Petition VAC- PL20130000583, to disclaim, renounce and vacate the County and the public interest
in a 20 -foot wide Lake Maintenance Easement (LALE.), being a part of Tract E of Fiddlers Creek
Phase 5, Aviamar Unit One, Plat Book 45, pages 34 through 39 of the Public Records of Collier
County, Florida, also being a part of Section 13, Township 51 South, Range 26 East, Collier
County, Florida, more specifically shown in Exhibit A, and accept the grant of a replacement
easement.
OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a 20 -foot
wide L.M.E., being a part of Tract E of Fiddlers Creek Phase 5, Aviamar Unit One, Plat Book
45, pages 34 through 39 of the Public Records of Collier County, Florida, also being a part of
Section 13, Township 51 South, Range 26 East, Collier County, Florida.
CONSIDERATIONS: Petition VAC- PL20130000583 has been received by the Engineering
Services, Growth Management Division, Planning and Regulation from Mark Woodward, Esq.,
of Woodward, Pires & Lombardo, P.A., as agent for the property owner. This vacation request is
to vacate a 20 -foot wide L.M.E., being a part of Tract E and relocating the L.M.E. to Tract C
along Sandpiper Drive, both of Fiddlers Creek Phase 5, Aviamar Unit One, Plat Book 45, pages
34 through 39 of the Public Records of Collier County, Florida, also being a part of Section 13,
Township 51 South, Range 26 East, Collier County, Florida, to construct a subdivision location
sign identifying the Millbrook Subdivision.
Letters of no objection from abutting property owners have been received from all who
responded. Certified mail receipts exist for those who elected not to respond.
FISCAL IMPACT: Growth Management Division, Planning and Regulation, Engineering
Services staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers
the County's cost of recording and processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact.
LEGAL CONSIDERATIONS: This item has been reviewed as to form and legality and
requires a majority vote for approval. - ERP
RECOMMENDATION: That the Board of County Commissioners; 1) approves the attached
Resolution, relating to Petition VAC- PL20130000583, which will vacate the County and the
public interest in a 20 -foot wide. L.M.E., being a part of Tract E of Fiddlers Creek Phase 5,
Aviamar Unit One, Plat Book 45, pages 34 through 39 of the Public Records of Collier County,
Florida, also being a part of Section 13, Township 51 South, Range 26 East, Collier County,
Florida, more specifically shown in Exhibit A, and 2) accepts the Grant of Easement to provide a
replacement L.M.E., and 3) directs the Clerk to the Board to record a certified copy of the
Resolution and Grant of Easement in the Public Records, and to make proper notation of this

COLLIER COUNTY, FLORIDA TO DISCLAIM, RENOUNCE AND
VACATE THE COUNTY AND THE PUBLIC INTEREST IN A 20 -FOOT
WIDE LAKE MAINTENANCE EASEMENT (L.M.E.), BEING A PART OF
TRACT E OF FIDDLERS CREEK PHASE 5, AVIAMAR UNIT ONE,
PLAT BOOK 45, PAGES 34 THROUGH 39 OF THE PUBLIC RECORDS
OF COLLIER COUNTY, FLORIDA, ALSO BEING A PART OF SECTION
13, TOWNSHIP 51 SOUTH, RANGE 26 EAST, COLLIER COUNTY,
FLORIDA. (PETITION VAC- PL20130000583)
WHEREAS, pursuant to Section 177.101, Florida Statutes, and Resolution 2006 -160,
Petitioner, Mark Woodward, Esq., of Woodward, Pires & Lombardo, P.A., has requested the
vacation of the County and the Public interest in a 20 -foot wide Lake Maintenance Easement
(L.M.E.), "being a part of Tract E of Fiddlers Creek Phase 5, Aviamar Unit One, Plat Book 45,
pages 34 through 39 of the Public Records of Collier County, Florida, also being a part of
Section 13, Township 51 South, Range 26 East, Collier County, Florida, being more specifically
described in Exhibit A; and
WHEREAS, at its May 14, 2013 regular :meeting, the Board of Commissioners, via
Resolution No. 2013 -104, approved the scheduling of a public hearing on June 25, 2013,
pursuant to Section 177.101, Florida Statutes, and Resolution 2006 -160; and
WHEREAS, the Board of County Commissioners, on this day, held a public hearing to
consider the petitioner's request and notice of said public hearing was given as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest in a 20
foot wide Lake Maintenance Easement (L.M.E), being a part of Tract E of Fiddlers Creek Phase
5 Aviamar 'Unit One, Plat Book 45, pages 34 through 39 of the Public Records of Collier
County, Florida, also being a part of Section 13, Township 51 South, Range 26 East, Collier
County, Florida, as specifically depicted in Exhibit A, attached hereto and incorporated herein by
reference, is hereby vacated, extinguished, renounced and disclaimed, and this .action is declared
to be in the public interest and for the public benefit.
BE IT FURTHER RESOLVED AND 'ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the public records and to make proper
notation of this Resolution on the plat of Fiddlers Creek Phase 5, Aviamar Unit One, recorded in
Plat Book 45, Pages 34-39 of the public records of Collier County, Florida.
THIS RESOLUTION ADOPTED after motion, :second and majority vote favoring

TlpI LAKE MAINTENANCE EASEMENT, granted as of the day of
��✓ o� , 2013, by FCC PRESERVE, LLC, a Florida limited
liability company, whose address is: 8156 Fiddler's Creek Parkway, Naples, Florida 34114-
0816, as the Grantor, to COLLIER COUNTY, its successors and assigns ( "Collier County"),
and the FIDDLER'S CREEK COMMUNITY DEVELOPMENT DISTRICT 2, a special
purpose unit of local government established pursuant to F. S. 190, its successors and assigns
( "CDD -2 "), hereinafter collectively referred to as the "Grantees."
WITNESSETH: That the Grantor, for and in consideration of the sum of ten dollars
($10.00) and other good and valuable consideration paid by the Grantees, the receipt of
which is hereby acknowledged, hereby conveys, grants, bargains and sells unto;
Collier County, their respective successors and assigns, a non - exclusive
easement without any responsibility for maintenance for access over, across,
under and through portions of Tract "C ", Fiddler's Creek Phase Five, Aviamar,
Unit One, according to the plat thereof recorded in Plat Book 45, Pages 34
through 39, of the Public Records of Collier County, Florida, as more
particularly described in Exhibit "A "attached hereto and incorporated herein by
reference (the "Easement Area ").
CDD -2, their respective successors and assigns, a non - exclusive easement for
the installation, repair, maintenance and access over, across, under and through
the "Easement Area ".
This Easement shall be nonexclusive and the rights, covenants and agreement of the
parties shall run with the title to the property and shall be binding on and inure to the benefit
of the parties hereto and their successors and assigns. The Grantor covenants that it has the
right to convey the Easement, and the Grantor hereby retains for itself, its successors and
assigns, the right to use the Easement Areas provided such use does not interfere with the
Grantees' rights herein.
