10/22/2013 17.B. EXECUTIVE SUMMARY This item requires that ex parte disclosure be provided by Commission members. Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve Petition VAC-PL20130001313 to disclaim, renounce and vacate the County and the public interest in a portion of 10th Street as shown on the plat of Eastover, Plat Book 1, Page 97 of the Public Records of Collier County, Florida, also being a part of Section 3, Township 47 South, Range 29 East, Immokalee,Collier County,Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of 10t Street as shown on the plat of Eastover, Plat Book 1, Page 97 of the Public Records of Collier County, Florida, also being a part of Section 3, Township 47 South, Range 29 East, Immokalee, Collier County, Florida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20130001313 has been received by the Engineering Services Department, Growth Management Division, Planning and Regulation from Thomas K. Boardman, of Thomas K. Boardman, P.A., as agent for the property owner to vacate a portion of 10th Street as shown on the plat of Eastover, Plat Book 1, Page 97 of the Public Records of Collier County, Florida, also being a part of Section 3, Township 47 South, Range 29 East, Immokalee, Collier County,Florida. The Engineering Services Department has reviewed this petition and found no reason for objection. The portion of 10th Street has never been improved or used as a means of legal access or transit by any property owner that would be affected by the vacation. In past years, a number of acts of vandalism and theft have taken place by suspects who enter packing houses and other properties in the vicinity of 10th Street. They access this area using that portion of 10th Street which the applicants seek to vacate. The closing of this road, will allow the affected property owners the opportunity to legally eliminate this access, and will stop these practices. The vacation of this property, which has never been used as a public road right-of-way, will allow the property to be placed on the tax rolls and revenue derived in the form of property taxes. The hearing has been advertised in a local paper of general circulation pursuant to Section 336.10, Florida Statutes and Resolution No. 2006-160, and adjoining property owners have been given notice as well. FISCAL IMPACT: Growth Management Division,Planning and Regulation staff has collected a$2,100 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition.
