EXECUTIVE SUMMARY
Recommendation to adopt a resolution authorizing the condemnation of a Road Right -of -Way,
Drainage and Utility Easement necessary for the construction of intersection improvements at 18th
Avenue NE and Everglades Boulevard. Transportation Intersection Safety and Capacity
Improvement Program (Project No. 60016). Estimated fiscal impact: $14,000.00.
OBJECTIVE: To authorize the condemnation of a Road Right -of -Way, Drainage and Utility Easement
necessary for the construction of improvements at the intersection of Everglades Boulevard and 18"' Avenue
NE.
CONSIDERATIONS: A Road Right -of -Way, Drainage and Utility Easement is needed for the
construction of a wider pavement edge turning radius at the southeast corner of the intersection of 18th
Avenue NE and Everglades Boulevard, so that school buses and larger vehicles making the northbound -to-
eastbound right turn from Everglades Boulevard onto 18th Avenue NE are able to stay completely within the
proper lane all the way through the turning movement. The owner of the property from which the easement
is required has demonstrated an unwillingness to negotiate for the sale of the easement to the County ever
since he learned that his lender might take all the proceeds from the sale, as is the lender's right under the
terms of the mortgage. Therefore, taking the easement, using the County's power of eminent domain in
accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, will be necessary for the
construction of the proposed improvements.
The Board is herewith being advised of the various factors considered by its professional engineering staff,
which include the environmental impacts, costs, public health, safety and welfare considerations, and the
long -range planning needs and impacts. In this regard the Board is referred to the attached technical
memorandum prepared by Julio Ordonez, P.E., Traffic Operations Section of the Transportation Engineering
Department of the Growth Management Division. By its review, concurrence and approval of this executive
summary, the back -up documentation, and the proposed resolution, the Board will have determined that the
Road Right -of -Way, Drainage and Utility Easement legal description (attached to the Resolution as Exhibit
"A ") is required for the construction of the proposed improvements; and that it is necessary and in the
public's best interest to take the easement through the County's power of eminent domain.
FISCAL IMPACT: Should negotiations with the property owner fail to yield a settlement, and
condemnation of the subject easement become necessary, the total costs are estimated not to exceed
$14,000.00, which will come from the Transportation Supported Gas Tax fund. This amount includes not
just the direct cost of the easement itself, it also includes all expenses for title work, real estate appraisals,
filing fees, and those expenses, such as property owner attorney fees and expert witness fees, which the
County is required to pay under the provisions of Sections 73.091 and 73.092, F.S.
GROWTH MANAGEMENT IMPACT: As part of the County's proposed 5 year transportation work
program, the Transportation Intersection Safety and Capacity Improvement Program is an integral part of
Collier County's Growth Management Plan.
LEGAL CONSIDERATIONS: A duly noticed public hearing is needed to acquire property by
condemnation. A majority vote is needed for approval. - HFAC
RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida:
1. Adopt the attached Resolution;
2. Authorize its Chairman to execute same on behalf of the Board; and
3. Authorize any budget amendments that may be necessary to implement the collective will of the Board
as evidenced by the adoption of the attached Resolution and the approval of this Executive Summary.

A RESOLUTION AUTHORIZING THE CONDEMNATION OF A ROAD
RIGHT -OF -WAY, DRAINAGE, AND UTILITY EASEMENT NECESSARY
FOR THE CONSTRUCTION OF INTERSECTION IMTROVEMENTS AT
18TH AVENUE NE AND EVERGLADES BOULEVARD.
(TRANSPORTATION INTERSECTION SAFETY AND CAPACITY
IMPROVEMENT PROGRAM PROJECT NO. 60016.)
WHEREAS, the acquisition of right -of -way for the construction of intersection
improvements is included in Collier County's Five Year Transportation Work Program (Project No.
60016); and
WHEREAS, school buses and larger vehicles making the northbound -to- eastbound right
turn at the intersection of 18th Avenue NE and Everglades Boulevard require a larger pavement
curve radius than presently exists in order to stay completely within the proper lane all the way
through the turning movement; and
WHEREAS, plans and specifications have been prepared for improvements to said
intersection; and
WHEREAS, construction of the proposed intersection improvements will require the
acquisition of additional right -of -way at the southeast corner of said intersection; and
WHEREAS, the location for the construction of the proposed improvements has been fixed
by survey and is collectively represented by the legal description attached hereto as Exhibit "A" and
which by reference is made a part hereof; and
WHEREAS, after consideration of the availability of alternate routes and locations, the
comparative costs of the project alternatives, various impacts upon the environment, long range
planning options, and public safety considerations, the Board desires to exercise its right to
condemn property for public purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the Board
that the intersection improvements at referenced above at 186' Avenue NE and Everglades
Boulevard (hereinafter referred to as "the Project "), being part of the Transportation Intersection
Safety and Capacity Improvement Program (Project No. 60016), is necessary and in the public's
best interest in order to protect the health, safety and welfare of the citizens of Collier County.
AND IT IS FURTHER RESOLVED that the acquisition of the proposed easement described
in Exhibit "A" for construction of the Project is an integral part of the County's long range planning
effort, and is included in the Capital Improvement Element of the Collier County Growth
Management Plan, as approved by the Florida Department of Community Affairs.

AND IT IS FURTHER RESOLVED that the Board has reviewed the technical
memorandum discussing competing alternatives for construction of the Project, and the costs
associated with the design, property rights acquisition, and construction of the Project, as well as
public safety and welfare considerations associated with the design and construction of the Project,
and various impacts to the environment, and the Board finds that after consideration of these issues,
the most favorable alternative for construction of the proposed improvements requires the
acquisition of the Road. Right -of -Way, Drainage and Utility easement described in Exhibit "A ",
attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that the taking of the perpetual, non - exclusive Road
Right -of -Way, Drainage and Utility Easement described in Exhibit "A" will provide County with
the right to place and/or excavate materials for the purpose of constructing, operating, and
maintaining roadway, bikepath and sidewalk improvements, drainage structures, including but not
Iimited to ditches, swales, earthen berms, rip -rap and retaining wall systems, underground pipes,
various types of water control structures and any and all manner of public and private utility
facilities.
AND IT IS FURTHER RESOLVED that all property shall be put to public purposes.
AND IT IS FURTHER RESOLVED that the County staff and Office of the County
Attorney are hereby authorized and directed to immediately acquire by gift; purchase or
condemnation in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, the
easement more particularly described in Exhibit "A," attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the property
sought to be acquired and therefore it will not be necessary to remove any mobile homes from the
property to be acquired.

1.0 INTRODUCTION
Collier County is undertaking intersection improvements on Everglades Boulevard at 18a'
Avenue N.E. intersection. The project is located in the eastern part of the county, as shown in
Figure 1. The specific purpose of the project is to improve safety and enhance capacity at the
existing intersection within the limits shown in Figure 2.
2.0 PROJECT DESCRIPTION
The Collier County Transportation Engineering Department proposes minor intersection
improvements on Everglades Boulevard at 18�' Avenue N.E. Ultimate improvements for this
corridor are projected to take place beyond the 2035 long range plan.
The intent of the project is to improvement the radii at the northeast and southeast corners of the
Everglades Boulevard/18t' Avenue N.E. intersection. These minor and cost effective
improvements will allow school buses and other larger vehicles to make better and safer turns as
shown in Figures 4 and 6.
3.0 NEED FOR IMPROVEMENTS
This project is being developed to accommodate the school buses and other larger vehicles for
right turn movements on the northbound approach of Everglades Boulevard at the 18th Avenue
N.E. intersection. Additional right -of -way must be acquired on land parcels at the southeast and
northeast corners of the Everglades Boulevard/18'b Avenue N.E. intersection to be able to
construct the improvements. The parcel at the northeast corner is desirable to improve visibility
at the intersection, so it should be acquired only if the property owner is willing to work with
the County. The parcel at the southeast corner is necessary to improve the intersection geometry
to facilitate turning maneuvers, so it must be acquired via condemnation if needed.
4.0 EXISTING CONDITIONS
4.1 Roadways
Everglades Boulevard is a two -lane two -way arterial road with a dedicated northbound right
turn lane and southbound left turn lane at the 18th Avenue N.E. intersection. 18th Avenue
N.E. is a two -lane two -way collector road with a dedicated westbound left turn lane at the
intersection with Everglades Boulevard (Figure 4 -1).
4.2 Right -of -way
The existing right -of -way on Everglades Boulevard is 100', with the existing roadway
centered in the eastern half of the easement. On 18th Avenue N.E., the existing right -of -way
is 60', with the existing roadway centered on the easement. All of the existing right -of -way
within the project limits is cleared and maintained by Collier County periodically.

4.3 Utilities
The existing power lines (FPL) on Everglades Boulevard are located along the east right -of-
way line and on 18th Avenue ME along the south right -of -way line. Telephone lines
(Century Link) follow the same location and Cable TV lines (Comcast) are attached to the
power poles. An existing power pole located at southeast corner of the intersection
precludes the construction of a larger radius for the turns.
4.4 Traffic Signals
This intersection is currently signalized, with the system operating during school hours and
on flashing mode the rest of the day. Existing traffic signal poles are located at the
southwest and northeast corners of the Everglades Boulevard/18t' Avenue N.E. intersection.
5.0 EVALUATION FACTORS
The following factors were considered during the evaluation of the project to be completed:
5.1 Alternative Alignments
Basically three conditions were considered during the evaluation of the project:
• Existing alignment without any improvements (Figure 3).
• Alternative 1: Improvements to the southeast and north east corners - existing alignment
with improvements at the southeast and northeast corners of the intersection. This
alternative consists on improving the return radii at the southeast and the northeast corners
of the intersection, as shown in Figure 4.
With this alternative, right -of -way acquisition is required. Corner clip parcels will be
needed to accommodate the proposed improvements. The existing power pole could be
relocated to provide more room for the construction a larger turning radius for the
northbound right turn lane at the southeast corner. The existing signal pole could also be
relocated to provide more and safer utility clearance, providing for improved sight distance
at the northeast corner. A SFWMD permit will not be required.
The limits of the project will be localized and confined to the southeast and the northeast
comers of the intersection. The cost of the project is minimal compared with the added
benefits (see section 5.5 below).
Alternative 2: Improvements to shift the intersection westward New alignment on
Everglades Boulevard to avoid improvements at southeast corner of the intersection. This
alternative consists on improving the entire intersection by shifting it approximately 17' to
the west of its current location, as shown in Figures 5A and 5B.
With this alternative, neither right -of -way acquisition nor utility relocations will be needed.
The shifting of the entire intersection will take place in a fully cleared and maintained right -

of -way on Everglades Boulevard, thus having negligibly environmental and drainage
impacts. A SFWMD permit will be more likely required.
The limits of the project will be increased to more than 1,000 feet north and south of the
intersection. These improvements are shown in Figure 5 -4. The cost of this alternative is
very high compared with the added benefits (see section 5.5 below).
5.2 Public Safety
Construction of the improvements at the Everglades Boulevard/18t' Avenue N.E.
intersection will improve the turning of school buses and other larger vehicles at this
location. The larger radius at the southeast corner of the intersection will provide for better
right turn movements on the northbound approach and better vehicular operations,
enhancing the capacity of the facility. Pedestrian and bicycle facilities are none existing
within the project limits.
5.3 Long Range Planning
The Collier County Transportation Planning Department identifies improvements to the
Everglades Boulevard corridor from I -75 to Golden Gate Boulevard in its 2035 Long Range
Transportation Plan; improvements from Golden Gate Boulevard to Randall Boulevard are
identified to take place outside this plan, beyond the 2035 planning window. The Everglades
Boulevard at 18a' Avenue N.E. intersection is included within this corridor, construction of
the ultimate improvements will take many years before any construction gets done at this
location.
5.4 Environmental Impact
No significant environmental impacts were found at the intersection of Everglades
Boulevard and 18'b Avenue N.E. with any of the alignment alternatives reviewed in 5.1
above. Alternative 1 considers improvements at the southeast and northeast corners in fairly
small property parcels that will have no significant impacts to the environment or the
drainage of patterns in the area. Alternative 2 considers improvements to the entire right -of-
way corridor on Everglades Boulevard, which is currently cleared and maintained by the
County; still, a SFWMD permit is very likely to be required because of the size of the
proj ect.
5.5 Costs
The following are the costs estimated for the alignment alternatives reviewed in 5.1 above:
• Existing alignment without any improvements: $0.00
• Existing alignment w /improvements at the SE corner, Alternative 1: $30,000.00
(Table 1).
• New alignment on Everglades Boulevard at the SE corner, Alternative 2: $660,000.00
(Table 2).

6.0 SUMMARY OF PROPOSED IMPROVEMENTS
Improvements to the intersection of Everglades Boulevard at 18th Avenue N.E. can be
accomplished in a very quick and cost effective manner by implementing Alternative 1. The
cost of the improvements at the southeast is significantly lower than Alternative 2, which
requires the shifting of the entire roadway on Everglades Boulevard.
Alternative 1 is recommended for implementation.
