EXECUTIVE SUMMARY Recommendation that the Community Redevelopment Agency (CRA)review and discuss a letter dated March 5, 2013 from Bayshore Cultural and Performing Art Center (CAPA) and provide guidance. OBJECTIVE: To obtain guidance from the Community Redevelopment Agency regarding Bayshore CAPA's inquiry letter dated March 5,2013. CONSIDERATION: In 2006, as part the Bayshore/Gateway Triangle Redevelopment Plan the CRA purchased 17.27 acres of property comprising 15.46 acres of mobile home zoned land and 1.81 acres of commercial zoned land. In 2008, to eliminate unhealthful, unsanitary conditions, the CRA purchased an adjacent commercial property. In June, 2012 the site was successfully rezoned to Mixed Use Planned Development (MPUD) that includes a maximum of 40 residential units, 48,575 square feet of commercial and retail uses, a 350 seat cultural and/or performing arts facility, 84,000 square feet of parking garage, green space, gardens and a boardwalk connection to Sugden Park. CAPA has a desire to develop a performing arts facility on the site. The facility would serve as a catalyst site for the Bayshore area. CAPA wants to make an offer to purchase the site and is seeking support and guidance on how to proceed with County staff. FISCAL IMPACT: None LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, and raises no legal issues at this time. Any direction by the Board requires majority vote -JAK. GROWTH MANAGEMENT: There is no impact on the County's long-range planning effort. Commissioner Donna Fiala, Chair Commissioner Fiala, As you know,Bayshore Cultural and Performing Arts(CAPA),has had a long-standing interest in the BGTCRA's 18+acres. This began with the CRA's inviting CAPA to participate in community-level studies defining the need for a new facility to provide much needed,multi-use space to Collier County's performing and visual artists and arts organizations. CAPA,a 501(c)(3)not-for-profit organization,has been earnestly pursuing a mission since 2008 to make this happen in the Bayshore area with the CRA property as the main focus. With the benefit of our extensive consultant-driven studies,we have completed a facilities plan that comprises defined space requirements, a pro-forma operations/governance plan,and a capital cost plan coupled with an implementation plan and schedule. An architect selection committee has been formed,so,at this point CAPA is ready to move into its major capital funding campaign,with an essentially"shovel ready"project. Our idea of a lease arrangement with the CRA has met with disinterest from a majority of the Commissioners. CAPA has determined that a plan to purchase the 18+ acres may be a more Assic effective way to move forward. Toward that end,we ask that the CRA Governing Board under your leadership help initiate the process for CAPA to make an offer for the property. For such an offer to be viable, it needs to have the following elements: 1) The price for the property must be fair based on the current appraised value. 2) CAPA would want a commitment from the County to help expedite adjustments to the present zoning to enable the CAPA facility plan to be implemented on the site in a timely fashion. 3) The designated Arts and Cultural District which encompasses the site needs to be supported by appropriate County actions to keep the CRA activity and administration intact. We believe these sales transaction elements represent a way forward for the County in its concerns about the CRA indebtedness while giving CAPA an opportunity to better focus its fund raising. We,of course,welcome the opportunity to discuss this with the BCC acting as the CRA Board.
