Public notice having been published in the Naples Daily News on
July 8, 1986, 8S evidenced by Affidavit of Publication filed with the
Clerk, public hearing was opened to consider a proposed ordinance for
~he purpose of creating the Naples Park Area Drðinage MSTU.
Public Works Administrator Kuck stated that as a result of com-
ments received from the Naples Park residents during the Board's
review of the Beachwalk project on May 27, 1986, the staff was asked
to provide a recommendation and method to improve drainage in the
area. He indicated that on June 16, 1986, staff recommended to the
Commission the creation of the Naples Park Area Drainage Improvement
MSTU and, at that time the Board directed staff to prepare an ordi-

nance to create t.Í'.ß drainage improvement MSTU. He explained that the
proposed district will be bounded on the north by lllth Avenue, on the
east by U.S. 41, on the south by Vanderbilt Beach Road, and on the
west by the Vanderbilt lagoon. Also included in this proposed
district, he said, are about 144 residential lots and 13 tax parcels,
the Beachwalk project and the Pavilion Shopping Center. He said that
due to the complexity of the design and lack of manpower, the Public
Works Division is recommending that the Naples Park Area Drainage
Improvement MSTU be established as a taxing unit to generate funds for
the preliminary engineering study and administrative costs which are
currently estimated in the neighborhood of $80,000. He pointed out
that there are two changes in the proposed ordinance; the first
paragraph, "Assessment District" should read "MSTU," and the third
paragraph which mentions -Ordinance No. 75-14- should be deleted.
Commissioner Voss asked if there are areas on the east side of
U.S. 41 that affect this area, would they would be included in the
study? Mr. Ruck said that the engineering report would take into con-
sideration the whole drainage area with some of the outlying areas, or
areas east of U.S. 41; if there is an assessment or improvement
district, those areas would be included and will pay their fair share.
Mrs. Lucy Veccia, a resident of Naples Park, statej that the resi-
dents of Naples Park do not want the rain water from the Beachwalk pro-
ject drained into Naples Park, putting in jeopardy of flooding the
property and homes of the residents. She indicated that she has no

objection to the proposed study and would welcome a workable drainage
sýstem in th~ ae " but objects to havin~ to dispose of Beachwalk
water in additi~n to their own. Mrs. Vepcia pointed out that Naples
Park does not at this time have the major flooding problems that it
will have if Beachwalk water is allowed to drain into Naples Park.
She asked the Commission to convince the Beachwalk development to look
lor alternate means of drainage.
The following speakers also sroke in favor of the study and the
taxing district, and against the Beachwalk development's overflow water
draining into Naples Park causing flooding and loss of property and
asked'the Board to take a very close look at this problem:

After a discussion on the proposed drainage system, Commissioner
Pistor asked Mr. Kuck if all three lakes are interconnected? Mr.
Kuck answered that Lake -A- will outfall across the road and into a
canal into Naples Park, and Lakes "B- and "C" are interconnected and
will discharge into Vanderbilt lagoon. Mr. Kuck added that he checked
with Mr. Green, who is the design engineer for the pro~ect, to see if
any changes had been made in the design and they are content with the
original design, adding that the water management plan was reviewed by

the South Flori'_ Water Management District, and approved, as well by
the County Staff.
Mr. Kuck mentioned that this development will not add more water
to North Naples, it will be the same amount depending on the rainfall;
the system has been designed to retain a certain amount of the run-off
water, so discharge after development will be less than what it was
before development. He indicated that if this is not true, and a
problem has been created, the County and developer would be liable for
corrections.
Commissioner Voss asked if there was an alternative to
discharging Lake "A" elsewhere? Mr. Kuck stated that Lake "A" could
be connected to Lakes "B- and -C-, but the engineer has indicated that
he did not see any benefit ~o that, and also Lake -A- discharges at an
elevation of one or two foot higher then whðt Lake "C" discharges
because of the differential in the lake elevations: Lake "A" is higher
than Lakes -B- and "C." He added that Lake "A" could be connected to
Lake -B- which also connects into Lake -C". Commissioner Voss asked
if that would be worthwhile considering? Mr. Kuck answered that the
Board could direct staff to proceed to talk to the engineer to see if
the connection can be made.
In answer to Commissioner Hasse, Mr. Kuck stated tnat during a
large part of the year there is water lying in the discharge canal
which is at a fairly low elevation as it goes down towards the
discharge point, and tides do have an effect on the discharge.

Commiesioner IIa.. :t:. asked if substðntially more water is being added to
Naples Park? Mr. Kuck answered that the. only time would be in the
case of a seriou3 storm and their lake svstem was completely full, but
during routine rains water would be conta~ned in the lake system and
let out at a slow rate into the Naples Park canal.
Commissioner Holland asked if Lakes "B" and -C" are proposed to
drain westward into the Bay? Mr. Kuck answered affirmatively.
Commis8ioner Holland asked how the elevation compares between the
Beachwalk project and the first five or six blocks north into the
Naples Park area? Mr. Kuck said he did not have information on hand
to refer to.
Commissioner Holland asked if the Commission can direct the deve-
loper to hook up Lake "A- to Lakes -B- and "C?" County Attorney
Cuyler an8wered that if the staff indicated that this drainage plan
was going to cause problems, or there was a reasonable chance, the
Board could authorize staff to contact the developer and discuss the
drainage plans; however, he believes that staff is satisfied that the
current plans will not cause problems.
Commissioner Voss asked if the present rainfall in the Beachwalk
area flows north into the North Naples channel? Mr. Kuck answered
that some goes north and some goes west into the existing culverts.
Commissioner Voss stated that the Beachwalk is not going to change
that, the rainfall will still be the same. Mr. Kuck said that the
Beachwalk will only change the characteristic of the ground and create

more impervious areas that were not present before, and that is why
they put th~ lð'~ system in, to collect that water and release it
slowly.
Assistant County Manager Dorrill stated that staff recommends
that the Board authorize the ordinance that would create the Naples
Park Area Drainage MSTU. Mr. Kuck stated that staff if also recom-
mending that the Beachwalk and Pavilion be included in that district.
George Mellen, Staff Engineer, stated that the discharge from the
Beachwalk is really in two categories; the controlled discharge through
the weir structure for the design storm event, and the discharge for
larger storms where everything will flood. He indicated that since
the system for the Beachwalk has been approved, rather than having
the engineer completely redesign it with new pipes, new weirs, etc.,
which would be excessive, the system should be allowed as designed and
appr~v.d to be built, but the severe storm can be reanalyzed and
redirected to the extreme west end with either an overflow pipe o~

Commissioner Pistor asked Mr. Hellen if the only time there will
be an appreciable flow of water from Lake -A" into this canal would be
during a 25 year storm? Hr. Mellen answered -Correct,- adding that
discharge is very limited and about 82' of the total runoff created by
Beachwalk will be kept on the property at the peak of a storm. He
said that the Beachwalk will discharge through very small weir struc-
tures, one located at Lake "A" and at retention area "D.-

Neil Dorrill, Assistant County Manager, stated that staff is
recommending that core samples be taken ~ithin a grid system for
determining the various ages of the municipal solid waste that is
buried at the Naples landfill, and then to have those core samples
taken to a testing laboratory to determine their BTU fuel value for
use as a fuel at the resource recovery facility.
Commissioner Pistor asked if it is found that this waste can be
burne~, will it help to eliminate a pollutant that has been created,
since the old cells are not lined with plastic and as long as they'
exist there is a potential for pollution?
Mr. Dorrill answered that there is more potential for leachate
ground contamination than in the current lined cell that is being
jnstalled now, adding that the Governor's office is very interested in
the project and is encouraging the County to make application for a
grant. He pointed out that the result would be that the old landfills
will be eliminated by mining and using the old wastes as a supplemen-
tal fuel. He added that the County is pursuing this project in con-
junction with Governor Graham's Energy Office.
Commissioner Voss asked what a bomb palorimeter is? Mr. Dorrill
answered that it is the heating device that determines the caloric
heating value of a pound of waste, and it would determine in BTU's the

equivalent heati~g value of that waste per pound. Commissioner Voss
asked if both the core borings and the bomb calorimeter are needed?
Mr. Dorrill stated that the core borings are to drill the core plugs
and those plugs will be shipped to the testing lab where 50 calori-
meter tests will be performed.
Commissioner Holland stated he received several calls and personal
visits from people that are concerned about this matter. He indicated
that it has been suggested by knowledgeable people in this area that
the County check with some of the cities that have tried this to find
out the results before the County goes into boring or testing, because
it is his understanding that in the state of Florida there have been
very few, if any, areas wh~re the material has been reclaimed from the
landfill for use in anything other than the use of methane gas. Mr.
Dorrill stated that the County is required by law to drill wells in
the closed landfills to vent off methane gas, and there is no burning¡
burning is used in other areas of the State. Commissioner Holland
stated that the likelihood of being able to salvage usable mater.ial is
almost nill and it would be well to consider unearthing part of it
and taking a sample rather than going ahead with the testing and
boring. County Manager Lusk stated that the difference in Collier
County would be that with a fluidized bed there is a better chance of
burning old solid waste than a mass burn.
Commissioner Holland stated that in the discussion regarding
resource recovery this matter was brought up as a possibility, and he

asked if any wor~ or survey was d~ne at that time on this particular
subject? Mr. Lusk indicated that the fluidized bed can burn if it has
a certain value, which is what is being requested now to see if that
certain value exists in the old waste. Commissioner Holland stated
that people are fearful of the odor that would result from uncovering
this material, which has been buried for a period of years. Mr. Lusk
stated that the testing would not cause ~hat, but if it is a problem
it will be found out before actual mining is done; all that will be
done at this point is taking core samples which would lead to further
investigation.
Commissioner Pis tor stated that he has spoken to people in the
engineering field and has attended meetings which suggest that this is a
matter worthy of investigation because of the benefits that could
be obtained in getting rid of materials that could cause trouble, and
there is a possibility it may work, but it has to be tested first.
Commissioner Voss said that any odor would surely have been
noticed at the venting of the methane gas and, if there is odor, it
will be noticed quickly at the time of boring.
Public Works Administrator Kuck mentioned that several countries have
tried this method, and he will try, with Mr. Fahey, tt get copies of
those reports and make them available to the Board members.
Commissioner Pistor stated that if other areas in the State have
attempted this process, perhaps the County should find out what the
results have been and if it has worked.

concern is that if the County goes into the recovery process, the odor
coming from the area would be prohibitive. He asked if testing would
give an answer as to how much odor or adverse conditions it would
create? Mr. tusk answered -No,- but indicated if the sample taken is
found to be worth burning, then it will be worth spending money to see
whether this project is feasible.

Tom Crandall, Utilities Administrator, stated that they have been
working with the rate consultants to determine what the effects are on
the County's rates regarding this project, and also worked with Hole,
Montes , Associates on the Master Water Plan, which is about 98'
complete and almost ready to bring to the Board for presentation. He
said there was a preliminary present~tion and it did _nclude the
installatiQn of this water main as Phase I construction, and the staff
is recommending that the line be installed. He indicated that staff
is requesting authorization for selecting an engineer for the design,
inspection and related services for the water main.

Mr. Crandal~ pointed out that by installing this line it will be
necessary to ta¡~e over the Carica Road 5 MG storage tank, and in the
Interlocal Agreement with the City of Naples, it has been agreed that
the County will build a 5 MG storage tank so the County can take over
their tank.
County Manager Lusk indicated that the agreement with the City
goes to 1990, and this pipe will give the County the ability to meet
their obligation by 1988, plus solve some of the water problems in the
North Naples area.
Commissioner Voss stated that last winter North Naples had a
terrible problem with water pressure and water volume which is related
to the pressure, and this project should have been started six months
ago. He added that since this is a matter of urgency, the Board
should go ahead and use the engineer of record, at least for the
line, and select an engineer for the tank via the normal process.
Mr. Crandall stated that until the plant construction is complete,
this line could be engineered and installed but it will be of no bene-
fit to North Naples until the additional capacity is available.
Commissioner Voss added that some parts do not have to be completed in
order to get the water through, and Mr. Crandall affirmed that.
Commissioner Hasse asked where the pipe will run to from the plant?
Mr. Crandall answered approximately five miles north on S.R. 951 and

approximately 6 miles west on Golden Gate Boulevard.
Commissioner Holland asked if the line will actually be of no
benefit until such time as another tank is built and there is storage

capacity on the north end? Mr. Crandall answered "Yes," because in
order to eliminate dependency on the City of Naples, the terms of the
agreement have to be met, and one of the terms is to build them a tank
at a location of their choosing and the County taking over the Carica
Road tank.
Commissioner Holland asked how near the County is today to using
the water that is being treated at the County's plant? Mr. Crandall
answered that during peak demand times there is no excess capacity.
Commissioner Holland stated that the pipe will be of no benefit
until such time as the wellfields and the plant have been enlarged.
Mr. Crandall stated that that was his feeling, but it will be an imme-
diate improvement upon the completion of the plant scheduled for
December, 1987. Commissioner Holland stated that at this point it
would be proper, according to state law, to short-list this project
and bring it back to the Commission.
In answer to Commissioner Pistor, Mr. Crandall said that the pipe
construction will be about nine months, the design another another 3
to 4 months, and short-listing about 2 months. Clerk Giles asked if
it is legally proper to by-pass the bid process on engineering work?
Mr. Lusk stated that the Board would have to declare an emergency for
the work to be started now, and the Board can appoint an er.gineer.
Commissioner Voss indicated that based on the many phone calls he has
received from the North Naples area, this project should be an
emergency. Mr. Lusk pointed out that when an engineer is selected,

according to th~ Competitive Negotiations Act, the only thing selec-
tion is based on is qualifications, and the process also provides a
second firm to fall back on if negotiations cannot be made with the
first firm.
Commissioner Holland stated that if construction is nine months,
design 3 to 4 months and short-listing two months, and 18 months to
enlarge the water plant, he does not see how an emergency can be
justified; he would prefer an advertised bid.

Assistant County Attorney Anderson stated this agreement drops a
lawsuit filed by the Glades, Inc. two or three months ago regarding

Commissioner Pistor stated that he has received numerous calls
objecting to this change because of the cost involved, $2.00 a month,
but he has received more calls aSking for the change. He indicated
that the Public Service Commission will consider asking the Telephone
Company to make the change, which will bring Bonita Springs, Little
Hickory and Lely Barefoot Beach into the Naples area.
Mr. Andy Clements stated that as a whole most of the people are in
favor of this. He added that the present rate for these areas is $6.40
for telephone services and the new rate would be compatible with
Naples Park.

Commis.ioner Voss stated that the law provides that if a wreck is
towed into a storage yard, it cannot be sold for 45 days, and he
believes that to be unreasonable. He added that it would be better to
change it to 60 days providing an extra 15 days ;n which to sell it
because State law provides that it has to be kept for 45 days.

Albert Von Steiner from Marco Island, a registered speaker,
explained his problems in trying to comply with both County Ordinance
and State Statute, and the Zoning Department asking that he remove
v.hicles in 45 days, and stated that the County Ordinance should pro-
vide sufficient time to meet the State rqquirements. Mr. Tom Lanfort
also spoke and said that he feels that he has been treated unfairly by
Zoning in reference to removal of vehicles.
County Attorney Cuyler stated that 60 days is an adequate period
of time, particularly for abandoned vehicles, and if the Board wants
to increase that he has no objection.
Commissioner Holland stated that the problem of abandoned vehicles
is becoming more severe throughout Naples, and he does not know
whether this action today will solve the problem.

Zoning Department, and they have no place to put them. He indicated
that the people towing vehicles are required to keep them for 45 days,
and most of the expenses are borne by them. He indicated that a 90
day period would be far more reasonable, otherwise the County could be

vehicles if these people are no~ given relief.

Ordinance. Commissioner Pistor stated that this matter has to be
thoroughly reviewed so that other needed changes can be made at the
same time.

Commis.ioner V~s. stated that Mr. Wafaa Assaad has requested a
name change for the road which will evefltually tie-in with Vanderbilt
Road, and it se~ms logical to continue that name all the way across.
Mr. George Archibald stated that currently the alignment of the
extension of Golden Gate Boulevard between Airport Road and U.S. 41 is
as shown on the Comprehensive Plan; the final alignment may be subject
to relocation based upon a study being done by the Lockner people for
the MPO. At this point, he said, it will tie into Airport Road and
most likely Vanderbilt Beach Road at the locations outlined. Mr.
Dorrill asked if this is in the current Five-Year Plan, and Mr.
Archibald replied it is in the Ten-Year Plan.

êt" operates. He indicated that the State has $105 or $106 million to

spend on coastal projects, and the Governor has directed State staff
to formulate a prioritized list of projects, the total value of which
would be twice that amount. What staff does, he said, is go down the
list and if there is a willing seller for any parcel, with no con-
ditions involved, that one would be approved for transmission to the
Governor. He mentioned that the prioritized list will be made public
on Friday of this week when the,Committee meets again. Commissioner
Voss n~ted that he talked to the Committee members and staff personnel
to find out what their attitudes were on two projects in Collier
County, Caxambas Pass and Lely Barefoot Beach. He said that generally
he got the impression that Caxambas Pass would not be acceptable
because there is too much money 'involved; however, there was favorable
reaction to Le1y Barefoot Beach because taking the 1,800 feet
purchased from Lely, and adding 600 feet of the parking lot which now
exists at the north end of the County, and the 5,000 feet that the
State already owns, would add up to 7,400 feet of beach by only having
to buy 1,800 feet of beach.
Commissioner Voss said that the problem may be that the people
might not want to give up the parking lot. He indicated that local
participation would mean a great deal to the Committee as they study
these various projects. He added that if the people are agreeable to
give up the parking lot and add another 600 feet to the Lely parcel and
perhaps pave the access road or,make an agreement to at least share in

the cost of pavlog the parking lot to be built, which would be a good
size, that would be a way of participating. He added that the access
road would be from Vanderbilt Drive or. relatively high ground and from
there access to the beach would be by boardwalk. He said there will
not be a decision until Friday when the list is published and sent to
the Governor and Cabinet for approval or disapproval.
Commissioner Voss stated that the Board does not need to take any
particular action today, but if the County finds that the Barefoot Beach
project is very high on the list, perhaps next week the Board will
have to take a position on whether they are willing to give up the
parking lot in order to gain access to 7,400 feet of beach and a much
larger parking lot 8 little further south than the present one.
