EXECUTIVE SUMMARY
Recommendation to approve and execute the document necessary to convey an easement to Florida
Power & Light Company on County property at the Gordon River Greenway Park; Project No.
80065.1.
OBJECTIVE: To convey an easement for installation of(transmission) electric infrastructure on County
property.
CONSIDERATIONS: On February 26, 2013, Agenda Item 11A, the Board approved the award of a
construction contract to Manhattan Construction, Inc. in the amount of$8,939,010. Within the scope of
work, the project includes the installation of two new poles for the transmission electric line serving the
Zoo and future Gordon River Greenway Park (GRG Park). An Easement to Florida Power & Light
Company (FP&L) for the installation of the two new poles along Goodlette-Frank Road, including, but
not limited to, wires,poles, guys, cables, conduits and appurtenant equipment, is required.
The easement area measures a total of approximately 400 square feet more or less, and is shown and
described on Exhibits "A" and `B" to the Easement. The County will not be compensated because the
Easement is a requirement for FP&L to provide the facilities necessary for the completion of the Gordon
River Greenway Park.
A location map is attached for reference.
FISCAL IMPACT: The total cost for recording the Easement will not exceed $35. Funds in the amount
of$35 are available in the Parks & Recreation Department Capital Improvement fund 306 under Project
80065.1.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office, is
approved as to form and legality, and requires a majority vote for approval. -JW
GROWTH MANAGEMENT IMPACT: The Gordon River Greenway Park is inventoried in the Collier
County Growth Management Plan. There is no impact to the Growth Management Plan by the
conveyance of this easement.
RECOMMENDATION: That the Board approves the Easement, authorizes the Chairwoman to execute
the aforementioned document, and directs the County Manager or his designee to proceed to follow all
appropriate closing procedures and record the aforementioned document in the Public Records of Collier
County,Florida.

UTILITY EASEMENT
(FLORIDA POWER AND LIGHT COMPANY)
THIS EASEMENT, made and entered into this day of
2013, by COLLIER COUNTY, a political subdivision of the State of Florida, whose
mailing address is 3335 Tamiami Trail East, Suite 101, Naples, Florida 34112
(hereinafter referred to as "Grantor"), to FLORIDA POWER AND LIGHT COMPANY,
whose mailing address is 700 Universe Boulevard, Juno Beach, Florida 33408
(hereinafter referred to as"Grantee").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and their respective heirs, legal representatives, successors and assigns.
Grantor and Grantee are used for singular or plural, as the context requires.)
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
licensees, agents, successors, and assigns, a perpetual, non-exclusive easement
forever for the construction, operation and maintenance of overhead and underground
electric utility facilities (including wires, poles, guys, cables, conduits and appurtenant
equipment) to be installed from time to time;with the right to reconstruct, improve, add
to, enlarge, change the voltage,as well as, the size of and remove such facilities or any
of them within an easement, as described on Exhibits "A" and "B" attached hereto and
made a part hereof.
Together with the right to permit any other person, firm or corporation to attach wires to
any facilities hereunder and lay cable and conduit within the easement and to operate
the same for communications purposes; the right of ingress and egress to said
premises at all times; the right to clear the land and keep it cleared of all trees,
undergrowth and other obstructions within the easement area;to trim and cut and keep
trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the
easement area which might interfere with or fall upon the lines or systems of
communications or power transmission or distribution: and further grants, to the fullest
extent the undersigned has the power to grant, if at all,the rights hereinabove granted
on the land heretofore described, over, along, under and across the roads, streets or
highways adjoining or through said property.
