EXECUTIVE SUMMARY
Recommendation to approve a resolution to authorize an upland lease
application with the Board of Trustees of the Internal Improvement. Land Trust
Fund of the State of Florida for the Parks and Recreation Department to manage
the ' newly constructed Isles of Capri Paddle Craft Park .constructed by Rookery
Bay National Estuarine Research Reserve.
OBJECTIVE: To obtain approval to enter into a sublease agreement with the Board of
Trustees of the Internal Improvement Land Trust Fund of the State of Florida
(hereinafter referred to as the "State of Florida ") for the Parks and Recreation
Department to manage the newly constructed kayak launch at Rookery Bay.
CONSIDERATIONS; Rookery Bay National Estuarine Research Reserve is
completing the construction of a kayak/canoe launch located on the comer of Collier
Boulevard and Isles of Capri. The park once completed will allow non- motorized water
access to residents of Collier County. While funds were available-for construction ,of the
park, on- going maintenance of the facility is required.
The Parks and Recreation Department employs maintenance. staff to provide mowing,
landscape maintenance, and oversight of beach and water facilities throughout Collier
County. The Department is positioned to provide for the maintenance of this facility
under the auspices of a sub - lease agreement between Collier County Board of County
Commissioners and the State of Florida.
In order to memorialize an agreement as described above, an upland lease application
must be filed with the State of Florida, which details the intent of the Board of County
Commissioners to manage the day to day operations of the facility. Staff is not
recommending that the Board of County Commissioners be responsible for any future
capital improvements at this location. After the application is accepted by the State of
Florida, a sub -lease agreement would be presented to the Board of County
Commissioners for consideration.
FISCAL IMPACT: It is estimated that there will be a financial impact of approximately
$2,500 in FY12 and then $5,000 annually thereafter. Current estimates include:

These funds are budgeted within the Beach and Water Cost Center associated with the
Parks and Recreation. Department. Revenue projections will be determined and
included in the FY 2013 budget once some history on the facility usage is accumulated.

RESOLUTION NO. 2012-
^ A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS,
COLLIER COUNTY, FLORIDA, APPROVING, AND AUTHORIZING STAFF
TO PREPARE AND SUBMIT AN UPLAND SUBLEASE APPLICATION TO
THE TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND, AND
AUTHORIZING THE CHAIRMAN TO EXECUTE AND DELIVER A
SUBLEASE AGREEMENT AND RELATED INSTRUMENTS, IN
CONNECTION WITH A NEWLY DEVELOPED KAYAK LAUNCH
DEVELOPED BY ROOKERY BAY.
WHEREAS, the Board of County Commissioners for Collier County, Florida ( "County ") has
been requested by Rookery Bay to enter into a sublease with the Florida Department of Environmental
Protection, so that Collier County staff can provide daily maintenance; and
WHEREAS, the proposed sublease will improve the quality of the recreational experiences
available to Collier County citizens, and thereby, will serve a public purpose; and
WHEREAS, the County wishes to apply to the Trustees of the Internal Improvement Trust
Fund, owner, for a sublease between the Florida Department of Environmental Protection and the
County, in order to provide daily maintenance at the newly completed Kayak Launch a kayak launch
developed by Rookery Bay, upon mutually agreeable terms and conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Section 1. It is hereby found and determined that the application for a sublease is in the best
interest of the County.
Section 2. The Chairman of the Collier County Board of Commissioners is authorized to
execute the Upland Lease Application.
Section 3. The foregoing WHEREAS Clauses are adopted and incorporated herein as if fully
restated;
Section 4. This Resolution shall take effect immediately upon adoption.

favoring adoption.

To whom it may concern:
This is to certify that the upland lease application sought for the management of the Isles of
Capri Paddlecraft Park by the Collier County Parks and Recreation Department will benefit the
citizens of Collier County by providing an exceptional kayak /canoe launch into Mcllvane Bay
and surrounding waters managed by Rookery Bay National Estuarine Reserve. Paddle craft
enthusiasts have established the need for needed access to the area and this project will
greatly enhance the public's ability to access these waters. It is without question that this lease
will serve a public benefit and not be contrary to the public's interest.
Furthermore, the Annual Updated Inventory Report conducted each year has identified the
acquisition of this parcel in the Parks and Recreation inventory in anticipation of this lease. The
acreage established by this lease will assist the local governmental entity in maintaining
necessary level of service standards for regional park lands.

The Propertz, located at 1295 Capri Boulevard, Folio #27180120003 (aerial attached), is designated as
Conservation by the Collier County Growth Management Plan (GMP), adopted pursuant to section 163-
^ 3167, Florida Statutes, and with this designation the a new kayak launch (passive recreational uses) at the
location would be consistent with the Collier GMP. Furthermore, in the 2011 Capital Improvement
Element (CIE ) Updating approved by the Board of County Commissioners at their November 8, 2011
Public Hearing, the location and kayak facility was designated as an FY2011 -12 capital improvement,
(CIE #80002 -12A) with funds allocated for its development.
