EXECUTIVE SUMMARY
Recommendation to approve the conveyance of water and wastewater utilities located at MarGood
Harbor Park, 321 Pear Tree Avenue, Goodland Florida, and to approve the execution of the
conveyance documents, at a cost not to exceed $120.
OBJECTIVE: To convey: 1) water utilities to the Collier County Water -Sewer District (CCWSD); 2) the
wastewater utilities to the City of Marco Island (Marco); and 3) a Utility Easement to the City of Marco
Island for the purpose of operating and maintaining the wastewater utilities being conveyed.
CONSIDERATIONS: On May 10, 2011, under Agenda Item #10A, the Board of County
Commissioners approved the award of ITB #11 -5652 for the construction of the improvements at
Margood Harbor Park, Project #80024.1. The project has .now been completed. CCWSD is currently
providing the water and Marco is currently providing wastewater utility services in the area and will be
providing the additional water and wastewater utility services to the newly installed facilities at MarGood
Harbor Park. As a condition to providing these additional services, the potable water and fire line
facilities constructed by the County and running from the water main within the existing right -of -way to
the water meter for the park shall be conveyed to the CCWSD for future services and maintenance of the
infrastructure as specified on the exhibit attached to the Utility Facility Warranty Deed and Bill of Sale to
the CCWSD. The wastewater infrastructure installed within the existing right -of -way to the lift station
shall be conveyed to Marco for future services and maintenance of the infrastructure as specified on the
exhibit attached to the Bill of Sale to Marco. In addition, Marco has requested a Utility Easement over
the existing right -of -way to provide for their access in the event that maintenance is required.
A location map is attached for reference.
The attached Utility Facility Warranty Deed and Bill of Sale, Bill of Sale and Utility Easement have been
reviewed and approved by the County Attorney's Office.
FISCAL IMPACT: The total costs for recording the required documents and obtaining necessary
certified copies will not exceed $120. Funds in the amount of $120 are available in the budget under
Project 80024.1. The County will also be responsible for future related utility charges.
LEGAL CONSIDERATIONS: The Utility Facility Warranty Deed and Bill of Sale to the CCWSD, and
the Bill of Sale and Utility Easement to Marco have been reviewed and approved for form and legal
sufficiency by the County Attorney's Office. The Bill of Sale and Utility Easement documents used have
been conceptually approved by Marco. This item requires a majority vote for approval. - ERP
GROWTH MANAGEMENT IMPACT: Margood Harbor Park is inventoried in the Collier County
Growth Management Plan. The conveyance of these facilities is consistent with the Growth
Management Plan.
RECOMMENDATION: That the Board approves the conveyance of the water utilities to CCWSD and
the wastewater utilities to Marco and authorizes the Chairwoman to execute the aforementioned
documents; and also for the Board to direct the County Manager or his designee to proceed to follow all
appropriate closing procedures and to record the aforementioned documents in the Public Records of
Collier County, Florida.

system(s) or portion(s) thereof, be they realty, personalty, or mixed, and Grantor will
defend such title against all claims of all persons whomsoever. For the purposes of this
conveyance, the utility facilities, system(s) and/or portion(s) thereof conveyed herein 'r
shall not be deemed to convey any of the lands described in either exhibit. Grantor
and Grantee are used for singular or plural, as context allows.
TO HAVE AND TO HOLD the some unto the Grantee and its assigns, together with .
the right to enter upon said land, excavate, relocate and /or take or introduce materials
