EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve a
request from the Empowerment Alliance of Southwest Florida to grant preliminary acceptance of
the subdivision improvements within Hatchers Preserve subdivision and allow the installation of
the required landscape buffer to occur concurrently with Certificates of Occupancy for each
individual lot.
OBJECTIVE: To have the Board of County Commissioners (Board) approve a request by the
Empowerment Alliance of Southwest Florida to install a required landscape buffer within the
Hatchers Preserve subdivision as each home is completed.
CONSIDERATIONS: The developer of Hatchers Preserve subdivision has requested
`preliminary acceptance' of the subdivision improvements. The Engineering Services
Department conducts inspections of the required subdivision improvements to ensure that all of
the improvements meet County standards prior to the issuance of Certificates of Occupancy
within the subdivision. All of the improvements within Hatchers Preserve meet County
standards with the exception of the required landscape buffer. The Empowerment Alliance of
Southwest Florida is the developer of this subdivision and the subdivision has been constructed
through various State and County grants. The developer does not currently have funds to install
the entire landscape buffer and has requested the ability to install the buffer on each lot prior to
the issuance of a Certificate of Occupancy. The County has a performance security in place
which includes the cost of the landscape buffer. The phasing of required landscaping may
become more flexible in the future and this process will be discussed during the next Land
Development Code (LDC) revision cycle.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office,
is legally sufficient, and requires a majority vote for approval. - ERP
GROWTH MANAGEMENT IMPACT: The developer has received a Certificate of Adequate
Public Facilities prior to the issuance of the construction plan final approval letter.
RECOMMENDATIONS: To have the Board of County Commissioners endorse staffs
recommendation to approve the installation of the required landscape buffer within Hatchers
Preserve subdivision as each home is completed.
1. Retain the cost of the landscape buffer in the performance security.
2. Allow preliminary acceptance of the subdivision prior to the completion of the entire
landscape buffer.
3. Direct the County Manager or his designee to include the potential to phase landscape
buffering for review and consideration during the next LDC cycle.
