EXECUTIVE SUMMARY Recommendation to approve the partial release of six liens in the Code Enforcement actions entitled Board of County Commissioners vs. Jean Cohen (as Trustee), relating to property known as Parcel No. 39440160005, Golden Gate Estates, Collier County, Florida. OBJECTIVE: That the Board of County Commissioners (Board) approve the partial release of multiple code enforcement liens for payment of $450, as to Parcel No. 39440160005 only, in relation to the Code Enforcement Special Magistrate actions entitled Board of County Commissioners vs. Jean Cohen Tr., Special Magistrate Case No. CENA20090015030, CENA20100012994, CENA20100018355, and CENA20110010628. CONSIDERATIONS: As a result of several code violations at 3132 Van Buren Street, multiple code enforcement liens encumber all real property of the owner, Jean Cohen, Trustee ( "Respondent "). Respondent also owns Parcel No. 39440160005 (no site address), which has no code violations but is encumbered by the liens. Collier County Real Property Management is requesting that the BCC accept the donation (companion item) of Parcel No. 39440160005 to be used as a future public water supply well site. If the donation of this parcel is approved by the BCC, Real Property Management will submit payment in the amount of $450 to partially release all six liens as to Parcel No. 39440160005 only. FISCAL IMPACT: Although the liens would be released as to Parcel No. 39440160005 only, the liens (and accrued interest) would continue to encumber all real and personal property owned by the Respondent. The $450 payment would cover all hard costs incurred in processing the six partial releases. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item is legally sufficient for Board action and requires a majority vote for approval. -JW RECOMMENDATION: That the Board accept payment of $450 and partially release the Liens (once payment is received) as described above, and also authorize the Chairman to sign the attached partial release.
