EXECUTIVE SUMMARY
Recommendation for the Chairman to execute a "Delegation of Authority to Act as Certifying
Officer" form designating the Collier County Manager as the Certifying Officer for Environmental
Reviews required for federally funded grant projects.
OBJECTIVE: Appropriately place the authority for certifying grant required environmental
reviews.
CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD)
requires local governments to complete an Environmental Review for federal grant related
projects that are federally funded. The Environmental Review must be completed for each
project, certified by the local Certifying Officer and made a part of the permanent project file.
Housing, Human, and Veteran Services routinely prepares the required Environmental Review
reports. Each report contains information about any potential environmental factors that may
impact the project site.
Section 104(g) of the Housing and Community Development Act of 1974 allows local
governments to act as the responsible entity for environmental review, decision - making, and
action that would otherwise apply to HUD under the National Environmental Policy Act
(NEPA).
The attached Delegation of Authority to Act as Certifying Officer form has been provided to
Collier County to designate the local Certifying Officer and for compliance with 24 CFR Part
58 — Environmental Review Procedures for Entities Assuming HUD Environmental
Responsibilities.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: The Delegation of Authority Form has been approved for use
by HUD. This item is legally sufficient and requires a majority vote for Board action. -JBW
RECOMMENDATION: That the Board authorizes the Chairman to execute the attached
Delegation of Authority to Act as Certifying Officer form designating the County Manager as the
Certifying Officer for Environmental Reviews required for federally funded grant projects.

Delegation of Authority to Act as Certifying Officer
I, the Chief Elected Officer of Collier County, on behalf of the Collier County Board of County
Commissioners, hereby delegate to the Collier County Manager, an official of Collier County, all
authority necessary to act as Certifying Officer for Collier County under Section 104(g) of the
Housing and Community Development Act of 1974, as amended (42 U S.C. 5304 (g)) (HUD
Act), in connection with the receipt of assistance from the U.S. Department of Housing and
Urban Development (HUD) under Title I of the HUD Act. Such authority hereby delegated
includes, but is not limited to, the authority to execute the certification required under Section
104(g) of the HUD Act ; the authority to specify when appropriate that the jurisdiction has fully
carried out its responsibilities for environmental review, decision making and action under
Section 104(g)(1) of the HUD Act; the authority to consent to assume the status of a responsible
Federal Official under the National Environmental Policy Act of 1969 and other provisions of
law specified in the regulations of HUD in 24 CFR Part 58; and the authority to consent on
behalf of Collier County the acceptance of the jurisdiction of the Federal courts for the purpose
of enforcement of the responsibilities as responsible Federal Official.
This delegation is effective as of _day of 12012.
