EXECUTIVE SUMMARY Recommendation to approve a Final Judgment in the amount of$6,466.92 settling all claims for the taking of Parcel 199DA1VIE, including attorney's fees, in the lawsuit styled Collier County v. Llevatt, Inc., et al, Case No. 2011-CA-3176 for Outfalls 3 & 4/LASIP (Project No. 51101). (Fiscal Impact$2,836.92) OBJECTIVE: That the Board of County Commissioners approves the attached Final Judgment for payment of full compensation, for the taking of Parcel 199DAME in the lawsuit styled Collier County v. Llevatt, Inc., et. al., Case No. 1l-CA-3176. (Outfalls 3 & & 4/LASIP, Project No. 51101). CONSIDERATIONS: Collier County condemned 5,700 square feet for a perpetual non-exclusive drainage, access and maintenance easement from Parcel 199DAME which is owned by William Dennis, III. An appraisal dated January 31, 2012 shows a market value of$3,630 for the taking. An Order of Taking hearing was held on March 6, 2012, and the County deposited the sum of $3,630 in the Court Registry. After negotiations, Counsel for owner and the County agreed to settle just compensation for$5,700 and award statutory attorneys fees in the amount of$766.92. Staff recommends settlement in the amount of$6,466.92 all inclusive. If approved, the County will be responsible for the following costs: Additional Amount Owed: $2070.00 Attorney's fees: $ 766.92 TOTAL $2836.92 FISCAL IMPACT: Funds in the amount of $2,836.92 is available as a part of the Stormwater Capital Improvement Project. Source of funds are ad valorem. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -ERP RECOMMENDATION: That the Board of County Commissioners approves the Final Judgment as to Parcel 199DAME and authorize payment of the funds as stated.
