Resolution to hold a public hearing to consider vacating a portion of a 15 -foot wide Drainage
Easement, being a part of Lots 77 and 78, Quail West Phase III, Unit 7, Plat Book 46, pages 89
through 102 of the Public Records of Collier County, Florida. Application No. VAC -
PL20120002668.
OBJECTIVE: Pursuant to Section 177.101, Florida Statutes, and Resolution 2006 -160, the
Board of County Commissioners must authorize a public hearing to consider the vacation of a
portion of any recorded subdivision plat.
CONSIDERATIONS: The Engineering Services Department has received a request from
Alexis Crespo of Waldrop Engineering, P.A., as Agent for the property owner. This request is to
vacate a portion of a 15 -foot wide Drainage Easement between Lots 77 and 78 and relocating the
Drainage Easement to the south side of Lot 77, Quail West Phase III, Unit 7, Plat Book 46, pages
89 through 102 of the Public Records of Collier County, Florida. A copy of the relocated
Drainage Easement is attached.
The hearing will be advertised in a local paper of general circulation pursuant to Section 336. 10,
Florida Statutes, and Resolution 2006 -160, and the adjoining property owners will be given
notice as well. The proposed replacement drainage easement will be approved for recording at
the public hearing.
FISCAL IMPACT: The application fee of $2,100.00 covers staff review and processing.
The applicant is also responsible for advertising fees.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's
Office, is legally sufficient and requires a majority vote for approval. - ERP
RECOMMENDATION: Recommendation that the Board of County Commissioners
endorse staff's recommendation to schedule a public hearing to consider vacating a portion of
a 15 -foot wide Drainage Easement, being a part of Lots 77 and 78, Quail West Phase III, Unit
7, Plat Book 46, pages 89 through 102 of the Public Records of Collier County, Florida.

SPECIFICALLY SHOWN IN EXHIBIT "A".
WHEREAS, Petitioner, Alexis Crespo, of Waldrop Engineering P.A, as Agent for the
property owner, has requested that a public hearing be held pursuant to Section 177.101, Florida
Statutes, and Resolution 2006 -160, to consider disclaiming, renouncing, and vacating the County
and Public interest in a portion of a 15 -foot wide Drainage Easement, being a part of Lots 77 and

Collier County, Florida, more specifically described in Exhibit ` °A" attached hereto; and
WHEREAS, Petitioner does hereby request that the Board of County Commissioners

:hearing to consider disclaiming, renouncing, and vacating the County's interest in the above
described'` Easement.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that pursuant to Section 177.101,
Florida Statutes,. and Resolution 2006 -160, in a regular session of the Board of County
Commissioners, a public hearing to consider disclaiming, renouncing and vacating the County's
interest in the above described Easement will be held on the 26h day of March, 2013 at 9:00
a.m., or as soon thereafter as practical, in the Boardroom, 3rd Floor, Administration Building,
Collier County Government Center, 3299 Tarniami Trail East, Naples, Florida..

DRAINAGE EASEMENT
THIS DRAINAGE EASEMENT is granted and conveyed this c q "day of C"'l IJ I
2013, by QUAIL WEST HOLDINGS, LLC, a Florida limited liability compag/y, which has a
mailing address of 2647 Professional Circle, Suite 1201, Naples, FL 34119, (hereinafter referred
to as "Grantor ") to the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY, AND AS THE EX-
OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT,
its successors and/or assigns, which has a mailing address of 3299 East Tamiami Trail, Naples,
FL 34112, (hereinafter referred to as "Grantee ").
Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this

This is not homestead property.
TO HAVE AND TO HOLD the same unto the Grantee, its successors and /or assigns, together
with the right and privilege to enter upon said land to excavate, relocate and /or take and /or
introduce materials, including but not limited to, water lines and pipes, well pumps and raw water
wells, and other equipment or improvements appurtenant thereto or thereunder for the purpose of
constructing, reconstructing, operating, relocating, repairing and /or otherwise maintaining the
subject drainage facilities and /or systems(s) or portion(s) thereof, in, on over and /or under the
easement area. The easement area granted herein shall constitute easements running with the
