EXECUTIVE SUMMARY
Recommendation to approve and execute the documents necessary to convey two easements to
Florida Power & Light Company on County property at the Gordon River Greenway Park;
Project No. 80065.1.
OBJECTIVE: To convey two easements for installation of distribution electric infrastructure on County
property.
CONSIDERATIONS: On February 26, 2013, Agenda Item 11A, the Board approved the award of a
construction contract to Manhattan Construction, Inc. in the'amount of $8,939,010. Within the scope of
work, the project includes the installation of distribution electric line serving the Zoo and future Gordon
River Greenway Park (GRG Park). An Easement to Florida Power & Light Company (FP &L) for the
installation of overhead and underground distribution lines from Goodlette -Frank Road into the GRG
Park property (West Node), and an Easement to FP &L for the installation of underground distribution
lines from Golden Gate Parkway into the GRG Park property (NE Node), including, but not limited to,
wires, poles, guys, cables, conduits and appurtenant equipment, is required.
The West Node easement area measures a total of approximately .42 acres more or less, and is shown and
described on Exhibit "A" to that Easement; and the NE Node easement area measures a total of
approximately .19 acres more or less, and is shown and described on Exhibit "A" to that Underground
Easement. The County will not be compensated because the Easement is a requirement for FP &L to
provide the facilities necessary for the completion of the Gordon River Greenway Park.

FISCAL IMPACT: The total cost for recording and obtaining copies of the two Easement documents
will not exceed $55. Funds in the amount of $55 are available in the Parks & Recreation Department
Capital Improvement fund 306 under Project 80065.1.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for approval. - JAB
GROWTH MANAGEMENT IMPACT: The Gordon River Greenway Park is inventoried in the Collier
County Growth Management Plan. There is no impact to the Growth Management Plan by the
conveyance of this easement.
RECOMMENDATION: That the Board approves the Easements, authorizes the Chairwoman to execute
the aforementioned documents, and directs the County Manager or his designee to proceed to follow all
appropriate closing procedures and record the aforementioned documents in the Public Records of Collier
County, Florida.

WHEREAS, Grantor has acquired the property with partial funding from the Florida Communities
Trust (FCT), and the Property is subject to certain limitations provided in the FCT Grant Award
Agreement a /k /a the Declaration of Restrictive Covenants, as amended (as recorded In OR
Book 4273, Page 713 in the Public Records of Collier County, Florida; and Amendment recorded
in OR Book 4817, Page 2217 in the Public Records of Collier County, Florida), hereinafter referred
to as the "Agreement," and
WHEREAS, as part and condition of the FCT funding, the County provided and FCT approved a
Management Plan for the project site, and together with the Agreement, the terms of which are
hereby incorporated herein by reference; and
WHEREAS, Grantor intends that the conservation and recreation values of the Property be
preserved and enhanced In accordance with the Management Plan, as It may be amended
from time to time only after review and approval by FCT; and
WHEREAS, All activities by the Grantor and Grantee shall be consistent with the Agreement and
Management Plan.
The undersigned, in consideration of the payment of $1.00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents, successors, and assigns ( "FPL "), a
perpetual, non- exclusive easement for the construction, operation and maintenance of
overhead and underground electric utility facilities (including wires, poles, guys, cables, conduits,
and appurtenant equipment) to be installed from time to time; with the right to reconstruct,
improve, add to, enlarge, change the voltage, as well as, the size of and remove such facilities
or any of them within an easement described as follows:
See Exhibit "A" ( "Easement Area ")
Together with the right to permit any other person, firm or corporation to attach wires to any
facilities hereunder and lay cable and conduit within the easement and to operate the some for
communications purposes; the right of ingress and egress to the easement area at all times; the
right to clear the land and keep it cleared of all trees, undergrowth and other obstructions within
the Easement Area; to trim and cut and keep trimmed and cut all dead, weak, leaning or
dangerous trees or limbs outside of the easement area which might interfere with or fall upon
the lines or systems of communications or power transmission or distribution; and further grants, to
the fullest extent the undersigned has the power to grant, if at all, the rights hereinabove
granted on the Easement Area heretofore described, over, along, under and across the roads,
streets or highways adjoining or through said Easement Area.
