EXECUTIVE SUMMARY
Recommendation for the Community Redevelopment Agency (CRA) to approve and
execute an extension of Commercial Building Improvement Grant 05/2011 Agreement
between the Bayshore /Gateway Triangle CRA and BE Home Realty, LLC due to certain
permitting and site development plan change requirements. (1712 Commercial Drive, Fiscal
Impact: None)
OBJECTIVE: To receive approval for a six (6) month extension of Commercial Building
Improvement Grant 05/2011 Agreement between the CRA and BE Home Realty, LLC due to
certain permitting and site development plan change requirements.
CONSIDERATIONS: BE Home Realty, LLC executed Commercial Building Improvement
Grant 05/2010 Agreement with the CRA on January 11, 2011 (Agenda Item 16B1 — Exhibit A).
The Grant Program requires grantees to complete work within one year of approval and the
Program also permits time extensions in cases when projects cannot be completed within the
Grant year.
To qualify for a time extension, grantees must demonstrate good faith to complete the project by
applying for permits and commence construction in a timely manner (Exhibit B). Unforeseen
upgrades required by Collier Land Development Codes and Federal Emergency Management
Agency (FEMA) requirements as well as a lengthy site development plan review process has
required the Grantee to request an extension of six (6) months to July 2012.
The Bayshore Gateway Triangle Local Advisory Board reviewed the extension request and
recommmends extending the Agreement from January 11, 2012 to July 11, 2012.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office
and is legally sufficient for Board action. This item requires a majority vote. (STW)
FISCAL IMPACT: Approved grant funding for this project in the amount of $50,000.00 will
remain encumbered for this project in the FYI CRA budget.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Community Redevelopment Agency approve and authorize
the CRA Chairman to execute the BE Home Realty, LLC Grant Agreement extension for six (6)
months to July 11, 2012.

MODIFICATION OF GRANT AGREEMENT BETWEEN CRA AND GRANTEE FOR
COMMERCIAL BUILDING IMPROVEMENTS FOR BAYSHORE
GATEWAY TRIANGLE COMMUNITY REDEVELOPMENT AREA
THIS AGREEMENT ENTERED this 10'' day of January, 2012 by and between the
Collier County Community Redevelopment Agency (hereinafter referred to as "CRA ") and BE
Home Realty, LLC (hereinafter referred to as "Grantee ").
WITNESSETH:
WHEREAS, in Collier County Ordi
Commissioners delegated authority to the CRA
contracts with Grantees for CRA grants; and

WHEREAS, Ordinance No. 08 -61 established the Commercial Building Improvement
Grant; and
WHEREAS, Grantee was approved for a Commercial Building Improvement Grant in the
amount of $50,000.00 on January 11, 2011 ( "CRA Approval "); and
WHEREAS, state Federal Emergency Management Agency (FEMA) code and
construction issues have prohibited Grantee from completing the warehouse renovation project
included in the Commercial Building Improvement Grant project as proposed by January 11,
2011; and
WHEREAS, the Commercial Building Improvement Grant Program explicitly states that
time extensions may be requested by Grantees in the event that a project cannot be completed
within a year from grant execution.
NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other valuable consideration, the parties agree as follows:
1. Grantee affirms and attests his intention to extend the length of time for the
Commercial Building Improvement Grant into which he entered on January 11, 2011 by six (6)
months, to end on July 11, 2012. All other terms and conditions established in the agreement
executed on that date between Charles Hallberg (agent), of BE Home Realty, LLC and the
Collier County Community Redevelopment Agency remain in effect.
2. Grantee affirms and attests his request for the time extension is due to
unanticipated delays associated with FEMA permitting and not due to unresponsiveness on part
of the Grantee. Grantee affirms he has exercised good faith in implementing the project by
documenting permit applications, verifying his promptness in permit applications (Exhibit "A ").
3. Grantee has timely requested an extension of his grant.

4. This Agreement shall be governed and construed pursuant to the laws of the State
of Florida.
5. This Agreement contains the entire agreement of the parties and their
representatives and agents, and incorporates all prior understandings, whether oral or written.
No change, modification or amendment, or any representation, promise or condition, or any
waiver, to this Agreement shall be binding unless in writing and signed by a duly authorized
officer of the party to be charged.
6. This Agreement is personal to Grantee, and may not be assigned or transferred by
Grantee or to Grantee's respective heirs, personal representatives. successors or assigns without
the prior written consent of the CRA.

Regarding the grants allocated for the above mentioned address, we formally request an
extension based on the amount of time spent on permitting and the insubstantial changes
required for the site development plan. Due to FEMA regulations we were forced to break the
scope of work into (2) separate phases for construction. We received the Phase I permit on July
6, 2011. We also had to submit the SDPI and revise it, which was finally issued on November 21,
2011. We are now packaging the submittal for Phase II construction for permitting. Attached is
a time -line showing the dates of permit /SDPI submissions. Please accept this as our request for

This is in response to your submittal of plans proposing a new ADA ramp, ADA stairs, replacing existing windows at
front offices, reconfiguring new entry way, new storefront entry door, new decorative features, extending the parapet,
and restriping the parking spaces.
This office has reviewed the plans and has no objection to the changes shown unless noted under stipulations.
INFORMATIONAL COMMENTS:
Fire Department: Approval is limited to the Site Plan only. All architectural design changes shall also be submitted for
review under a commercial Building Permit, where it will be reviewed for code compliance with the Florida Fire
Prevention Code and NFPA 101 Life Safety Code (2006 Florida - specific edition), as well as the Florida Building
Code.
STIPULATIONS:
Engineering Services: This approval does not constitute approval by City of Naples. A letter of approval from City of
Naples must be submitted prior to scheduling the pre - construction meeting.

"Be advised that this project has been reviewed by staff in accordance with the applicant's description of

EXECUTIVE SUMMARY

Grant Applicant within the Bayshore Gateway Triangle area. (1712 Commercial Drive,
$50,000.00)
OBJECTIVE: To approve and execute a Commercial Building Improvement Grant Agreement
between the Community Redevelopment Agency (CRA) and a Grant Applicant within the
Bayshore Gateway Triangle Community Redevelopment area. (1712 Commercial Drive,
$50,000.00)
CONSIDERATIONS: The purpose of the grant program is to provide an incentive to revitalize
the area by providing matching grant funds to encourage the private sector to upgrade /rehabilitate
commercial properties. The CRA provides a project cost - match of 50% from Tax Increment
Funds capped at $30,000 for exterior improvements and capped at $20,000 for interior
improvements (provided the exterior improvement's costs reach the cap amount). Remaining
project dollars are provided by the applicant. The CRA's Commercial Building Improvement
Grant Program is funded annually at a level that satisfies existing grant obligations from prior
fiscal years and funds future grant opportunities. For FYI 1, a total of $151,000 is budgeted for all
grant programs. From this allocation, 114,938 dollars are committed to date. This grant
application, if approved, would exceed the allocated T1F funds by $13,398; however, there is
$14,631.16 reserved in the TiF grant budget for contingencies such as this. if this award is
granted, there will be $642.16 remaining in the reserve fund.
The Commercial Building Improvement Grant application (Exhibit A) submitted by Charles
Hallberg, authorized agent of BE Home Realty, LLC, owner of the commercial property at 1712
Commercial Drive, Naples Florida, 34112, was recommended for approval by the
Bayshore /Gateway Triangle CRA Local Advisory Board.
LEGAL CONSIDERATIONS: This item requires a majority vote. It has been reviewed by the
County Attorney Office and is sufficient for Board consideration and approval. -STW
FISCAL IMPACT: Sufficient budget exists within Fund (187) FYI budget to satisfy this
application. This project totals $207,300.00, and the request is for up to $50,000.00 for exterior
and interior projects (with a 50% grantee match) for a total fiscal CRA impact of $50,000.00.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the CRA Board approves and authorizes the Chairman to execute
the Commercial Building Improvement Grant Agreement between the Community
Redevelopment Agency and Charles Hallberg, authorized agent of BE Home Realty, LLC, owner
of the commercial property at 1712 Commercial Drive, Naples Florida, 34112 in the amount of
$50,000.00.

I. Grantee acknowledges to the CRA that Grantee has received a copy of the Collier
County Community Redevelopment Agency Commercial Building Improvement Grant Program
Information and Application (hereinafter referred to as "Grant Program "), that Grantee has read
the Grant Program, and that Grantee has had ample opportunity to discuss the Grant Program
with Grantee's counsel or advisor. Grantee further acknowledges to the CRA that Grantee
understands and agrees to abide by all of the terms and conditions of the Grant Program. Grantee
agrees to the terms and conditions of the Grant Program.
2. Grantee is the record owner / tenant of property described as

contractors and /or vendors with cash. All payments for approved projects must be in the form of
a check or credit card drawing on funds from Grantee's accounts.
5. The CRA has approved a grant to Grantee in the amount of b;-c 4 r
be administered pursuant to the terms of this Agreement based on an estimated cost of

grant amount shall be reduced dollar for dollar in CRA funds as determined by ratio of matching
private funds required.
6. Unless prior disclosure is included in the grant application, no Grantee, or any
immediate relative of Grantee, shall serve as a contractor or subcontractor for the construction of
the improvements and no Grantee, or any immediate relative of Grantee, shall receive
compensation for labor for the construction of the improvements. An immediate relative of
Grantee shall include mother, father, brother, sister, son, daughter, aunt, uncle and cousin or
family member by marriage to include mother -in -law, father -in -law, brother -in -law and sister -in-
law. Grantee has verified that all contractors who have provided bids for the approved work are
actively licensed by Collier County. Grantee acknowledges that the total grant award shall not
exceed the sum of lowest bids /price quotes for all projects. Grant funds for work performed by
contractors shall only be disbursed upon verification that said contractors are actively licensed by
Collier County.
7. Grantee agrees to obtain all necessary permits and submit any required plans to
the County's Growth Management Division. Upon completion of the work, Grantee shall
submit to the CRA staff a Project Summary Report, two (2) 8 inch by 10 inch photos showing
the improvements, a list of materials and construction techniques used, a list of architects and/or
contractors, and any other information specific to the project or requested by the CRA staff.
The CRA, through its staff, shall confirm that the Commercial Building Improvements were
constructed pursuant to the terms of the application approved by the CRA.
8. Within forty -five (45) days after confirmation that the improvements were
constructed pursuant to the terms of the approved application, the Grantee shall be issued a check
in the amount of the grant. However, if the Grantee fails to make the improvements pursuant to
the terms of the approved application, or if the improvements are not completed within one (1)
year of CRA approval, , the grant shall be deemed revoked and Grantee shall not be entitled to
funding.
9. This Agreement shall be governed and construed pursuant to the laws of the State

Dear Moore General Contracting Services, LLC:
This is in response to your submittal of plans proposing a new ADA ramp, ADA stairs, replacing existing windows at
front offices, reconfiguring new entry way, new storefront entry door, new decorative features, extending the parapet,
and restriping the parking spaces.
This office has reviewed the plans and has no objection to the changes shown unless noted under stipulations.
INFORMATIONAL COMMENTS:
Fire Department: Approval is limited to the Site Plan only. All architectural design changes shall also be submitted for
review under a commercial Building Permit, where it will be reviewed for code compliance with the Florida Fire
Prevention Code and NFPA 101 Life Safety Code (2006 Florida - specific edition), as well as the Florida Building
Code.
STIPULATIONS:
Engineering Services: This approval does not constitute approval by City of Naples. A letter of approval from City of
Naples must be submitted prior to scheduling the pre- construction meeting.
