EXECUTIVE S-
Recommendation to acknowledge a Corrective Dedication/Reservation for the plat of
Quarry Phase 3, and to direct the Clerk of Courts to make a notation on the recorded plat
making reference to the recorded Corrective Dedication/Reservation.
O &ECTIVE: To acknowledge a Corrective Dedication/Reservation for the recorded plat of
Quarry Phase 3, and to direct the Clerk of Courts to make -a notation on the recorded plat.
CONSIDERATIONS: The Board of County Commissioners approved the plat of Garry Phase
3 on September `13, 2011. The developer subsequently applied to have the plat recorded.
Pursuant to Section 10.02.05 A.4 of the Land Development Code, Recordation of final
subdivision plat, the applicant must also provide a current Title Opinion at the time of plat
recordation. The Title Opinion which was provided to the County failed to recognize that The
Quarry Community Association, Inc. owns property within the limits of the plat and therefore
should have been a signor to the plat Dedications / Reservations.
On November 1, 2011, the plat for Quarry Phase 3 was recorded at Plat Book 51, Pages 27 —
33. Subsequent to the recording of the plat, the developer recognized that The Quarry
Community Association, Inc. should have been included as an Owner on the plat.
The Corrective Dedication / Reservation has been recorded in Official Record Book 4751,
Pages 988 through 990 in the Public Records of Collier County in an attempt to correct and
clarify the recorded plat. A copy of the recorded document is attached.
FISCAL IMPACT: There is no Fiscal Impact associated with this action.
GRO ,WTtI T IMEACT: There is no Growth Management impact associated
with this action.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the
Corrective Dedication / Reservation for legal sufficiency. This item requires a majority vote
and is ready for Board consideration and approval. STW
RECQ -NDATTJQN: To acknowledge the recorded Corrective Dedication / Reservation for
the plat of Quarry Phase 3 as recorded at Plat Book 51, Pages 27 — 33, and direct the Clerk
of Courts to make notation on the recorded plat of the Corrective Dedication / Reservation.
