EXECUTIVE SUMMARY Recommendation to approve an after-the-fact amendment to the Older Americans Act Program agreement and corresponding budget amendments to reflect increased grant funding in the amount of $91,529; from the Area Agency on Aging of Southwest Florida, Inc., d/b/a Senior Choices of Southwest Florida. (Net Fiscal Impact$101,698.88) OBJECTIVE: To continue provision of meals and other support services to qualified Collier County Seniors. CONSIDERATIONS: Collier County Services for Seniors has provided support services to Collier County's qualified senior citizens for over 30 years through Older Americans Act programs (OAA). Funding is provided through the Florida Department of Elder Affairs, and administered by Senior Choices. The contract period for OAA programs is January 1, 2013 through December 31, 2013. The original award and budget was approved by the BCC on January 22, 2013, Item 16.D.5. On May 28, 2013, Item 16.D.13, the Board approved Amendment#1 to decrease funding. Staff received the proposed Amendment #2 which includes an increase in funding and includes contract language as defined in Florida Statues, Sections 119.0701 and Section 119.011(2) which relates to compliance with public records. Packet Page-1878- 9/24/2013 16.D.10. Amendment #2 was received by staff on August 21, 2013 and was required to be returned to Senior Choices within 30 days. Amendment #2 is being presented after-the-fact because Amendment #2 was not received in time for it to be processed to meet the agenda submittal deadlines for the September 10, 2013 Board meeting. In order to remain in compliance with the grant and to be able to continue to provide much needed services to the County's frail elderly it was necessary to execute the amendment prior to the regularly scheduled Board meeting. Consequently, pursuant to CMA 5330 and Resolution No. 2010-122, the County Manager authorized Steve Carnell, Interim Administrator,to sign the contract amendment. Collier County as the Lead Agency is responsible to respond to seniors needs and to manage the spending authority for the OAA programs. FISCAL IMPACT: A budget amendment in FY14 is required in the amount of $91,529.00, which will reside in Human Services Grant Fund 707, affecting Project Numbers 33246, 33247, 33248 and 33249. Matching Fund budgets in Human Services Match Fund 708 will be amended accordingly in the amount of$10,169.88. Match funds are available within Fund 708 Reserves supported by excess revenues received from prior year unit reimbursements which may be reinvested into the OAA programs. LEGAL CONSIDERATIONS: This is a standard form amendment provided by the Area Agency on Aging for Southwest Florida, Inc. d/b/a Senior Choices of Southwest Florida. This item has been approved for form and legality and requires a majority vote for Board action. — JAB. GROWTH MANAGEMENT: There is no growth management impact from this recommendation. RECOMMENDATIONS: That the Board of County Commissioners approve the after-the-fact amendment#2 and attestation statement between Collier County and the Area Agency on Aging for Southwest Florida, Inc d/b/a Senior Choices of Southwest Florida and authorize the budget amendments. The purpose of this amendment is to increase the contract amount by$91,529.00 and increase the level of services accordingly. Line denotes completion of above summary The Standard Contract is hereby amended to read as follows: 7.2.5 As defined in Sections 119.0701 and Section 119.011(2),Florida Statutes,the Recipient shall keep and maintain public records that ordinarily and necessarily would be required by the public agency in order to perform services. 7.2.6 The Recipient shall provide the public with access to public records on the same terms and conditions that the public agency would provide the records,and at a cost that does not exceed the cost provided in Chapter 119, Florida Statutes, or as otherwise provided by law. 7.2.7 Public records that are exempt or confidential and exempt from public records disclosure requirement are not to be disclosed except as authorized by law. 7.2.8 All requirements shall be met for retaining public records and transfer,at no cost to the agency all public records in possession of the Recipient upon termination of the contract and destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. All records stored electronically must be provided to the public agency in a format that is compatible with the information technology systems of the public agency. This amendment shall be effective on August 8,2013. All provisions in the agreement and any attachments thereto in conflict with this amendment shall be and are hereby changed to conform with this amendment.
