Agenda 09/24/2013 Item #10A 9/24/2013 10.A.
EXECUTIVE SUMMARY
Appointment of Members to the Collier County Planning Commission.
OBJECTIVE: To appoint seven members to the Collier County Planning Commission.
CONSIDERATIONS: The Collier County Planning Commission, recently merged with the
Environmental Advisory Committee, currently has five vacancies representing each
Commissioner District and two at-large vacancies representing environmental interests. No
specific experience requirements shall be necessary as a prerequisite to appointment, but special
consideration shall be given to applicants who have experience or who have shown interest in the
area of planning, zoning, and related fields. Further consideration in the appointment of Planning
Commission members shall be made so as to provide the Planning Commission with the needed
technical, professional, business, and/or administrative expertise to accomplish the duties and
functions of the Planning Commission.
The two at-large environmental members are expected to provide the Planning Commission with
technical expertise on environmental matters, and shall demonstrate evidence of expertise in one
or more of the following areas related to environmental protection and natural resources
management: air quality, biology (including any of the sub-disciplines such as botany, ecology,
zoology, etc.), coastal processes, estuarine processes, hazardous waste, hydrogeology,
hydrology, hydraulics, land use law, land use planning, pollution control, solid waste, stormwater
management, water resources, wildlife management, or other representative area deemed
appropriate by the BCC, with a Board preference for one of these members with an expertise in
biology and/or wildlife management, and the other with an expertise in water and/or hydrology.
Members are required to file a Form 1, Statement of Financial Interest each year with the
Supervisor of Elections.

COMMITTEE RECOMMENDATION: Quasi-Judicial- no recommendation
FISCAL IMPACT: NONE
GROWTH MANAGEMENT IMPACT: NONE
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. The
new Planning Commission Ordinance provides in part as follows:
"Terms of office of planning commission members shall be for not less than two nor
more than four years and not more than a minority of such members'terms shall expire in
any one year."
This language was taken from the 1967 Special Act which in part created the Planning
Commission (which can be found in Sec. 250-33 in Municode). Accordingly, the Board will
need to stagger the terms of the reconstituted CCPC.
In creating staggered terms, it may be helpful to the Board to note that current Planning
Commissioners Ebert and Homiak's terms were due to expire October 1, 2013; current Planning
Commissioners Rosen and Strain's terms were due to expire October 1, 2016; and the District
Four seat(presently vacant) was due to expire October 1, 2015.
There are two categories of seats on the reconstituted Planning Commission. The Board
may establish different terms for the two at-large seats compared to the District seats. The terms
for each category, however, should be the same. Establishing separate terms for these categories
will mean additional consideration should be given to avoid future staggering issues.
The ordinance further provides that candidates for the District Seats must be nominated
by the Commissioner for that District, and require majority vote. The two at-large members can
be nominated by any Commissioner, but must receive four-fifths vote for appointment or
reappointment. -JAK
RECOMMENDATION: That the Board of County Commissioners considers appointing seven
members and directs the County Attorney to prepare a resolution confirming the appointments.

I have been a full time resident of Marco Island for 11 years, moving to Collier County after a
successful 26-year career as an Army officer, retiring as a full Colonel. My military experience
as a Garrison Commander, the equivalent of a city manager, of a major U.S. Army Installation ins
Georgia has provided the background to serve on the Collier County Planning Commission. This
military installation was the largest employer in the entire Central Savannah River Area with an
economic impact of$1.1 billion to the local Augusta-Richmond economy. Execution of the
comprehensive master plan was essential to our community growth strategy that included
expansion for new schools, housing areas and utilities. The valuable knowledge I've gained in
managing the natural resources of an area roughly 68 square miles, specifically forestry,
endangered species, fish and wildlife management, air quality, and water resources protection, is
particularly applicable to this volunteer position. Promoting ecological integrity of the landscape

current and future needs. The public's use of these lands was also a part of the balance. Members
of the public were permitted to hunt on the land at various times of the year. In addition, limited
training areas remained in full service even while the endangered Red-Cockaded Woodpecker
