Recommendation to approve execution of a Utility Facilities Warranty Deed and Bill of Sale to,
convey the wastewater utilities iin€rastructure at the Collier County public beach facilities at
Biuebill Ave. to the Collier County Water -Sewer District, at an estimated cost of 535.50.
QBJEC M: To convey wastewater utilities installed within road right -of -way to the Collier County
Water -Sewer District (CCWSD) for continued maintenance and ownership.
CQNSiU =- I The construction of the wastewater infrastructure within the right -of -way at
Bluebill Avenue and Gulf Shore Drive has been completed and preliminary acceptance of the wastewater
Utilities has been issued by Growth Management Division (GMD). A Bill of Sale to the CCWSD for the
wastewater utilities installed within the road right -of -way is required to convey ownership at the time of
final acceptance for ongoing and continued maintenance of the wastewater utilities and future installation,
as needed. The County's GMD will process the final utility conveyance acceptance per the Utility
Ordinance and a copy of the recorded Bill of Sale should be delivered to GMD for that process. The
recording of this Bill of Sale does not constitute final acceptance.
A location map of the utility conveyance area is attached for reference.
FISCAL RyVACT: The total cost for recording the Bill of Sale will not exceed $35.50. Funds in the
amount of $35.50 are available in the budget in TDC Fund 183 under Project No: 800581.
LEGAL CONSIDERATIONS: The attached Bill of Sale has been approved for form and legal
sufficiency. This item requires a majority vote for approval. -3BW
GROWTH MANAGEMEN V ACT: There is no impact to the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners:
1. Approve the attached Bill of Sale.
2. Authorize the Chairman to execute the Bill of Sale.
3. Directs the County Manager or his designee to proceed to record the Bill of Sale in the Public
Records of Collier County, Florida.

UTILITY FACILITIES WARRANTY DEED AND BILL OF SALE
THIS INDENTURE made this day of , 2012, between COLLIER COUNTY,
a political subdivision of the State of Florida, whose mailing address is 3335 Tamiami Trail E., Suite
101, Naples, FL 34112 (hereinafter referred to as "Grantor"), and the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY
AND AS THE EX- OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT, its
successors and assigns, whose mailing address is 3335 Tamiami Trail E., Suite 101, Naples, FL 34112
(hereinafter referred to as "Grantee").
WITNESSETH:
That said Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other
good and valuable consideration to said Grantor in hand paid by said Grantee, the receipt
whereof is hereby acknowledged, has granted, bargained and sold to the sold Grantee, and
Grantee's heirs, successors and assigns forever, all wastewater, and /or utility facilities and /or
system(s) or portion(s) thereof lying in or around the southwest corner of the intersection of
Bluebill Ave. and Gulf Shore Dr. as shown on the graphic. "Exhibit "A" attached, for operation,
relocation, installation, repair and /or maintenance of said existing and any future utility facilities,
systems) or portion(s) thereof, all situate and lying and being in Collier County, Florida, to wit:
(See Exhibit "A" attached hereto and incorporated by reference herein.)
and said Grantor does hereby fully warrant the title to said utility facilities and /or system(s) or
portions) thereof, be they realty,, personalty, or mixed, and Grantor will defend such title against
all claims of all persons whomsoever. For the purposes of this conveyance, the utility facilities,
system(s) and /orportion(s) thereof conveyed herein shall not be deemed to convey any of the
lands described in either exhibit. Grantor and Grantee are used for singular or plural as context
allows. A list of the utility facilities, etc., being conveyed is attached as Exhibit "B ".
TO HAVE AND TO HOLD the some unto the Grantee and its assigns, together with the
right to enter upon said land, excavate, relocate and /or take or introduce materials for the
purpose of constructing, relocating,, operating, repairing and /or otherwise maintaining utility
systems thereon. Grantor and Grantee are used for singular or plural, as the context requires.
