Recommendation to disclaim, renounce and vacate the County and the public interest in a portion of the Drainage Canal Easement, recorded in Official Record Book 4385, page 3675 of the Public Records of Collier County, Florida, also being a part of Section 19, Township 50 South, Range 26 East, Collier County, Florida, and to accept the Dedication and Conveyance of easement for access and maintenance. [Petition VAC-PL20130000413] OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the Drainage Canal Easement, recorded in Official Record Book 4385, page 3675 of the Public Records of Collier County, Florida, also being a part of Section 19, Township 50 South, Range 26 East, Collier County, Florida, and to accept the Dedication and Conveyance of easement for access and maintenance. CONSIDERATIONS: Petition VAC-PL20130000413 has been received by the Engineering Services, Growth Management Division, Planning and Regulation from John English of Peninsula Engineering, as agent for Minto Sabal Bay, LLC. This vacation request is to vacate a portion of the Drainage Canal Easement, recorded in Official Record Book 4385, page 3675 of the Public Records of Collier County, Florida, also being a part of Section 19, Township 50 South, Range 26 East, Collier County, Florida, more specifically shown in Exhibit A, and to accept the Dedication and Conveyance of easement for access and maintenance. Letters of no objection from abutting property owners have been received from all who responded. Certified mail receipts exist for those who elected not to respond. FISCAL IMPACT: Growth Management Division, Planning and Regulation, Engineering Services staff has collected a $2,100 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact. LEGAL CONSIDERATIONS: The vacation of easements conveyed to the County by separate instruments recorded in the public records is authorized by Sections 125.01 and 125.37, Florida Statutes, and Collier County Resolution No. 2006-160. The County has complied with all advertising requirements required by law for the vacation of this easement and the acceptance of the replacement easement. This item has been approved as to form and legality, and requires a majority vote for approval. -ERP RECOMMENDATION: That the Board of County Commissioners 1) approves the attached Resolution, relating to Petition VAC-PL20130000413, which will vacate the County and the public interest in a portion of the Drainage Canal Easement, recorded in Official Record Book 4385, page 3675 of the Public Records of Collier County, Florida, also being a part of Section 19, Township 50 South, Range 26 East, Collier County, Florida, more specifically shown in Packet Page -1361- 7/9/2013 17.A. Exhibit A; 2) accepts the Dedication and Conveyance of easement for access and maintenance; and 3) directs the Clerk to the Board to record a certified copy of the Resolution and the Dedication and Conveyance of easement for access and maintenance in the Public Records of Collier County, Florida. Grantor specifically reserves the right to full use and enjoyment of the area within the Access and Maintenance Easement for all uses and purposes not inconsistent with the right conveyed to Grantee pursuant to this Easement, including,but not limited to, Grantor's right to secure the area within the Access and Maintenance Easement from access by the general public by any lawful means as Grantor may deem necessary or desirable, including, but not limited to, the construction of security fencing and gates.
