EXECUTIVE SUMMARY
Recommendation to approve a Purchase Order to Quality Enterprises USA, Inc., for
median safety modifications on Collier Boulevard at the entrance to the Forest Glen Golf
and Country Club in the amount of $127,272.85 using the Annual Roadway Contractors
Agreement(Contract#12-5864).
OBJECTIVE: To approve a Purchase Order for roadway median safety improvements on
Collier Boulevard.
CONSIDERATIONS: On June 25, 2013, the Board of County Commissioners (Board) entered
into a Cost Share Agreement(Agreement) (Item 16.A.15) with the Forest Glen Golf and Country
Club Homeowners Association (Forest Glen) for median safety improvements on Collier
Boulevard. The Agreement called for Forest Glen to share the construction cost with the county
in an amount not exceed 55% of the Engineer's Opinion of Probable Cost (OPC). The OPC at
completion of design was estimated at $94,164. Forest Glen paid it share of$51,790.20.
In accordance with the agreement, after Forest Glen paid its share, the county solicited quotes
from four (4) vendors for the work under the annual Roadway Contractors Agreement, #12-
5864. The lowest quote received was $139,372. The county opted to reject all quotes and the
project design was modified to reduce costs. The county then requested a second round of
quotes from vendors for the modified design and the lowest quote was $127,272.85. This quote
includes an allowance of $16,000 for unknown costs, should they be required. County staff
reviewed the low quote and determined that it was fair and reasonable since two requests for
quotes produced similar results. The following is a summary of the second round of quotes
received:
1. Quality Enterprises, Inc. $127,272.85
2. Bonness, Inc. $139,824.42
3. Ajax Paving, Inc. NO QUOTE
4. Community Asphalt, Inc. NO QUOTE
The June 25, 2013, Executive Summary indicated that the fiscal impact to the county would be
up to $55,000 for construction related costs. However, given the increased project construction
cost of $127,272.85, the total amount of county funds to be obligated would be $75,482.65,
$16,000 of which is for roadway allowance. If this allowance is not needed to complete the
project,the county obligation would be $59,482.65.
Although the project costs are more than originally expected, county staff believes that the
benefits of the median safety improvements far outweigh the additional costs required and,
therefore, would recommend that a Purchase Order be approved for this project.
FISCAL IMPACT: Funding is available in the FY14 Capital Budget approved by the Board on
September 19, 2013. The source of funding is the Gas Tax Fund (313) in Project 60016. It is

estimated that, upon completion, this project will not require immediate additional committed
annual funding.
LEGAL CONSIDERATIONS: This item has been reviewed and approved as to form and
legality, and requires a majority vote for Board approval. -- SAS
GROWTH MANAGEMENT IMPACT: This action will result in no growth management
impact.
RECOMMENDATION: That the Board approve a Purchase Order to Quality Enterprises USA,
Inc., for median safety modifications on Collier Boulevard at the entrance to the Forest Glen
Country Club in the amount of$127,272.85 using the Annual Roadway Contractors Agreement
#12-5864.

As you all know, the quotes submitted on October 18, 2013 were rejected
because they came substantially higher than the cost estimate by the designer.
Banks Engineering has revised the plans reducing the length of the proposed
southbound left turn lane on Immokalee Road at Forest Glen to bring the cost
of the improvements within budget. We would like to get new quotes for the
construction of these improvements under the Annual Roadway Contract No.
12-5864. The following documents are attached for your use:

Please submit your re-quote by 3:00 p.m. on Thursday. November 7, 2013.
The work will be done via a Purchase Order. Substantial completion of the
project shall be done within 45 calendar days from NTP and Final Completion
30 calendar days thereafter; the total contract time is now 75 calendar days.
The following information is also provided to you:
• The project will be managed during the construction phase by an inspector
designated by the county.
• The contractor will be required to prepare and submit a ROW permit
application; Collier County will pay the application fees and the Consultant
will provide three (3) sets of signed and sealed of the revised plans. Tania
Delgado will assist on the ROW permitting process.
• The contractor will be required to start the construction within two (2)
weeks of the issuance of the Notice-to-Proceed letter by the County.
Let us know if you have any questions or if you would like to meet on site to
jointly review the scope of work. The consultant that prepared the plans, JMB
Transportation Engineering, is available to answer any questions and/or meet
on site to review the project if needed.

Ladies & Gentlemen:
As you all know, the quotes submitted on October 18, 2013 were rejected
because they came substantially higher than the cost estimate by the designer.
Banks Engineering has revised the plans reducing the length of the proposed
southbound left turn lane on Immokalee Road at Forest Glen to bring the cost
of the improvements within budget. We would like to get new quotes for the
construction of these improvements under the Annual Roadway Contract No.
12-5864. The following documents are attached for your use:
1. Construction plans are the plans for median improvements on Immokalee
Road at Forest Glen (Collier County Project No. 60016)
2. The bid schedule for the project
3. MOT attachments
4. Summary of revisions and changes

Please submit your re-quote by 3:00 p.m. on Thursday, November 7, 2013.
The work will be done via a Purchase Order. Substantial completion of the
project shall be done within 45 calendar days from NTP and Final Completion
30 calendar days thereafter; the total contract time is now 75 calendar days.
The following information is also provided to you:
• The project will be managed during the construction phase by an inspector
designated by the county.
• The contractor will be required to prepare and submit a ROW permit
application; Collier County will pay the application fees and the Consultant
will provide three (3) sets of signed and sealed of the revised plans. Tania
Delgado will assist on the ROW permitting process.
• The contractor will be required to start the construction within two (2)
weeks of the issuance of the Notice-to-Proceed letter by the County.

jointly review the scope of work. The consultant that prepared the plans, JMB
Transportation Engineering, is available to answer any questions and/or meet

COST SHARE AGREEMENT BETWEEN
THE FOREST GLEN GOLF& COUNTRY CLUB AND COLLIER COUNTY
THIS AGREEMENT is made and entered into this a$ ay of June, 2013, by and
between Collier County, a political subdivision of the State of Florida, by and through its Board
of County Commissioners (hereinafter referred to as the"County"), and FOREST GLEN GOLF
& COUNTRY CLUB HOA, with a principal address of 3855 Forest Glen Boulevard, Naples,
Florida 34114(hereinafter referred to as"Forest Glen").
RECITALS:
WHEREAS, Forest Glen represents the collective interests of the Forest Glen
Community(Community)located at 3855 Forest Glen Boulevard,Naples,Florida;and
WHEREAS, the Community seeks to temporarily improve their access into their
development off of Collier Boulevard(CR-951); and
WHEREAS, Forest Glen and the County have reanalyzed the traffic conditions along
CR-951 and have collectively agreed that a modification to the northbound dual left turn lanes on
CR-951 into Business Circle will not adversely impact the health, safety and welfare of the
traveling public at this time; and the construction of a southbound single left turn lane directly
into the main entrance of the Community will temporarily improve access and enhance safety;
and
WHEREAS, Forest Glen and the County anticipate that these improvements should not
exceed$100,000 and have agreed to equally share in the construction cost; and also share in the
design and construction management with Forest Glen taking on the design and the County
taking on the construction management;and
WHEREAS, the County and Forest Glen agree that this modification to the CR-951
access may or may not be permanent but should last a reasonable amount of time to justify the
time and expense; and
WHEREAS, after reasoned consideration by the Board of Commissioners, the Board
finds that this Agreement will not adversely impact the proper function of the County's
transportation system; that this Agreement will not adversely impact the health, safety and

welfare of their citizens; and that these temporary improvements provide an overall public
benefit.
WITNESSETH:
NOW, THEREFORE, in consideration of the mutual covenants herein contained, the
parties agree as follows:
1. All of the above RECITALS are true and correct and are hereby expressly
incorporated herein by reference as if set forth fully below.
2. Forest Glen, at its sole cost and expense, shall design the modifications to the
northbound dual left turn lanes and the southbound single left as shown on Exhibit A(hereinafter
referred to as the"Project")consistent with Florida Department of Transportation standards.
3. County shall provide a timely review of the plans and upon approval prepare an
opinion of probable costs (OPC). If the OPC exceeds $110,000, either party may by written
notice unilaterally terminate this Agreement. The County will submit the OPC to Forest Glen for
its review, and upon its approval, Forest Glen will make payment to the County for 55% of the
OPC within 120 days. This payment shall be kept in a separate account. County will commence
construction of the Project within 180 days of receiving payment. Upon completion of the
Project, County shall provide Forest Glen with an accounting of the actual cost of the Project. If,
and only if,the actual costs exceed the OPC, Forest Glen shall have ten business days to dispute
this final accounting. Should no dispute be filed within this time frame,County shall deduct half
of the actual costs of the Project from this fund, and shall transmit the remaining balance to
Forest Glen. In no event will Forest Glen be responsible for more than its payment to the
County, and should actual costs exceed 110% of the OPC, County will bear the full cost of any
such excess. Any dispute will be submitted to the Board of County Commissioners for
adjudication. The decision of the Board shall be fmal.
4. In the future, should the County believe that the Project is adversely impacting the
functional operation of CR-951 at Business Circle, the County at its sole discretion and cost may
eliminate the southbound turn lane and return the dual northbound left turn lanes to its present
configuration. Prior to doing so, the County will provide Forest Glen with a 180 day notice of
such intent before commencing construction. Within this 180 day notice period, Forest Glen at

its sole cost and expense may elect to modify the location of the southbound left turn lane further
south as shown on Exhibit B. Should Forest Glen choose this option, it will have 180 days after
noticing the County to commence construction.
