EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairwoman to execute a Second Partial
Release of Conservation Easement with the South Florida Water Management District on
County owned property at the Vanderbilt Beach Parking Garage for the Vanderbilt Beach
Restroom Facility, and make a finding that the expenditure set forth herein promotes tourism;
Project No. 90046.
OBJECTIVE: To secure a partial release of conservation easement from the South Florida
Water Management District (SFWMD) in connection with the Vanderbilt Beach Restroom
Facility.
CONSIDERATIONS: On September 27, 2011, the BCC approved Variance Petition (CCSLPV
PL20100001812) requesting a variance from the Coastal Construction Setback Line (CCSL)
and preserve to allow for the construction of a new restroom complete with ADA ramp access,
and concrete piling foundation, seaward of the CCSL to replace the existing restroom structure,
all of which are located on or near the County-owned existing Vanderbilt Beach Parking Garage
with a street address of 100 Vanderbilt Beach Road, located in Section 32, Township 48 South,
Range 25 East, Collier County, Florida. On December 14, 2011, the Board approved Item 10K
for execution and processing of a Partial Release of Conservation Easement related to the
Variance Petition.
On Jan 22, 2013, as a result of public comment, the BCC approved (Item 11B) a revised
location and design of the beach park restroom facility. The new design is lower and more
compact, but is now located in a portion of the wetlands easement landward of the CCSL. This
relocation requires a further modification of the original Conservation Easement to SFWMD to
encompass the footprint of the redesigned and relocated restroom facility in Preserve #4. The
previous 0.02 Acre parcel at the western end of the Parking Garage in Preserve #3 for the
tractor access path is unchanged and is referenced in the Second Partial Release.
Therefore, a request for a Second Partial Release of a Conservation Easement from the
SFWMD is required to support the future development of this project. Staff, the design
consultant of record (Q Grady Minor & Associates and Coastal Engineering Consultants, Inc.),
and the County Attorney's Office have reviewed the attached Second Partial Release of
Conservation Easement and recommend that the Chairwoman approve and execute the
required document.
FISCAL IMPACT: The total cost for recording and copies of the Second Partial Release will not
exceed $80. Funds in the amount of $80 are available in the Parks & Recreation Department
Beach Park Facilities Fund 183 Project Number 90046.
GROWTH MANAGEMENT IMPACT: This project is consistent with the Growth Management
Plan Objective 1.3, Policy 1.3.2, to ensure that access to waterways remains available to the
general public.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office,
requires majority vote, and approved as to form and legality. - CMG

SECOND PARTIAL RELEASE OF CONSERVATION EASEMENT
This Partial Release of Conservation Easement ("Partial Release") is made this day
of , 2013, by and between the SOUTH FLORIDA WATER MANAGEMENT DISTRICT
("District") having an address of 3301 Gun Club Road, West Palm Beach, Florida 33406 and a
mailing address of Post Office Box 24680, West Palm Beach, Florida 33416-4680 and COLLIER
COUNTY, a political subdivision of the State of Florida ("Owner") having an address of c/o Parks
&Recreation, 15000 Livingston Road, Naples, Florida 34109.
WITNESSETH:
WHEREAS, the Owner granted in favor of the District that certain Deed of Conservation
Easement dated July 26, 2005 and recorded in Official Records Book 3857 at Page 1013 of the
Public Records of Collier County, Florida, amended by that certain Partial Release of
Conservation Easement dated December 13, 2011 and recorded in Official Records Book 4895
at Page 1357 of the Public Records of Collier County, Florida (hereinafter collectively referred to
as the "Conservation Easement") encumbering the real property described on Exhibit "A"
attached hereto and made a part hereof (hereinafter referred to as the "Original Premises");
and
WHEREAS, the District has been requested to release a portion of the Conservation
Easement with respect to only that portion of the Original Premises described on Exhibit "B"
attached hereto and made a part hereof (hereinafter referred to as the "Release Parcel"); and
WHEREAS, the District is amenable to amending the conservation easement to release a
portion of the Conservation Easement only with respect to the Release Parcel.
NOW, THEREFORE, for good and valuable consideration, the adequacy and receipt of
which is hereby acknowledged, the District hereby releases, discharges, and terminates the
Conservation Easement over and upon the Release Parcel, without impairing the operation and
effect of the Conservation Easement as to the remainder of the Original Premises which are not
contained within the Release Parcel, (the original Premises less and except the Release Parcel is
hereinafter referred to as the "Remainder Premises"). The Conservation Easement shall remain in
full force and effect with respect to the Remainder Premises and shall remain unaffected by this
Partial Release of Conservation Easement. All references in the Conservation Easement to
"Property"shall hereafter mean and refer to the Remainder Premises.
