EXECUTIVE SUMMARY Recommendation to adopt a resolution accepting dedications in the plat of Brooks Village as recorded in Plat Book 49, pages 27 and 28. (Collier Boulevard Project No. 68056.) Estimated fiscal impact: $540 per annum. OBJECTIVE: To accept dedications to the County pursuant to the plat of Brooks Village. CONSIDERATIONS: On January 15, 2008, the plat of Brook Village was approved by the Board of County Commissioners ("Board") and subsequently recorded in Plat Book 49, pages 27 and 28. The plat dedicates to the County Tract "R-1" as future road right-of-way, with responsibility for maintenance. Collier Boulevard, Pine Ridge Road and 111`" Avenue SW roadway improvements have already been constructed within right-of-way easements burdening most of this 2.42 acre tract. However, the remaining area of this tract (approximately 0.523 acres) is needed for the six-laning of Collier Boulevard between Green and Golden Gate Boulevards (Project No. 68056). The plat also dedicates to the County certain drainage, lake maintenance, conservation and access easements with no responsibility for maintenance. The site-related improvements associated with the plat consist of a shopping center and have been constructed in accordance with the Land Development Code. The Engineering Services Department has conducted a satisfactory final inspection of the improvements. The attached resolution for acceptance of these plat dedications and responsibility for maintenance of Tract "R-l" is required under Section 10.02.04.B.5.1.i of the Land Development Code. FISCAL IMPACT: The estimated annual operating and maintenance cost of this new right-of- way will be $540.00 per annum while it remains unimproved. Source of funds is Gas Taxes. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office, is legally sufficient and requires a majority vote for approval. —ERP GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the County's Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners of Collier County adopt the attached resolution accepting the dedications in the Plat of Brooks Village as recorded in Plat Book 49, pages 27 and 28, and responsibility for maintenance of Tract "R-1"; and authorize the Chairwoman to execute same on behalf of the Board. RESOLUTION NO. 13- A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA FINALLY ACCEPTING THE PLAT DEDICATIONS GRANTED BY THE PLAT OF BROOKS VILLAGE, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 49,PAGES 27 AND 28. WHEREAS, on January 15, 2008, the Board of County Commissioners of Collier County, Florida approved the plat of Brooks Village for recording; and WHEREAS, Section 10.02.04 B.5.1.i of the Collier County Land Development Code requires the acceptance of plat dedications by Resolution; and WHEREAS, the County has development improvement plans which include Tract `R-1' according to the plat, which was dedicated to Collier County as future public road right-of-way with responsibility for maintenance; and WHEREAS, the plat also dedicates certain drainage, lake maintenance and conservation easements to Collier County,with no responsibility for maintenance. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the plat dedications according to the plat of Brooks Village as recorded in Plat Book 49,Pages 27 and 28, are fmally accepted. BE IT FURTHER RESOLVED AND ORDERED that the roadway and drainage improvements within Tract `R-1' will be constructed and maintained by Collier County as public road right-of-way.
