Agenda 02/28/2012 Item #16A142/28/2012 Item 16.A.14.
EXECUTIVE SUMMARY
Recommendation to extend Contract #07 -4105 with White & Smith, LLC, Planning
and Law Group, under the same terms and conditions as the original contract, for
a period of nine (9) months, ending on December 11, 2012 (fiscal impact: time
extension only).
OBJECTIVE: To extend an existing contract with White & Smith, LLC Planning and Law
Group to help staff prepare the Collier County Administrative Code and update and
rewrite identified sections of the Land Development Code.
CONSIDERATION: The Board of County Commissioners (Board) awarded Contract
#07 -4105, in the amount of $147,972.00, to White & Smith, LLC Planning and Law
Group (Consultant) on September 11, 2007, to assist staff with the development of a
Collier County Administrative Code and related amendments to the LDC. Consistent
with the terms of the Agreement, additional extensions to the contract not to exceed four
(4) years were approved, thereby renewing the contract through September 10, 2011.
An additional six (6) month extension to March 11, 2012 was approved, consistent with
County's Purchasing Policy, Section XV.D., at the request of the contract manager to
the Purchasing /General Services Director on July 18, 2011. Copies of the original
contract, change order and extension letters are attached.
Because all extensions under the agreement have been exhausted, Board approval is
needed for any further amendment to extend the existing contract beyond March 11,
2012. The contract extension will allow the Consultant to continue assisting the County
for the duration of the amendment cycle, anticipated to be completed in September
2012. The consultant will be responsible for making revisions to the Administrative
Code, assisting in the development of LDC amendments, attending public hearings, as
well as preparing the final documents after adoption.
The Administrative Code combines the procedures for developing property that are
contained throughout the Land Development Code into a single document. It is
intended to be a user - friendly document that can be utilized by County staff, applicants,
and design consultants to easily understand many of the complex permitting processes
that are available in Collier County. The Administrative Code will describe the
permitting and notification procedures; identify who is eligible to file an application;
describe the agencies and officials involved in the review process and the criteria
established for the review; and be incorporated by reference in the LDC. Once
adopted, the LDC will be amended to remove many of the procedural requirements.
The proposed Administrative Code and related LDC amendments will not affect any
regulatory provisions that currently exist.
A completed draft of the Administrative Code was submitted to the County in February
2010. However, due to County staff reductions and turnover, the completion and
adoption of the Administrative Code has been on hold. The County intends to finalize

the Administrative Code and related LDC amendments as part of the 2012 LDC
Amendment Cycle 1, which is scheduled to go before the Board for final approval by
September 2012. County staff has completed a review of the draft document and has
engaged the Consultant to make revisions. Due to the amount of time that has passed
since the draft was completed, many of these revisions are needed to ensure
consistency with recent County amendments and changes to Florida Statutes.
The following table documents the funds expended on the project as of 2/7/12, and
shows the outstanding balance of $62,045.45.

FISCAL IMPACT: The proposed extension does not change the awarded and total
budgeted contract amount of $147,972. A purchase order in Fund 131 (Land
Development Services) was "rolled" from FY2011 into FY2012, and covers the
remaining balance of $62,045.45.
GROWTH MANAGEMENT IMPACT: Approval of this contract extension will not affect
the Growth Management Plan. The proposed Administrative Code and related
amendments to the Land Development Code will result in a document that is more
easily understood and applied, and will have a substantial positive impact on the
County's ability to effectively and expeditiously process and manage land use and
building permit applications and business functions and will result in fewer errors by the
staff and the users of the Land Development Code.
LEGAL CONSIDERATIONS: The Board may approve amending Contract #07 -4105 to
extend the agreement an additional nine (9) months, as requested by staff, consistent
with Purchasing Policy section XVD. This item has been reviewed and approved by the
County Attorney's Office, is legally sufficient for Board action and only requires a
majority vote for approval —SRT.
