EXECUTIVE SUMMARY
Recommendation to accept and approve the Florida Department of Environmental Protection’s
offer to pay for and have their appointed contractor investigate a historic fuel discharge at the Old
Fuel Island site at the Government Complex.
OBJECTIVE: To permit the Florida Department of Environmental Protection (FDEP) appointed
contractor to undertake the study at FDEP cost, and hence to ascertain if the historic fuel discharge site is
now sufficiently self-remediated to be eligible for a Site Rehabilitation Completion Order (SRCO)
approval.
CONSIDERATIONS: A responsibility of the Solid and Hazardous Waste Management Division is to
monitor and maintain county-owned fuel tanks in a safe and code compliant condition. Included in this
responsibility is also the monitoring of the spill cleanup status of any past or present accidental county
discharges.
The Old Fuel Island site at the government complex is recorded as having a historic petroleum discharge,
the cleanup responsibility for which resides with the FDEP, and that is eligible for FDEP cleanup funds
through the state Inland Protections Trust Fund (IPTF). While the discharge occurred about 1983, the
cleanup of the site by the FDEP has been inactive since then due to its low cleanup priority scoring by the
FDEP.
Due to natural attenuation of the previously spilled fuel contaminants over time, the FDEP believes there
is a possibility that the Old Fuel Island might have already achieved satisfactory soil and groundwater
cleanup target levels and that would make it eligible for a SRCO, thus releasing the site from any future
FDEP cleanup actions.
In an effort to re-evaluate these historic sites, the FDEP has thus initiated a new program termed Low
Score Site Initiative (LSSI) in which, funded sites with low scores are being assessed for current levels of
contamination. The funding cap for the program is $30,000 per site and no prior investment is required
by the property owner (County). However, if it is determined that the site is eligibl e for a SRCO, the
deductible for the program is eligible to be collected. In this case however, no deductible payment is
required in the event closure is obtained since the Old Fuel Island is in the original Early Detection
Incentive (EDI) program which has no cap or deductible.
FISCAL IMPACT: There is no fiscal impact to the County for this study.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: To accept and approve the Florida Department of Environmental Protection
offer to pay for and have their appointed contractor investigate the Old Fuel Island Discharge site; and
authorize the Chairman to execute the attached Real Property Owner Affidavit initiating such work.
