EXECUTIVE SUMMARY
Recommendation to waive competition and authorize the extension of two existing sole-source
agreements; one with Allen-Bradley/Rockwell Automation for variable frequency drives and
related components, and one with Data Flow Systems, Inc.,for telemetry systems, both for a period
of five years.
OBJECTIVE: Ensure the ability to meet operational and reliability needs, meet the demand for
potable and irrigation quality water, and stay in compliance with all regulatory requirements at
the best value.
CONSIDERATIONS: On May 25, 2010 (Agenda Item 16C2), the Board of County
Commissioners (Board) approved sole-source agreements with Allen-Bradley/Rockwell
Automation, and Data Flow Systems, Inc. This request seeks to extend those agreements for an
additional five (5) five year period, with annual reviews by Public Utilities and Purchasing staff
to consider pricing, service and new product technology. Staff continues to review the industry
for alternative products and technologies that may provide greater value; however, for the near
future, these two vendors offer optimum solutions.
Allen-Bradley/Rockwell Automation
The Public Utilities Division uses more than 80 variable frequency drives (VFDs), and 190
programmable logic controllers (PLCs) supplied by Allen-Bradley/Rockwell Automation to
control its water, wastewater, reuse water, and solid waste processes. These electrical devices
are critical for maintaining compliance and meeting customer demand. The devices are highly
technical, requiring investment in infrastructure, systems, spare parts, and training. The
performance and reliability of this equipment has been at or above industry standards. By
standardizing on Allen-Bradley/Rockwell Automation for VFDs, PLCs, related interface
components and software, costs for training and spare parts is minimized.
The manufacturer has identified its local distribution network. The distribution supplier of
record, Rexel, Inc., is recognized as the exclusive distributor for Allen-Bradley/Rockwell
Automation products, per the attached letter of April 24, 2013. Also attached is the
corresponding sole source waiver.
Data Flow Systems
When the Wastewater Department integrated its pump stations with radio communications, it
selected Data Flow Systems (DFS) as the standardized, best-value approach. Since
implementing DFS at all pump stations, the system has proved itself in providing reliable, cost-
effective, real-time information critical to proactive operations and maintenance, and to meeting
system demand and staying in regulatory compliance. By standardizing on DFS for remote
terminal units, telemetry control units, hyper SCADA servers, related interface components and
software, costs for training and spare parts is minimized for the installed base of 750 pump
stations.

2013. Also attached is the corresponding sole source waiver.
Purchasing Director's Single Source Certification
Per the Board's policies on Standardization (XIV. A) and Formal Competitive Threshold (V. A
and C), the Purchasing Director certifies that it is in the best financial interest of the County to
standardize and waive competition.
FISCAL IMPACT: Funding is available in, and is consistent with, the FY13 Capital Budget
approved by the Board on September 20, 2012. The sources of funding are the Water User Fee
Fund (412), and the Wastewater User Fee Fund (414). Listed below are estimated expenditures
for the five-year term of the agreements.

LEGAL CONSIDERATIONS: This item has been reviewed as to form and legality, and requires
majority vote for Board approval. -SRT.
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to insure the adequacy of viable public facilities.
RECOMMENDATION: That the Board of County Commissioners, Ex-officio the Governing
Board of the Collier County Water-Sewer District:
1. Waive competition and authorize sole-source purchases of Allen-Bradley/Rockwell
Automation equipment for a five-year period.
2. Waive competition and authorize sole-source purchases of Data Flow Systems equipment
for a five-year period.

• Access to local distributor inventory(including spares and replacement parts)

Rexel - Sarasota, FL is the distributor authorized by Rockwell Automation to sell
Allen-Bradley and Rockwell Software products, along with related services, in the
geographic area in which your facility is located. As a matter of Company policy,
Rockwell Automation only provides product and sales support to the local authorized
distributor, and it is our practice and policy to always promote and recommend that
customers buy from their local authorized Allen-Bradley distributor. Rockwell
Automation discourages purchasing from non-authorized sources, including
distributors who may hold an Allen-Bradley appointment in another area.
If you purchase Allen-Bradley products from an unauthorized source, you may not
receive the latest version. The latest version of Allen-Bradley products, along with
related factory product services, only is available through your local authorized Allen-

Also, products that are not purchased directly from Rockwell Automation or its local
authorized distributor may not be covered by a manufacturer's warranty. Rockwell
Automation's standard manufacturer's warranty covers new Allen-Bradley products
for a period of one year from the date of Rockwell Automation's or its authorized
Allen-Bradley distributor's invoice to the customer. As a result, there is no assurance
that products sourced from unauthorized parties will carry a valid and unexpired
manufacturer's warranty. Customers purchasing products from unauthorized
sources should not assume that they will receive any rights under any Rockwell
Automation factory warranty. Only an authorized Allen-Bradley distributor may offer
access to factory warranty coverage on Allen-Bradley products.
We recognize that price can be an important consideration in any purchasing
decision; however, it also is important that customers understand what they are
getting for that price (or in the case of purchases from an unauthorized source, what
they're not getting). Rockwell Automation firmly believes that the best customer
value in the long-run is achieved by dealing with the local authorized Allen-Bradley
distributor.

is the sole source provider for the TAC II SCADA System and associated Remote Terminal Units (RTUs),
Telemetry Control Units(TCUs), Hyper SCADA Server(HSS), HT3 SCADA Software, and training services
currently utilized by Collier County.
DFS is responsible for the design, manufacture, and service of the entire TAC II SCADA System component
product line.There are no other manufacturers, dealers,distributors or service organizations that offer the
