EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners provide after - the -fact approval
of the Sheriffs Office submittal to the U.S. Department of Justice for the FY 2012 COPS
Hiring Program grant.
OBJECTIVE: To request after - the -fact approval from the Board of County Commissioners on
the submittal of a three -year grant application requesting $798,600 under the COPS Hiring
Program.
CONSIDERATION: The COPS Hiring Program provides federal funding to hire entry-level law
enforcement officers or rehire deputies who have been laid off or scheduled for lay -off as a result
of budget cuts. In the spring of 2011, the BCC approved and the Sheriff submitted a request to
hire four entry level deputies. The County was not awarded funding in 2011. However, on
March 1, 2012, CCSO was invited to update and resubmit the 2011 request for funding. The
grant application was due on March 22, 2012.
There have been some modifications to the COPS Hiring guidelines including the requirement
that all new entry -level law enforcement officers be military veterans who served on active duty
for a period of at least 180 days, any part of which occurred on or after September 11, 2001; the
federal funds will only cover 75% of the salary and benefits for the first three years, not to
exceed $125,000 per officer; a local match of 25% is required during the first 36- months. The
grant requires that CCSO add four entry-level law enforcement positions to the current number
of budgeted positions and retain the four positions for a minimum of 12 months after the
completion of 36- months of federal funding.
FISCAL IMPACT: The COPS Hiring application requested the following funding:
Federal funding FY201.3- FY2015: $500,000
Local match required FYI 3 -FY15: $298,600
TOTAL grant: $798,600
The 25% local match will come from Crime Prevention Funds, Confiscated Trust Funds, or other
CCSO funding sources. The CCSO will need to provide 100% of the salaries and benefits for
the four law enforcement positions for a minimum of 12- months in FYI 6.

SUBJECT: County Manager review and approval of a re- submission of the 2011 COPS Hiring
Grant sponsored by the United States Department of Justice in the amount of $798,600
The Collier County Sheriff's Office (CCSO) has been asked to resubmit their 2011 COPS Hiring
Program (CHP) grant application to request funding to cover the salary and benefits of four entry
level law enforcement officers for 36 months. A COPS Hiring Program Grant was submitted in
May 2011 requesting funding to cover the cost of salaries and benefits for these positions. CCSO
did not receive federal funding in 2011; however, the application was maintained in a "pending
pipeline" and the department has until March 22, 2012 to re- submit the grant application.
There have been some changes to the COPS Hiring Grant including:
• 2012 grants will cover 75% of approved entry -level salary and fringe benefits over 36
months up to a maximum federal share of $125,000 per officer position.
CCSO will be required to provide a minimum 25% cash match and cover the cost of salary
and fringe which exceeds the federal maximum of $125,000 per officer position.
All new hires must be military veterans who have served on active duty for a period of
more than 180 consecutive days, any part of which occurred on or after September 11,
2001, and who have been discharged or released from active duty under honorable
conditions.
• Over the course of the 36 month grant, CCSO must demonstrate an increase in its cash
match towards salaries and benefits.
CCSO will be responsible for retaining the four positions and covering 100% of the cost in
FY 2016.
Your approval authorizes the CCSO to submit the application online. CCSO will request
after the fact approval at the April 24, 2012 BCC meeting. Once you have reviewed the

dare(s) of the lay -offs; and/or budget documents ordering departmental and/or jurisdiction -wide budget cuts. These
records must be maintained with your agency's CHP grant records during the grant period and for three years following
the official closeout of the CHP grant in the event of an audit, monitoring, or other evaluation of your grant compliance.
If your agency's request is funded, it will have the opportunity after the award announcement to request a grant
modification to move awarded funding into the category or categories that meet your agency's law enforcement needs at
that time (including updating the dates of future scheduled lay -offs).

Community Policing Strategy
COPS Office grants must be used to reorient the mission and activities of law enforcement agencies through initiating
community policing or enhancing their involvement in community policing. If awarded funds, your responses to sections II
(a) and 11(b) that follow will constitute your agency's community policing plan under this grant. Your organization may be
audited or monitored to ensure that it is initiating or enhancing community policing in accordance with this plan. The COPS
Office may also use this information to understand the needs of the field, and potentially provide for training, technical
assistance, problem solving and community policing implementation tools. Please note that the COPS Office recognizes
that your COPS - funded officer(s) (or an equal number of veteran officers who are redeployed after hiring the entry-level
COPS - funded officers) will engage in a variety of community policing activities and strategies, including participating in

Residential dwelling burglaries have increased 30.4° between 2010 (931) and 2011 (1214) and the trend has continued during
the first few months of 2012. Residential burglaries are occurring throughout Collier County from residences in the rural "Estates ",
to low- income and middle class subdivisions, and upscale, gated communities.
The increase in residential burglaries may be related to a number of factors including high unemployment and home foreclosures,
an increase in prescription drug abuse, and easy access from the 1 -75 corridor connecting the Miami area to Naples/Ft. Myers and
Tampa /St. Petersburg.
Collier County is geographically the largest county east of the Mississippi River with a total land area of 2,025 square miles.
Collier County is larger that the states of Rhode Island and Delaware so the Collier County Sheriffs Office has large districts to
patrol with a sworn officer population that has continued to shrink during these fiscally constrained times.
Collier County has an annual countywide population of 321,520 according to the 2010 Census. There is a seasonal increase in
population, during the winter months, and according to the County's Land Development Services Department, there was an
estimated peak seasonal population of 389,149 residents in 2010.
The Greater Naples -Marco Island (Collier County, FL) community hosts over 1 million visitors annually. According to tourism
statistics over 1.38 million visitors came to Collier County in 2010.
With the addition of four entry-level COPS deputies, CCSO would address the spike in residential burglaries through increased
targeted patrols based on current trends, enhanced communication with residents, visitors, and a variety of organizations, and
increased crime prevention efforts. These enhancements would occur in partnership with numerous homeowners associations,
civic organizations, local police departments, tradtional and social media and others.
CCSO utilizes evidence based, best practices such as Data -Driven Approaches to Crime and Traffic Safety ( DDACTS). DDACTS
will be utilized to adddress trends along with other crime data collected, analyzed and mapped by CCSO. The Collier County
Sheriffs Office launched DDACTS in the fall of 2011. This operational model integrates location -based crime and traffic data to
establish effective and efficient methods for deploying law enforcement resources. DDACTS may prove to be beneficial in
addressing residential burglaries and agency efforts to enhance crime prevention.

The Collier County Sheriff's Office currently has COPS deputies in each of its six patrol districts.
Community Policing has been an integral part of the organization for a number of years as evidenced by
the agency's strategic and community safety plans. At the present time, COPS deputies provide a
quarterly report outlining all of the activities that occurred within their districts, meetings attended, problems
and disputes addressed during the quarter, community events attended and other activities that encourage
and foster interaction between law enforcement and the community.
CCSO currently collects, analyzes, and uses crime data and information to support a wide range of
problem solving goals. Examples of data being utilized to address a goal include the 2010 formation of the
Collier County Organized Retail Theft Association (CCORTA) to address larceny in area retail
establishments.
The agency is currently utilizing evidence based, best practices including DDACTS (Data- Driven

Given the collapse of the housing market, and the national and international economies, Collier County's economy has
suffered dramatically since 2008. The construction industry was the area's largest employer at the height of the building
boom. With the collapse of the area housing market, the county lost thousands of jobs in construction, real estate,
banking, engineering and other development related industries. As the housing dependent sectors declined, there was a
ripple effect in retail, hospitality and other industries. Prior to the economic downturn, area unemployment ranged from 3
to 5 %. Between 2009 and 2010, the unemployment rate skyrocketed to 11 and 12% with unemployment peaking at 13.3%
in August 2010.
(Along with the loss of construction related jobs, the tourism industry was impacted by the 2010 Gulf of Mexico -BP oil spill
`I Although no oil came ashore in the county, the number of visitors declined due to concerns about the oil spill impacts
along with the declining national and international economy. According to the local convention and tourism bureau,
(Collier County typically hosts over 1 million visitors annually. Both domestic and international visitors have declined in
recent years; however, in 2010 tourism increased by 3.3% over 2009 figures with over 1.3 million visitors.
negative economic impacts occurred in the agricultural sector with crop freezes in 2009 and 2010 resulting in
job losses.
Given the staggering job losses and unemployment rate, the number of housing foreclosures ballooned to 8,203 in 2009. '
Foreclosures in the county began to escalate in late 2007 to 3,267. By 2008 there were 7,872 foreclosures which peaked at
8,203 in 2009. Fortunately, the foreclosure rate slowed in 2010 but the fiscal impact on local government is continuing Into
e sixth straight fiscal year. High foreclosure rates (10 -11 %) have resulted in huge losses of local government revenue.

governments began to impose hiring freezes and In some cases furloughs and lay -offs.
As the Collier County Sheriff's Office prepares Its FY '13 budget, there will be no salary increases for the sixth consecutive
year. Within the agency, an exception basis hiring freeze has been in effect for the past few years. Collier County
government has requested that the Sheriff reduce his budget annually for the past five years which will continue in Fri 3.
During the past two fiscal years, the Sheriffs Office budget has been reduced by 5% annually. Fortunately, the reductions
in budget have come through attrition and reducing capital expenditures to zero for two consecutive years. To date, there
have been no Sheriff's Office lay -offs or furloughs but for the past few years vacancies could not be filled due to local
government budget constraints.

13. It will comply with the Human Subjects Research Risk Protections requirements of 28 CFR Part 46 if any part of the funded project
contains non - exempt research or statistical activities which involve human subjects and also with 28 CFR Part 22, requiring the
safeguarding of individually identifiable information collected from research participants.

14. Pursuant to Executive Order 13043, it will enforce on-the-job seat belt policies and programs for employees when operating agency -
owned, rented or personalty -awned vehicles.

set forth in the Anti- Lobby Act, 18 U.S.C. 1913.
18. In the event that a portion of grant reimbursements are seized to pay off delinquent federal debts through the Treasury Offset Program
or other debt collection process, it agrees to increase the non- federal share (or, if the awarded grant does not contain a cost sharing
requirement, contribute a nonfederal share) equal to the amount seized in order to fully implement the grant project.
19. None of the funds made available under the FY 2012 Appropriations Act (Public Law 112 -55) may be distributed to the Association
of Community Organizations for Reform Now (ACORN) or its subsidiaries."

A. No federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any person for
influencing or attempting to influence an officer or employee of any agency, a member of Congress, an officer or employee
of Congress, or an employee of a member of Congress in connection with the making of any federal grant; the entering into
of any cooperative agreement; and the extension, continuation, renewal, amendment or modification of any federal grant or
cooperative agreement;
B. If any funds other than federal appropriated funds have been paid or will be paid to any person for influencing or
attempting to influence an officer or employee of any agency, a member of Congress, an officer or employee of Congress, or
an employee of a member of Congress in connection with this federal grant or cooperative agreement, the undersigned shall
complete and submit Standard Form - LLL, "Disclosure of Lobbying Activities;' in accordance with its instructions; and
C.The undersigned shall require that the language of this certification be included in the award documents for all subawards
at all tiers (including subgrants, contracts under grants and cooperative agreements, and subcontracts) and that all sub -
recipients shall certify and disclose accordingly.
2. Debarment, Suspension and Other Responsibility Matters (Direct Recipient) As required by Executive Order 12549, Debarment
and Suspension, and implemented at 2 CFR Pan 2867, for prospective participants in primary covered transactions, as defined at 2
CFR Part 2867.20(a), the applicant certifies that it and its principals:
A. Are not presently debarred, suspended, proposed for debarment, declared ineligible, sentenced to a denial of federal
benefits by a state or federal court,or voluntarily excluded from covered transactions by any federal department or agency;
B. Have not within a three -year period preceding this application been convicted of or had a civil judgment rendered against
them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a
public (federal, state or local) or private agreement or transaction; violation of federal or state antitrust statutes or
commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax
evasion or receiving stolen property, making false claims, or obstruction of justice, or commission of any offense indicating
a lack of business integrity or business honesty that seriously and directly affects your present responsibility;
C. Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity (federal, state or local)
with commission of any of the offenses enumerated in paragraph (A)(ii) of this certification; and
D. Have not within a three -year period preceding this application had one or more public transactions (federal, state or local)
terminated for cause or default.
3. Federal Taxes and Assessments
A. If applicable, an applicant who receives an award in excess of $5,000,000 certifies that, to the best of its knowledge
and belief, the applicant has filed all federal tax returns required during the three years preceding the certification, has not
been convicted of a criminal offense under the Internal Revenue Code of 1986, and has not, more than 90 days prior to
certification, been notified of any unpaid federal tax assessment for which the liability remains unsatisfied, unless the
assessment is the subject of an installment agreement or offer in compromise that has been approved by the Internal
Revenue Service and is not in default, or the assessment is the subject of a non - frivolous administrative or judicial
proceeding.
B. The applicant certifies that it does not have any unpaid Federal tax liability that has been assessed, for which all
judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner
pursuant to an agreement with the authority responsible for collecting the tax liability.
If applicable, an applicant who receives an award in excess of $5,000,000 certifies that, to the best of its knowledge and belief, the

4. Drug -Free Workplace (Grantees Other Than Individuals)'
As required by the Drug -Free Workplace Act of 1988, and implemented at 28 CFR Part 83, for grantees/recipients, as defined at 28
CFR Part 83.660 -
A. The applicant certifies that it will, or will continue to, provide a drug -free workplace by:
(i). Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or
use of a controlled substance is prohibited in the grantee's workplace and specifying the actions that will be taken
against employees for violation of such prohibition;
(ii). Establishing an on -going drug -free awareness program to inform employees about -
(a) The dangers of drug (a) abuse in the workplace;
(b) The grantee's policy of maintaining a drug -free workplace;
(c) Any available drug counseling, rehabilitation and employee assistance programs; and
(d) The penalties that may be imposed upon employees for drug -abuse violations occurring in the workplace.
(iii). Making it a requirement that each employee to be engaged in the performance of the grant be given a copy of
the statement required by paragraph (i);
(iv). Notifying the employee in the statement required by paragraph (i) that, as a condition of employment under the
grant, the employee will -
(a) Abide by the terms of the statement; and
(b) Notify the employer in writing of his or her conviction for a violation of a criminal drug statute occurring
in the workplace no later than five calendar days after such conviction;
(v). Notifying the agency, in writing, within 10 calendar days after receiving notice under subparagraph 6v)(b) from
an employee or otherwise receiving actual notice of such conviction. Employers of convicted employees must

include the identification number(s) of each affected grant;

This disclosure form shall be completed by the reporting entity, whether subawardee or prime Federal recipient, at the initiation or
