EXECUTIVE SUMMARY
Recommendation to authorize Emergency Medical Services (EMS) to purchase required
medications off - contract (ITB 409 -5217) due to vendor drug shortages and volatile pricing
in the market and further authorize Staff to conduct a modified two quote solicitation
process to secure the required medications.
OBJECTIVE: That the Board of County Commissioners authorizes staff to purchase required
medications off - contract when the required medication is not available at the contracted price or
the vendor is not able to provide the required medication.
CONSIDERATIONS: On June 9, 2009 (Item 16F3), the Board of County Commissioners
approved the award of Invitation to Bid 409 -5217 for the purchase of emergency medications for
the County Emergency Medical Services to five vendors: Henry Schein Matrix Medical,
Kentron Health Care, Midwest Medical Supply Company, Bound Tree Medical and Alliance
Medical dba Allmed. Over the past few years, a number of merges in the market have occurred,
and the County is now in contract (based on ITB 409 -5217) with only two (2) vendors out of the
original five (5). This bid award is set to expire in June 2013, and County staff is working on a
new solicitation.
Over the course of the past year, health care providers throughout the country, including EMS,
have been adversely affected by the nationwide drug shortages due to manufacturers' reduced
production and rapid price increases for the medications that are carried on emergency transport
vehicles. In some examples, the County is still able to get the required medications at the agreed
to contract price. However, in other cases, the contracted vendors have failed or refused to
provide certain required medications at the current contract price or there is a delay in critical
supply deliveries due to these market conditions. EMS has attempted to compensate for these
shortages by changing protocols or substituting the forms of the necessary medications.
Attached to this Executive Summary is a list of the required medications which are currently
utilized by EMS, any one of which might be affected by this volatile marketplace.
In order for EMS to maintain customary protocols and to act quickly in this volatile market, Staff
is requesting Board authorization to purchase required medications off - contract when the vendor
cannot honor the contract price or when the vendor cannot provide the required medication.
Staff further requests authorization to conduct a modified quote process (two quotes rather than
three) for these drugs until a new contract can be secured which addresses the medications. This
modified quote process will include staff securing two documented telephone quotes prior to
requisitioning a purchase order. These quotes will be reviewed by Purchasing staff prior to the
issuance of a purchase order. All other line items when available will be purchased with a
purchase order using ITB #09 -5217.
FISCAL IMPACT: It is impossible to determine the exact fiscal impact due to the current
volatility of the market; however, the annual cost of medicine and drug purchases within the
EMS Fund (490) is $70,000.

LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office.
ITB #09 -5217 provides: "In the event circumstances arise in which the Contractor is unable to
supply the required goods and /or services within the County's needs, Contractor shall advise the
Purchasing Director in writing of the circumstance and duration. The County may select an
alternate supplier to provide required goods and /or services until such time that the Contractor is
again able to supply these requirements." Pursuant to the language in the ITB, the County may
seek alternate vendors when necessary. Further, pursuant to the County's Purchasing Policy,
Section VA (4), the Board may waive formal competition where it is determined to be in the best
interest of the County to do so. This item is legally sufficient for Board action and requires
majority vote for approval. — CMG
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting
from this action.
RECOMMENDATION: That the Board of County Commissioners authorizes Emergency
Medical Services (EMS) to purchase required medications off - contract (ITB 409 -5217) when
necessary due to vendor supply shortages and /or volatile pricing in the market and further
authorize Staff to conduct a modified quote process to secure the required medications.
