EXECUTIVE SUMMARY
Appointment of member to the Affordable Housing Advisory Committee.
OBJECTIVE: To appoint an alternate member to the Affordable Housing Advisory Committee
for a term that expires on October 1, 2014.
CONSIDERATIONS: The 11 member Affordable Housing Advisory Committee was
created by Ordinance 91-65, as amended, to monitor and advise the Board of County
Commissioners and the City Council regarding the goals, objectives, and policies of the county's
housing element in the county's growth management plan and the city's comprehensive plan, and
any other program, means, or directives which would assist or encourage the provision of
affordable housing in Collier County and its municipalities. The Board of County
Commissioners appoints nine members, including the alternate member, one of which must be a
resident of Immokalee. The City of Naples appoints two members. The composition of the
committee is set forth in the Ordinance and includes a member of the Collier County Planning
Commission. Terms are three years. A list of the current membership is included in the backup.
There are currently four vacancies on the Affordable Housing Advisory Committee.

1. CALL TO ORDER
Chairman Stephen Hruby called the meeting to order at 3:03 PM and read the procedures
to be observed during the meeting.
2. ROLL CALL—COMMITTEE MEMBERS AND STAFF
Roll Call was taken. A quorum was established; seven(7)voting members were present.
3. APPROVAL OF AGENDA AND MINUTES

John Cowan moved to approve the Agenda as amended. Second by Vice Chairman

B. AHAC Meeting Minutes—May 6,2013
• During the April 8th meeting, Staff had been directed to verify the status of John
Cowan's attendance at the January meeting. It was determined that Mr. Cowan
was "Excused." The January minutes will be amended to reflect the correction.
John Cowan moved to approve the minutes of the May 6, 2013 meeting as submitted
Second by Gerald Murphy. Motion carried, 7—0.
C. Subcommittee Minutes—May 6, 2013
Chairman Hruby noted a copy of the Subcommittee Minutes had been provided to the
AHAC members as an informational item. A vote was not required.
4. INFORMATION ITEMS
A. Expiring Terms—AHAC Members
Kim Grant reported Stephen J.Hruby and Clyde C. Quinby member terms will expire on
October 1, 2013.
If anyone is interested in serving on the AHAC they may apply or reapply online at the County
website for vacancies available to be filled:
o Employers within jurisdiction
o Labor actively engaged in home building
o Alternate
o A representative from Immokalee
B. Appointment of AHAC Member to DSAC
Kim Grant noted Mark Strain is also a member of the Planning Committee where DSAC
plans are reviewed. In order to amend the DSAC Ordinance would require a Public
Hearing and advertise changes to the Ordinance.

A consensus was formed to direct Staff to proceed forward in approaching the BCC to
amend the DSAC Ordinance to identify a seat on the DSAC for an AHAC member.

6. DISCUSSION ITEMS/PRESENTATIONS
A. NSP Video
Public Services County Staff presented a short video was shown on the accomplishments
of Neighborhood Stabilization Program.
B. Recommendations: Review of Funding approved for CDBG,HOME & ESG Projects
Addressed after 6C.
C. Subcommittee Report: June 3rd and July 1st
Chairman Hruby gave an update on the July meetings:

• Staff provided statistics and data received from HUD and Shermburg.
• Focused on multifamily housing
• Gross indicators for multifamily housing

• July 1 -Worked on a methodology for incentives.
• Process was made.
• What types of incentive programs the Subcommittee wants to suggest.
• Report is scheduled to be available in January 2014.

She reviewed the "Next Steps:"

• Funding is for the period of October 1, 2013 through September 30, 2014.
Staff recommended the Committee approve the Review Committee's recommendation to fund
the projects identified FY2013-2014 Annual Funding Cycle for CDBG,HOME & ESG
allocation.
Staff addressed all questions.
Committee members requested additional time and Staff to provide a synopsis on the
recommendations prior to endorsement allocation recommendations.
Chairman Hruby suggested a"Special" Committee meeting with only one item on the
agenda. It was decided to hold a"Special"Committee meeting on July 15th at 3:00 pm.

D. Application of Albert Batista: Finding from County Attorney's Office
Staff provided an email composed by Colleen M. Greene,Assistant County Attorney dated
April 10, 2013 on CCPC Ethics Inquiry and Albert Batista's Advisory Board Application Form
to serve on AHAC. (See attached)
The County Attorney's Opinion"based on information presented, there is not a statutory
conflict of interest under CH. 112, Fla. Stat.provides an "optional abstention provision" that
allows an advisory committee member to abstain from voting on a matter when there is or
appears to be a possible conflict of interest under Ch.112. "
Gerald Murphy moved to recommend Albert Batista application to serve on the AHAC
Committee to the BCC for approval.
Second by Vice Chairman Christian Davis.
Motion carried, 6-0.
John Cowan abstained.

This 11 member commission was created on July 23, 1991, by Ordinance No. 91-65, to monitor
the implementation of the Affordable Housing Task Force's Recommendations, and the goals,
objectives, and policies of the Housing Elements of the County's Growth Management Plan and
the City's Comprehensive Plan. Terms are 3 years.
Amended by Ordinance No. 2005-69: the BCC will appoint 8 members, including the alternate
member, two of which must live in the Rural Area (East of Collier Boulevard), and one of those
must be a resident of Immokalee. The City of Naples will appoint 2 members.
On 12/14/04 the BCC adopted Ordinance 2004-77 to add 1 Alternate member to be appointed by
the BCC. The Alternate member shall serve in a voting capacity only when a regular member is
absent from a meeting.
On December 13, 2005, the BCC approved Ord. No. 2005-69 changing the composition of the
committee, 9 members and 1 alternate. The BCC will appoint 8 members, including the alternate
(2 of which must live in the Rural Area (East of Collier Boulevard), and one of those must be a
resident of lmmokalee) and the City of Naples will appoint 2 members.
On April 11, 2008 the BCC adopted Ord. No. 2008-17 changing composition of committee; 11
members & 1 alternate; BCC will appoint 9 members plus alternate; City of Naples will appoint 2
members. Take stipulation (East of Collier Boulevard) out of ordinance.
The commission shall be comprised of members from the following categories in connection with
affordable housing:
1. Residential home building industry;
2. Banking or mortgage banking industry;
3. Areas of labor actively engaged in home building;
4. Advocate for low-income persons;
5. For-profit provider of affordable housing;
6. Not-for-profit provider of affordable housing;
7. Real Estate professional;
8. Local planning agency;
9. Citizen who resides within the jurisdiction of the local governing body making the
appointments;
10. Citizen who represents employers within the jurisdiction;
11. Citizen who represents essential services personnel; and
12.Alternate
