EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners approve a budget
amendment in an amount up to $420,600, and approve payment for detention
services provided by the Florida Department of Juvenile Justice (DJJ).
OBJECTIVE: To obtain Board approval for a budget amendment in the amount of $420,600
and to reimburse DJJ for those detention services for the remainder of FY 2013.
CONSIDERATION: In the fourth quarter of FY 2005, the county began to pay for costs of pre-
dispositional days associated with the housing and feeding of juveniles being held in state-run
Department of Juvenile Justice Detention Centers. Pre-dispositional days are days that the
juveniles spend in the detention centers before appearing before a judge. Following those
appearances, the State of Florida is responsible for detention and any associated costs.
Previously, before FY 2005, all costs were paid for by the State of Florida. The following is a
breakdown of adopted budget versus actual costs since inception:

DJJ uses the latest audited actual information to estimate pre-dispositional days for each county
and this information was factored against the total FY 2013 State DJJ budget of$74,009,403, to
arrive at a proportionate share for each County. For FY 2013, the estimated pre-dispositional
days were equal to the actual days from the State Fiscal Year 2011/2012 spent by Collier
County juveniles in the detention centers prior to an appearance before a judge. Following
those appearances, the state assumes the responsibility and costs for those juveniles.
At the end of each State fiscal year, an audit is conducted and adjustments are made to each
county's apportion. These adjustments are usually received in the beginning of the following
calendar year. In FY 2012, Collier County received an adjustment for an additional payment of
$797,922.74. Shortly thereafter, a suit was filed against DJJ concerning the adjustments.
Collier County deferred paying this adjustment until the suit was decided. The court ruled in
favor of the DJJ. The County's FY 2013 had already begun and this payment was made on
October 23rd, 2012. On December 10th, 2012, the adjustment for the next year was a credit of
$102,879.00 for a net adjustment of $695,043.74 of additional charges in FY 2013. Since the
County's fiscal year does not coincide with the State fiscal year, the first nine months of
payments are different than the last three months. With the first nine months of payments at

$192,325.10 per month, the last three months at $154,366.94 per month, and the adjustments,
there will be insufficient funds of $420,600 for payments to DJJ if a budget amendment is not
approved.
FISCAL IMPACT: A budget amendment from General Fund (001) reserves in an amount up to
$420,600 will only be processed as needed to reimburse outstanding and future FY 2013
billings for juvenile detention services provided by the Florida Department of Juvenile Justice.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no
legal issues, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this executive summary.
RECOMMENDATION: That the Board of County Commissioners approve increased payments
to the Department of Juvenile Justice and approve all necessary budget amendments.
