EXECUTIVE SUMMARY Recommendation to create two new projects within the Court Facilities Fees Capital Fund 181, for Court approved projects for improvements to the Courthouse and authorize budget amendments in the amount of$425,000. OBJECTIVE: To obtain approval of the creation of two new, Court-approved projects within Fund 181, Court Facilities Fees, for improvements to the Courthouse and the budget amendments necessary to complete those projects. CONSIDERATIONS: Fund 181, Court Facilities Fees, is supported by revenues generated by court activities as provided in both Florida Law (F.S. 318.18(13)) and Collier County Ordinance No. 2009-41. Funds collected pursuant to these sections must be used to support State court facilities, and expended as provided by the Board of County Commissioners in consultation with the Chief Judge of the Twentieth Judicial Circuit. In a December 19, 2012, letter to Chief Judge Jay B.Rosman(Attachment A),the County Manager, upon the advisement of the Court Administrator, requested two Courthouse projects and Chief Judge Rosman approved the request in a letter dated January, 2013 (Attachment B). The two(2)proposed new,Court-approved projects for improvements to the Courthouse are: (1) Replacement of the antiquated courtroom lighting and dimmer system, which includes panels, switches, and components including upgrading the controls. Currently the system has no available replacement parts and has been failing on a regular basis. Current lighting controls have been piecemealed from adjacent courtrooms and are not sustainable. Cost for this project is estimated at$115,000, and (2) The installation of a new electronic evidence presentation system, which includes two podiums, equipment, cabling, power, and audio/video connections to allow the use of electronic display of documents. This will include all associated courtroom re-wiring, raised floors,and carpeting. This project will utilize a network-based system and provides the ability to integrate the current(Court-Smart) and future technologies. The cost of the project is estimated at$310,000. Two budget amendments in the amounts of$115,000 and $310,000 are necessary to complete the two proposed projects. FISCAL IMPACT: A budget amendment is required to move $115,000 into the Replace Lighting System Project 50094 and $310,000 into the Courthouse Technology Improvements Project 50095. The source of funds is the Court Facilities Fees,Fund 181 with a total impact of$425,000. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office,is legally sufficient for Board action and only requires a majority vote for approval—SRT. This surcharge is in addition to any penalties imposed for non- criminal traffic infraction pursuant to Chapter 318,Florida Statues,or imposed for criminal violations listed in F.S. 318.17.The ordinance further stipulates that(b)the Court shall order payments of this surcharge in all matters subject to this section.The court shall not waive this surcharge and(c)the funds collected pursuant to this section shall be used to fund state court facilities.Funds collected pursuant to this section shall be expended as provided by the Board of County Commissioners in consultation with the Chief Judge.
