EXECUTIVE SUMMARY
Recommendation to reconsider retaining properties from active sales obtained from
Avatar Properties, Inc., that are part of the Golden Gate Estates Land Trust.
OBJECTIVE: To update the Board of County Commissioners, acting in their capacity as Trustee of
the Golden Gate Estates Land Trust (Trustee), through a recommendation made by the Golden Gate
Estates Land Trust Committee (Committee) regarding the reservation of certain lands obtained from
Avatar Properties, Inc.
CONSIDERATIONS; The Board of County Commissioners discussed this matter under Item 11 -L on
the December 11, 2012 agenda, at which time, the Board provided direction to revisit this item with
the Committee to determine whether parcels reserved by specific local government agencies, such as
the School Board and the Golden Gate Fire District, are still part of their master plans, and whether
those parcels should remain on the Trustee's Reserved List, or if those parcels should return to
general inventory.
Staff contacted _each agency and received letters stating that the reserved parcels are still of interest
and are part of their future plans; copies of the letters are' attached for reference.
At the Committee's meeting on January 28, 2013, and again at a Special Meeting held on February
28, 2013, this matter was discussed and, by a 3-0 vote, the Committee recommended the following:
1) to rename the Reserved List to the Future Sale List;
2) to require that all parcels on the Future Sale List be sold at 90% of the appraised value, as
required in the 1983 Agreement (appraisals are provided by an outside appraisal 'company and
are paid for by the purchaser);
3) to allow government agencies the right of first refusal to purchase any parcel prior to the parcel
being sold to the general public; and
4) to convey Unit 43, Tract 80 (5 acres) to Collier County, with no monetary consideration, for the
exclusive continued use by the Sheriff's Office. This location has been used as a gun range by the
Sheriff's Office since 1990. (If the recommendation is approved by the Board, staff will submit the
agreement at a future meeting.)
The rationale for the Future Sale List is to retain more desirable properties to be released for sale
once land values increase. The increase in land value will yield higher revenue for the Trust, therefore
benefitting the residents of Golden Gate Estates in that more funds will be available for desired
equipment, services, and infrastructure. All of these methodologies are consistent with the1983
Agreement.
The Committee's vote to offer each agency the right of first refusal to purchase any of the properties
on the Future Sale List is being suggested in order to offer local government agencies the option to
purchase a particular parcel for development, which in turn, would serve and benefit the residents of
Golden Gate Estates.

In order to provide a brief history from the previously submitted Executive Summary,. the following is
offered: The 1983 conveyance stipulated that the lands or the money derived from the sale of the
Trust Lands would be used by the Board for purposes directly beneficial to the residents of Golden
Gate Estates by providing facilities for existing and future residents of Golden Gate Estates, with all
capital improvements to be physically located within the geographical boundary of the area known as
Golden Gate Estates. Such facilities would include fire protection, police, public schools, libraries and
recreation: facilities, and equipment necessary for the operaiion�thereto., ,Nether the Trust Lands nor
the proceeds from the sale of any Trust, Lands shad be used for the purposes of acquisition,
construction or maintenance of roads, bridges, or s milar- projects.
Since the inception of the Golden Gate Estates Land Trust, 964.8 acres of the 1,061.50 ( + / -) acres
conveyed to the Trustee have been sold. In addition to the 5.0 acre tract being recommended to be
conveyed to the County for the SherifFs Office use' r' there are currently 8.93 acres available for
immediate sale. The remaining 82.31 acres are being reserved for future sane since the land values
have decreased substantially over the past several years. The difference in the conveyed acreage of
1,061.50 and the actual acreage of 1,061.04, being .46 acreage, accounts for the +/- (plus/minus)
factor.
Currently, the Land Trust Fund 605 has approximately $1,102,143.65 incash reserves that the
Trustee can make available to assist in providing services and /or equipment that is beneficial to the
residents of Golden Gate Estates. Recently, the Land Trust has funded an exterior sign for the Golden
Gate Estates Library and has funded a portion of the addition to the Louise_ Hasse Community Center
at the Max Hasse Park.
The remaining eighteen parcels, which include those previously reserved for other governmental
agencies as outlined in the Executive Summary dated December 12, 2012, will remain on the Future
Sale List and are as follows:

GROWTH MANAGEMENT IMPACT: This item has no impact on the Collier County Growth
Management Plan.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's
Office and is legally sufficient. This item requires a majority vote. ERP
RECOMMENDATION: That the Board of County. Commissioners, acting as Trustee, approves the
retention of lands as outlined above, accepts the Committee's recommendation that the Reserved List
be referred to as the Future Sale List; that all parcels be sold for 90% of appraised value at the time of
�. conveyance; that governmental agencies will be offered the first right of refusal prior to releasing any
property to the general public; to convey Unit 43, Tract 80 to Collier County for no monetary
consideration for the continued exclusive use by the Sheriffs Office; and that staff will update the
Board every five years, or sooner if deemed necessary, for review and approval of its remaining
inventory.

I am writing on behalf of the Golden Gate Fire Control and Rescue District (the District)
in response to the above- captioned letter from you regarding the District's need for and
future use of reserved GAC Lana Trust property, described as follows:
• Unit 78, Tract 116, East 75 feet of the West 180 feet (1.17 acres)
• Unit 78, Tract 116, East 75 feet of the East 150 feet (1.17 acres)
• Unit 93, Tract 48, West 105 feet of the West 180 feet (1.59 acres)
• Unit 93, Tract 48, East 75 feet of the west 180 feet (1.14 acres)
Please be advised that the above -fisted properties remain a part of the District's master
plan and are considered essential for the District's future use.
Also, please change your records to reflect that Donald Peterson is no longer the Fire
Chief for the District and has not been for the past five years.

in response to your letter dated January 10, 2013 regarding the reservation of certain GAC Land Trust Parcels
(the "GAC Parcels") for future School District use, we respectfully request that the Golden Gate Estates Land
Trust Committee continue to reserve the GAC Parcels for the benefit of the School District as set forth below.
Unit 7. All of Tract 81 (7.92 gacre4l — School District plans to utilize property for installation of
pedestrian/bicycle bridge to access future school sites and County park.
Unit go, All of Tract 2 (9.09 ..acres ) — School District pi ans to utilize property for installation of
pedestrian/ bicycle bridge to access future school sites and County park.
Unit 196. All of Tract 185 (4.77 acres) — School District plans to utilize property for land assembly as basis for
future educational facility.
As the County has not reached it full development potential, we anticipate future growth in the public schools.
The maintenance of a land inventory for future school sites and related infrastructure is necessary in a State with a
