EXECUTIVE SUMMARY
Recommendation to direct staff to send the 2014 Evaluation and Appraisal Report (EAR) letter to
the Department of Economic Opportunity as required by Florida Statute 163.3191.
OBJECTIVE: To have the Board authorize staff to send the 2014 EAR letter to the DEO
indicating that no EAR required amendments are necessary, as required by F.S. 163.3191.
CONSIDERATIONS: On January 31, 2011, the Board adopted the 2011 EAR-report, the
seven-year assessment of the County's Growth Management Plan (GMP). Later that summer,
the Florida Legislature passed the Community Planning Act, which substantively altered the
requirements for the preparation of an EAR-report, as well as the schedule of the next round of
EAR-reports for jurisdictions throughout the State. Within that revised schedule, January 2014,
is the due date for the County's next EAR-report. This shortened three-year window, in
combination with the fact that in February of 2013, the Board adopted the 2011 EAR-based
amendments related to the 2011 EAR and the fact that an EAR-report is now only required to
address issues of Statutory non-compliance results in the reality that no changes are needed
statutorily to the county's GMP. The attached letter expands upon those facts and stands as the
County's 2014 EAR-report, as provided for by F.S. 163.3191. The Planning Commission
reviewed the letter at their July 17, 2013 Public Hearing, with no changes recommended.
FISCAL IMPACT: There is no fiscal impact associated with the request
GROWTH MANAGEMENT IMPACT: The attached Evaluation and Appraisal Notification letter
(Exhibit "A") is designed to satisfy the statutory requirements for the 2014 Collier County EAR-
report and once accepted by the DEO, the County's EAR requirements will be satisfied until
2021.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality. A
majority vote is needed for Board approval.—HFAC
RECOMMENDATION: That the Board directs staff to send the Evaluation and Appraisal
Notification letter(Exhibit"A")to the Department of Economic Opportunity.

Attached is the Evaluation and Appraisal Notification letter prepared for submittal to the State of
Florida Department of Economic Opportunity (DEO). If you recall, in 2012 the DEO assigned
January 1, 2014 as the date Collier County was to complete our next EAR, only three years since
the County's last adoption date for the EAR (seven years is the traditional spacing between
evaluations). Plus, the State's requirements for evaluations and appraisals had changed
dramatically, now necessitated only to meet changes in State law.
Staff has completed our evaluation of whether EAR-based GMP amendments are needed at this
time — and there are none. This notification of the County's intention to not amend its
comprehensive plan will fulfill our EAR requirement.
Comprehensive Planning staff will be present at your July 18 meeting to explain further, take
your comments and answer your questions.

Subject Collier County Evaluation and Appraisal Notification
Dear Mr. Eubanks:
Per the Evaluation and Appraisal Notification Schedule 2012-2018 posted on the State of Florida
Department of Economic Opportunity's website, Collier County, by January 1, 2014, must make a
determination as to whether the need exists to amend the comprehensive plan to reflect changes in
State requirements since the last time the comprehensive plan was updated.
Collier County submitted an adopted EAR in 2011 and it was found sufficient. The County submitted
proposed EAR-based amendments in April, 2012 and your Department rendered an Objections,
Recommendations and Comments Report on July 6, 2012. This Report indicated the State found no
Objections to the EAR-based amendments. However, the Report did include a number of technical
assistance comments.
Public hearings were held in September and October of 2012 and January, 2013, with the Board of
County Commissioners adopting EAR-based amendments, with the technical comments revisions that
your Department recommended, on January 8, 2013. The Department of Economic Opportunity
issued its Notice of Intent to find Collier County's EAR-based amendments "In Compliance" on
February 15, 2013. No petitions challenging the amendments were filed and they are now in effect.
Since that time we have monitored the 2013 Legislative Session and determined that no amendments
to the comprehensive pan are necessary in order to be consistent with new statutory requirements.
Tnerefore, Collier County has aetermined -mat there is no need to prepare an EAR.
