Recommendadon to approve tide execution of a Corrective Easement to FP&L at a cost
not to exceed $19.
0113AG IdE: To correct a scrivener's error in the legal description of an easement to Florida
Power & Light Company (FP&L.) recorded in the Public Records.
CONSIDERATIONS: During the course of recent title review and surly work, it was
determined that 'a previously approved Easement to FP&L, recorded in OfflcW Records Book
3616, at Page .1850, Public Records of Collier County, had a scrivener's error in the legal
description attached as Exhibit A. Accordingly, a Corrective Easement is required to enter the
correct legal description and sketch in the Public Records of Collier County.
A location map identifying the correct location of the FP &L line is attached for reference.
FISQ& IMPACT: Funds not exceeding $19 to record the Corrective Easement are available in
Solid Waste Fund 474, under Project 59005, which is consistent with FY12 Capital Budget
approved September 29, 2011.
LEGAL CQNSIQERATJM The attached Corrective Easement has been approved for form
and legal sufficiency. This item requires a majority vote for approval. -JBW
GROWTH MANAGEMENT t ACT There is no impact to the Growth Management Plan.
RECOM MND,,_A`: That the Board:
1. Approves, and authorizes the Chairman to execute, the attached Corrective
Easement.
2. Directs the County Manager or his designee to prod to record the Corrective
Easement in the Public Records of Collier County, Florida.

The undersigned, in consideration of the payment of $1.00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents, successors, and assigns, an easement
forever for the construction, operation and maintenance of overhead and underground electric
utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be
installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the
voltage, as well as, the size of and remove such facilities or any of them within an easement of
10 feet in width, described as follows:
An FP &L Company easement more particularly described on Exhibit "A" attached
hereto and made a part hereof. Said legal description and sketch prepared by
Thomas E. Rhodes of Rhodes & Rhodes Land Surveying, Inc.
Together with the right to permit any other person, firm or corporation to attach wires to any
facilities hereunder and lay cable and conduit within the easement and to operate the same for
communications purposes; the right of ingress and egress to said premises at all times; the right
to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the
easement area;. to trim and cut and keep trimmed and cut all dead, weak,- leaning or
dangerous trees or limbs outside of the easement area which might interfere with or fall upon
the lines or systems of communications or power transmission or distribution; and further grants, to
the fullest extent the undersigned has the power to grant, if at ail, the rights hereinabove
granted on the land heretofore described, over, along, under and across the roads, streets or
highways adjoining or through said property.
