EXECUTIVE SUMMARY
Recommendation to approve a Joint Motion and Stipulated Final Judgment in the amount of
$38,500 for Parcel 455RDUE, in the lawsuit captioned Collier County v. Alex D. Randolph, et al,
Case No. 17-CA-1472, required for the Golden Gate Boulevard Expansion Project No. 60145.
(Fiscal Impact: $32,940)
OBJECTIVE: To approve a settlement of full compensation owed for the taking of Parcel 455RDUE
required for the expansion of Golden Gate Boulevard from east of Everglades Boulevard to east of the
Faka Union Canal (Segment 3 - Project No. 60145), hereinafter referred to as the “Project”.
CONSIDERATIONS: On November 14, 2017, Collier County condemned Parcel 455RDUE and
deposited $5,730 into the Court registry as a good faith estimate of value p ursuant to an Order of Taking
in the lawsuit styled Collier County v. Alex D. Randolph, et al, Case No. 17-CA-1472. Parcel 455RDUE
is a 2,100-sq. foot perpetual, non-exclusive road right-of-way drainage and utility easement required for
the construction of the Project. An Aerial of Parcel 455RDUE is attached. Their initial claim was
$46,690. Through negotiations, the parties agreed to total compensation in the amount of $38,500, broken
down as follows: $22,500 to the homeowners, and $16,000 in attorney’s fees, expert fees, and costs. If
approved, the County will be required to pay an additional $32,940, which includes the $170 fee to
deposit into the Clerk’s Registry.
The County Attorney’s Office and Staff recommend approval of this Stipulated Final Judgment since a
better result is not anticipated at trial. Upon approval, the County Attorney’s Office will file the Joint
Motion and Stipulated Final Judgment with the Circuit Court.
FISCAL IMPACT: Funds in the amount of $32,940 will be paid from impact fees from the Golden Gate
Boulevard Expansion Project No. 60145. The primary funding source for the acquisition of right-of-way
is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding
source will be gas taxes.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been prepared by the County Attorney’s Office, is
approved as to form and legality, and requires a majority vote for Board approval. - JAB
RECOMMENDATION: To approve the attached Joint Motion and Stipulated Final Judgment, and
authorizes the payment of funds as stated herein.
