EXECUTIVE SUMMARY
Recommendation to approve six (6) mortgage satisfactions for the State Housing Initiatives
Partnership (SHIP) Loan Program in the combined amount of $17,500.
OBJECTIVE: To support the affordability of housing in Collier County through the SHIP down
payment and emergency repair and/or rehabilitation assistance programs.
CONSIDERATIONS: SHIP, a state affordable housing program, offers assistance to first-time
homebuyers for use toward a portion of the required down payment and emergency repairs to the newly
acquired home. As a condition of the award, the homeowner must repay the assistance provided upon
sale, refinance or loss of homestead exemption.
Community and Human Services (CHS) staff has recently completed a review of County-issued SHIP
loans. Through this process, staff has identified six (6) mortgages where the homeowner is entitled to
have their original down payment assistance forgiven. None of the mortgages include a maturity date.
Section 95.281(1)(b) F.S. allows this debt to be forgiven if the mortgage is more than twenty (20) years
old and the final maturity of an obligation secured by the mortgage is not ascertainable or previously set
forth in the mortgage. Under such circumstances, the mortgage is considered terminated and for record
purposes, the down payment amount may be forgiven.
Therefore, due to the length of time of the mortgage, the following homeowners have met the obligation
and the loan should be forgiven. SHIP Ordinance No. 93-19 did not require a maturity date.
The following table provides details regarding the associated mortgages that have met their obligation. As
such, satisfactions are required.

Approval of these items will authorize the Chairman to sign the aforementioned satisfactions of mortgage
and the executed documents shall be recorded in the Public Records of Collier County, Florida.
FISCAL IMPACT: There is no Fiscal impact associated with the Satisfactions of Mortgage. The $52.50
recording fee will be paid by SHIP Grant Fund (791), Project 33525.1.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote

give Lender written notice for any investigation, claim, demand, lawsuit or other action by any governmental or regulatory agency or private party
involving the Property and any Hazardous Substance or Environmental Law of which Borrower has actual knowledge. If Borrower learns, or
is notified by any governmental or regulatory authority. that any removal or other remediation of any Hazardous Substance affecting the Property
is necessary. Borrower shall promptly take all necessary remedial actions in accordance with Environmental Law. As used in this paragraph 20,
"Haz.ardous Substances" arc those substances defined as toxic or hazardous substances by Environmental Law and the following substances:

Unless Lender and Borrower otherwise agree in writing, insurance proceeds shall be applied to restoration or repair of the

Enwonmental Law and the following substances: gasoline, kerosene, 0H1er flammable or toxic petroleum products, toxic
pesticides and herbicides. volatile solvents, materials containing asbestos or formaldehyde. and
radioactive materials. As used in this paragraph 20. "Environmental Law· means federal laws and laws of the 1u'nsd1ct1on

21. Acceleration; Remedies. Lenlier shall give notice to Borrower pnor to acceleration following Borrower's
