Roll Call/Attendance: Chairman Sharon Kenny called the meeting to order at 9:18 A.M. Roll Call was taken and a quorum established. 2. Addenda to the Agenda: Under 6 B. New Business - Add Discussion on the Captain Horr House at Key Marco, which is on the National Historic Register. 3. Approval of Agenda: Craig Woodward moved to approve the Agenda, including the Addenda to the agenda item. Second by Eugene Erjavec. Carried unanimously, 4-0. 4. Approval of Minutes: October 18, 2017 Eileen Arsenault moved to approve the minutes of October 18, 2017. Second by Craig Woodward. Carried unanimously, 4-0. 5. Old Business: A. Pavilion Lake PDI Update Ray Bellows explained that Fred Reischl was working on the petition for part of a preserve area to be used as an expansion of the parking lot to allow for ease of access. The issue was now in the re-submittal stage. Fred Reischl stated that to date, the re-submittal had not been received. B. Otter Mound Update Ray Bellows noted the presentation by Alexandra Sulecki of Conservation Collier at the October 18, 2017 HAPB meeting. She had spoken about ground disturbances caused by Hurricane Irma producing shell and pottery shards. Eugene Erjavec reported the salvage and recovery process had begun; however, the area was heavily disturbed with exposed pottery shards (some decorated), pierced arc shells and bone fragments. He stated he had worked on a City sewer project in that area which turned up many similar objects and many, as yet, unnamed objects. Craig Woodward noted the publishing of that information had brought out complaints from the Indian group known as the Independents, who were making claims on the found artifacts. The issue of collecting, identifying and housing of findings had not yet been determined. Eugene Erjavec responded that most of what had been found was what usually has been found in the area; and, the Historical Society and Museum already have several samples. He has conducted many excavations in the past in that area. He suggested documenting and photographing what was found; but, collecting of samples should not be necessary. Ray Bellows stated further monitoring could be scheduled if necessary. 23.A.4 Packet Pg. 202 Attachment: Complete Packet Materials 1.17.18 HAPB (4790 : Historical Archeological Preservation Board - January 17, 2018) November 15, 2017 3 Stuart Miller arrived at 9:25 a.m. C. Horse Creek Estates Historic Marker Update Ray Bellows announced that, Lisa Marciano, was working with the Museum Director to have a new marker installed. He stated that the property owners at Horse Creek Estates do not want to pursue Historic Designation. He asked if the HAPB still wanted to pursue the Historic Designation since part of the area is a portion of the original Tamiami Trail. Ray explained the HAPB had pursued Historical Designation when the developer was in control of the property. However, the Horse Creek Estates Homeowner Association was now in control. To the best of his knowledge, they were not in favor of pursuing Historic Designation. It was the consensus of the HAPB to leave the item on the Agenda until the marker is in place; and, recheck that the HOA has been apprised of the Historical Designation benefit and process. Staff will follow up. 6. New Business: A. Election of Officers After a brief discussion, the following action was taken: Craig Woodward moved to nominate Eugene Erjavec for Chairman. Second by Eileen Arsenault. Motion approved 5-0. Sharon Kenny moved to nominated Eileen Arsenault as Vice-Chairman. Second by Craig Woodward. Motion approved, 5-0. Sharon Kenny handed over the chairmanship to Eugene Erjavec, who conducted the rest of the meeting. B. Discussion re: Captain Horr House, Key Marco Ray Bellows announced he had received an e-mail from Charlie Strader, Southwest Florida Archeological Society, who had spoken to the Property Manager for Key Marco. Mr. Strader inspected and helped shore up portions of the window lintel to prevent further damage to the wall, caused by Hurricane Irma. Mr. Strader had included copies of photos of the damage. His advice to the Property Manager was to shore up the wall as an immediate fix and to acquire a Certificate of Appropriateness from HAPB to make more permanent repairs to the structure. Ray explained the structure was previously designated Historical and was on the National Historical Register; before the City of Marco Island was created. The property surrounding the parcel is now Key Marco, a homeowner’s association of individual single family homes. Eugene Erjavec provided background information on the property, citing the fact that damage to the structure had accelerated over the past several years. He had visited the site since Hurricane Irma and he suggested documenting the damage before any repairs and do a short term fix by shoring up the wall. He had documented what he’d found after the storm for the Museum. He 23.A.4 Packet Pg. 203 Attachment: Complete Packet Materials 1.17.18 HAPB (4790 : Historical Archeological Preservation Board - January 17, 2018) November 15, 2017 4 cited the threat to the structure collapsing and the fill that would be needed to support the wall from collapsing due to erosion. He spoke on the history of the tabby construction and the fact that Capt. Horr was the first postmaster; also, was a U.S. Marshal from Tallahassee to Key West after the Civil War. In all, he noted, the property had severely suffered from neglect, which he felt was too deteriorated to save. Craig Woodward read from the e-mail Mr. Strader had sent to the Property Manager and concluded the HAPB should support the effort to repair and save what was left of the property; especially since its Historical Designation was supported by the HAPB. He asked if the HAPB could approve a Certificate of Appropriateness. Ray Bellows stated they could have, prior to Marco Island becoming a City. Once again, without an Interlocal Agreement, Collier County, and in turn, the HAPB have no authority. Therefore, there was no technical requirement to get permission from the HAPB. Following a brief discussion, Craig Woodward suggested that regardless of the HAPB’s lack of jurisdiction, they still have an opinion. He suggested they send a letter or e-mail to Mr. Strader and the Key Marco Property Manager stating the HAPB strongly supports the temporary shoring up of the structure as suggested by Mr. Strader; and, moving forward to investigate a permanent solution to preserve this Historic site. Also, stating that the HAPB would help in any way that they are able. Copies of the letter would also be sent to the City of Marco and to Dan Smith. After comment and discussion, Chairman Eugene Erjavec called for a motion. Craig Woodward moved to have a letter sent to the Property Manager at Key Marco and to Charlie Strader as well as copies to the City of Marco Island and Dan Smith. The letter is to state the HAPB ‘s strong support of temporary measures to shore up the structure at Capt. Horr House and to move forward investigating a permanent solution to preserve the Historic site. Also stating the HAPB’s offer to help in any way they are able. Second by Eileen Arsenault. Carried unanimously, 5-0. Craig Woodward suggested Dan Smith and Chad be invited to the next HAPB meeting. Eugene Erjavec spoke about the upgrading of the probability maps and overlay maps. He has worked with them on several areas. To his knowledge, funds were available. Eileen Arsenault suggested holding a HAPB meeting on Marco Island since many of the Board’s topics involve Marco Island. Ray Bellows will check with Dan Smith and Chad to coordinate dates. The January HAPB meeting will be the target date. 7. Review of Project and Activity Log –Postponed 8. HAPB Comments: Stuart Miller announced he would be speaking at the Depot Museum on Wednesday, December 6. He will be talking about the HAPB, its function and some of the projects they have worked on, as well as some of their current projects. Fred Reischl noted that both Stuart Miller and Elizabeth (Betsy) Perdichizzi would be speaking at the Depot Museum. However they needed to be mindful of the Sunshine Law provision that no discussion of HAPB topics could be discussed with each other. Eileen Arsenault commented on a message she had received asking how she preferred to receive notices –by mail or electronically. She preferred E-mail. The rest of the HAPB stated they also preferred E-mail. Eileen Arsenault moved to receive the HAPB meeting packet as well as the Minutes of meetings by E-mail. Second by Craig Woodward. Carried unanimously, 5-0. Craig Woodward thanked Eugene Erjavec and Eileen Arsenault for accepting Chairman and Vice Chairman positions. Eugene Erjavec announced a Historical Society event- an Appraisal Fair by the Antique Road Show will be coming to Marco Island on the weekend of March 3. It will be open to the public to bring items for appraisals. The Marco Island Historical Society Gala will occur that same evening. Craig Woodward moved to forego the December HAPB meeting. The subject property consists of ± 1.9 acres located at the northeast corner of the intersection of School Drive and Delaware Avenue East. a. Describe how the project is consistent with the Collier County Land Development Code and Growth Management Plan. Include information on how the request is consistent with the applicable section or portions of the Future Land Use Element. Response: The RMF-6 District permits churches as a Conditional Use. The application and proposed master plan identifies all the required elements for a conditional use, as required by the LDC. b. Describe the existing or planned means of ingress and egress to the property and proposed structure thereon with particular reference to automotive and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. Response: The means of ingress and egress to the property are currently proposed along Delaware Avenue East. Weekday vehicular and pedestrian traffic control/access shall likely remain the same with the proposed land use being sought. c. Describe the effect the conditional use will have on neighboring properties in relation to noise, glare, economic impact, and odor. Response: The proposed church will have a minimal effect on neighboring properties most days of the week. The majority of traffic/trips are proposed during worship services on Tuesday and Saturday evenings at 7:30p.m. and again on Sunday afternoons at 4:00p.m. Landscape buffers and water management areas adjacent to existing residential land uses/zoning will be utilized to reduce any potential for noise or glare. d. Describe the site’s and the proposed use’s compatibility with adjacent properties and other properties in the district. Response: The subject property is bordered to the north, east, south and west by single-family and mobile home residential land uses and zoning; adjacent to and, opposite existing right-of-ways. School Drive and Delaware Avenue East both directly border the subject property. The RMF-6 District permits Churches as a Conditional Use. Although the property could be developed with a variety of residential uses, its location at an intersection, the church’s membership being local to the area and its mission to provide a place of worship to the existing community make the property uniquely suited for the development of a church. Please provide any additional information which you may feel is relevant to this request. Response: The subject property is currently owned by the applicant, and members of the existing Church are all local to the region. Upon the successful completion of the conditional use application, the proposed church will be found consistent and permitted per the requirements of the LDC and its design and development standards. Future Land Use Element Provisions Policy 5.4: New developments shall be compatible with, and complementary to, the surrounding land uses, as set forth in the Land Development Code (Ordinance 04-41, adopted June 22, 2004 and effective October 18, 2004, as amended). The RMF-6 District permits churches as a Conditional Use. The application and proposed master plan identifies all the required elements for a conditional use, as required by the LDC. Policy 7.1 The County shall encourage developers and property owners to connect their properties to fronting collector and arterial roads, except where no such connection can be made without violating intersection spacing requirements of the Land Development Code. The means of ingress and egress to the property are currently proposed at Delaware Avenue East. Policy 7.2 The County shall encourage internal accesses or loop roads in an effort to help reduce vehicle congestion on nearby collector and arterial roads and minimize the need for traffic signals. An internal access loop roadway is not possible for this small of a site. The applicant has, however, planned for internal circulation provided within the design of the master concept plan. Policy 7.3 All new and existing developments shall be encouraged to connect their local streets and their interconnection points with adjoining neighborhoods or other developments regardless of land use type. Interconnections to adjoining parcels are not feasible to the east, because the surrounding Mobile Home zoned parcel(s) are all developed.
