7/9/2013 16.G.1 . EXECUTIVE SUMMARY Recommendation that the Collier County Airport Authority grant the Executive Director the authority to work with the Solid and Hazardous Waste Management Department to obtain possible funding to resolve a petroleum discharge cleanup at Marco Island Airport. OBJECTIVE: To allow the Executive Director to work with the Collier County Solid and Hazardous Waste Management Department to obtain possible funding to fulfill its obligation for Site rehabilitation Completion Order(SRCO)approval with the Florida Department of Environmental Protection(FDEP). CONSIDERATIONS: Chapter 62-770, Florida Administrative Code, defines the criteria for Petroleum Site Contamination Cleanup. The Marco Island Airport has an open petroleum discharge that is eligible for FDEP cleanup funding through the Inland Protections Trust Fund (IPTF). The discharge occurred at the Airport on December 6, 1988. The cleanup at the site has been inactive for some time due to low priority scoring by the FDEP. The Marco Airport site was scored a 7 based upon this scoring system The priority score is used to rank cleanup sites eligible for the IPTF funding since the cost of the IPTF eligible cleanups statewide far exceeds the IPTF balance. Note, however, that the IPTF is continually replenished by taxes on barrels of oil imported into Florida,which has sustained the program for over 25 years. Due to natural attenuation by micro-organisms living sub-surface feeding on low levels of petroleum contamination at the plume fringes and a cleanup effort conducted by the Airport in 1999, there is a possibility that the Airport has already achieved soil and groundwater cleanup target levels that would make it eligible for a SRCO from the FDEP, releasing the site from future cleanup actions. The FDEP has initiated a new program under the IPTF termed Low Score Site Initiative (LSSI) in which IPTF funded sites with low scores are being assessed for current plume concentrations. The cap for the program is $30,000 per site and no prior investment is required by the property owner (County). However, if it is determined that the site will be eligible for a SRCO, the deductible for the program the discharge is eligible for will be collected. In this case, no deductible payment is required in the event closure is obtained since the Marco Airport is in the Early Detection Incentive (EDI) program which has no cap or deductible. The Marco Island Executive Airport, FDEP Facility ID 8518749 has not fulfilled its obligation pursuant to Chapter 62-770 F.A.C., and currently does not qualify for a Site Rehabilitation Completion Order (SRCO) approval. If obtained, the proceeds from the LSSI program will bring the Airport into compliance. FISCAL IMPACT: None. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues, and requires majority vote for approval. -JAK RECOMMENDATION: That the Collier County Airport Authority authorize the Executive Director to work with the Collier County Solid & Hazardous Waste Management Department to obtain possible funding.
