EXECUTIVE SUMMARY
Recommendation to approve a modification to Disaster Recovery Initiative Grant Agreement
#IODB- D4- 09- 21- 01 -KO9 between the Florida Department of Economic Opportunity (DEO) and
Collier County and amend the associated subrecipient agreements to reflect a reallocation of funds
to provide for resurfacing work within the Immokalee Stormwater Improvement Project, include a
bathroom expansion in the Immokalee Shelter Improvement project and update project work
plans; all with no fiscal impact.
OBJECTIVE: Obtain agreement from the grantor agency to provide for additional scope of work with
no additional funding.
CONSIDERATIONS: The BCC approved strategic plan includes Strategic Focus Area III: Community
Health, Wellness and Human Services, and the associated strategic goal is: "To improve the quality of life
and promote personal wellness, self reliance and independence ". Part of the agency's tactical
achievement toward this goal is the receipt and management of DRI fund grants. The purpose of the DRI
grant is to fund projects that provide disaster relief and long term recovery.
On May 25, 2010, item 16D10, the Board of County Commissioners accepted a federally - funded disaster
recovery agreement with the DEO. The subrecipients for two (2) of the approved projects have requested
an expansion to their project's scope of work. The estimated cost of each expansion will not require any
additional funds beyond those that have already been awarded to the subrecipients as the bids for the
current projects were less than the anticipated amount. To accommodate these changes a modification to
the Collier /DEO grant agreement must be submitted to the DEO. Additionally amendments to the
subrecipient agreements need to be approved to reflect the changes in the grant agreement.
The scope of work for the Immokalee Stormwater Improvement project will be expanded to include a
"resurfacing" activity. This project requires several crossover cuts to the road surfaces of the main roads
within the project. Resurfacing these roads instead of filling the multiple cuts would provide a better
finished product and reduce future maintenance costs. The activity is allowable with the grant and the
estimated cost of the resurfacing is $200,000. The Collier /DEO agreement modification reflects an
addition of the "resurfacing" activity for this amount.
The chart below depicts how the funds are being reallocated within the Immokalee Storm water
Improvement project's subrecipient agreement with the Immokalee Community Redevelopment Agency.

The Scope of work for the Immokalee Shelter enhancement project with the Public Schools of Collier
County will increase to include an expansion to the Immokalee Middle School cafeteria bathroom. The
bathrooms in the cafeteria of the Immokalee Middle School are not large enough to accommodate the
amount of persons that would be restricted inside during a storm. Expanding the bathroom facilities in

this area of the school would accommodate and contribute to the health and safety of those using the
shelter. This activity is allowable with the grant within the activity of "public facilities ". The
Collier /DEO grant agreement currently has all of the awarded funds for this project in the "public
facilities" activity. An amendment to the associated subrecipient agreement will add the bathroom
expansion to the scope of work for the project with no change in funding in the agreement
As part of the modification to the Collier/DEO contract work plans for all four (4) projects have
been updated. The updated project work plans closely reflect the actual status of each project.
The work plans within each subrecipient agreement have also been amended to coincide with the
work plans in the Collier/DEO agreement modification.

Once the DEO has provided approval for modification to the grant agreement, the subrecipient
agreements may be executed by the Board chair.
FISCAL IMPACT: Approval of this modification to grant agreement and the associated subrecipient
agreements will have no additional effect on ad valorem or general fund dollars. Disaster Recovery
Initiative grant funds are available within the Housing Grants Fund (705), Project 33104.
GROWTH MANAGEMENT IMPACT: Implementation of DRI will help facilitate efforts to meet the
goals, objectives and policies set forth in the Housing Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: This item is legally sufficient and requires a majority vote for Board

RECOMMENDATION: To approve and authorize the Chairman to sign modification #4 to Disaster
Recovery Initiative (DRI) grant Agreement #IODB- D4- 09- 21- O1 -K09 between the Florida Department of
Economic Opportunity (DEO) and Collier County, approve amendments to the associated subrecipient
agreements and authorize execution by the Chairman upon DEO approval of such modification.

MODIFICATION NUMBER 4 TO SUBGRANT AGREEMENT BETWEEN
THE DEPARTMENT OF ECONOMIC OPPORTUNITY AND
COLLIER COUNTY
This Modification is made and entered into by and between the State of Florida, Department of
Economic Opportunity, ( "the Department "), and Collier County, ( "the Recipient"), to modify DEO/DCA
Contract Number l ODB-D4-09-21 -0 1 -K09), award dated May 22, 2010 ( "the Agreement ").
WHEREAS, the Department and the Recipient entered into the Agreement, pursuant to which the
Department provided a subgrant of $9,963,208.00 to Recipient under the Small Cities Community
Development Block Grant ( "CDBG ") Program as set forth in the Agreement;
WHEREAS, the Department and the Recipient desire to modify the Agreement;
WHEREAS, pursuant to the provisions of Chapter 2011 -142, Laws of Florida, the DCA Division
of Housing and Community Development was transferred to the Department of Economic Opportunity
effective October 1, 2011; and the parties wish to reflect the new name.
NOW, THEREFORE, in consideration of the mutual promises of the parties contained herein,
the parties agree as follows:

1. The Agreement is hereby reinstated as though it had not expired.

by the revised Attachment A, the Program Budget, which is attached hereto and incorporated

provisions and caveats that meet or exceed the conditions agreed to in the Participating Party
Agreement between the Recipient and the original Participating Party.

THE SUBRECIPIENT AGREES TO:
A. PROJECT SCOPE:
The Immokalee Area CRA project will purchase a minimum of five (5) acres of vacant land to
develop a storm water pond site. The land to be purchased may consist of a single site or
multiple sites. Additionally, the Immokalee Area CRA will undertake a flood and drainage
improvement project to result in the installation of a minimum of 13,625 linear feet of pipes,
swales, culverts, associated materials and related site restoration activities to include
resurfacing and restrilina of roadways affected by the project and using a minimum of 17,819
square yards of material. The project will be further defined in the construction agreements,)
that will be subsequently approved by the Board of County Commissioners. Project funds will
also be used for Construction Engineering Inspections as determined by the Florida Rural
Utilities Service (RUS) bulletin.

SCOPE OF SERVICES

Shelter Enhancement /Generator Project
A. PROJECT SCOPE:
On May 25, 2010 the Board of Commissioners approved Disaster Recovery Grant
Agreement #IODB- D4- 09- 21- 01 -KO9 with the Florida Department of Community
Affairs. Details of this scope of work are consistent with and support certain details of
that agreement.
The School District of Collier County will undertake improvements to the public
facilities of Immokalee High School and Immokalee Middle School. The results of the
project consists of the installation of a generator at Immokalee High School, a generator
at Immokalee Middle School, and installation of impact resistant windows and doors at
and a cafeteria bathroom expansion at the Immokalee Middle School. This funding will
cover all costs associated with the installation of two (2) generators, and a minimum of
27 openings to be replaced with impact resistant windows or doors and an expansion of
the cafeteria bathroom at the Immokalee Middle School. The project will be further
defined by the DCA approved bid specifications and contractor eligibility.
The detailed project scope will be contained in the results of the solicitation for bid of the
vendor awarded the project's construction contract. The project construction contract
will include details sufficient to document the number, amount and costs associated with
all activities.
