2/12/2013 10.D. EXECUTIVE SUMMARY Recommendation to adopt a Resolution in support of removing the ban on spearfishing in. Collier County coastal waters, and requesting that the Florida Fish and Wildlife Conservation Commission (FWC) repeal the special acts and/or rules designated as Chapters 27473 (1951) and 30665 (1955). OBJECTIVE: To allow spearfishing in Collier County waters in the Gulf of Mexico. CONSIDERATIONS: In 1951 Chapter 27473 was enacted by the Florida Legislature, which prohibited the use of artificial light when spearing or gigging saltwater fish in Collier County. In 1955 county residents petitioned the Board of County Commissioners to completely ban spearfishing in Collier County waters. After public hearing on the issue the Board passed several. resolutions in 1955 and 1956 which first restricted and then banned all saltwater spear fishing. A referendum on the matter was held in November 1956, and Collier County voters approved the ban by a vote of 1,196 in favor of the ban to 590 opposed. Upon this vote Chapter 30665 became law, prohibiting spearfishing in all Collier County waters. In 1983 the Legislature passed Chapter 83-134, which repealed the above Special Acts as law, converting them into regulations of the Marine Fisheries Commission, and still in effect under the Florida Fish and Wildlife Conservation Commission(FWC). Additionally the ban is codified in Ch. 379.2425,Fla. Stat. Today, spearfishing is allowed in most of the state and is regulated by the FWC, except in Collier County and in portions of Monroe County where is it prohibited. Fishermen who harvest by spearing are subject to the same rules and limitations that other anglers in the state are required to follow. The FWC defines spearfishing as "the catching or taking of a fish through the instrumentality of a hand or mechanically propelled, single or multi-pronged spear or lance, barbed or barbless, operated by a person swimming at or below the surface of the water." The following prohibitions are imposed by the FWC: • Spear-fishing of marine and freshwater species in freshwater is prohibited. Possession of a spear gun in or on freshwater is also prohibited. • Within 100 yards of a public swimming beach, any commercial or public fishing pier, or any part of a bridge from which public fishing is allowed. • Within 100 feet of any part of a jetty that is above the surface of the sea - except for the last 500 yards of a jetty that extends more than 1,500 yards from the shoreline. • In Collier County (currently) and in Monroe County from Long Key north to the Dade County line. • For any fish for which spearing is expressly prohibited by law(listed below). • In any body of water under the jurisdiction of the Dept. of Environmental Protection, Division of Recreation and Parks (Florida Parks Service). Possession of spearfishing equipment is prohibited in these areas, unless it is unloaded and properly stored. The following is a list of species that are prohibited for harvest by spearing: • Billfish (all species) • Spotted eagle ray • Sturgeon • Manta ray Packet Page-62- 2/12/2013 10.D. • Sharks • Bonefish • Tarpon • Goliath Grouper • Snook • Blue Crab • Nassau grouper • Spotted seatrout • Red drum • Weakfish • Stone Crab • Pompano • African pompano • Permit • Tripletail • Lobster • Families of ornamental reef fish(surgeonfish,trumpetfish, angelfish, butterflyfish, porcupinefish, cornetfish, squirrelfish,trunkfish, damselfish, parrotfish,pipefish, seahorse, puffers,triggerfish except gray and ocean) As reported in a January 13, 2013 article in the Naples Daily News, lionfish have been found in Collier County waters. Lionfish, an invasive non-native species which have no natural predators in this area, will destroy native fish on our reefs in the Gulf. Harvesting by spearfish has been shown to be the most efficient and effective means of control. Therefore it is in the public's best interest that the antiquated ban on spearfishing be lifted as to Collier County waters, as it already has been throughout almost all of Florida. The method to accomplish this is to request that the FWC repeal the special acts and/or rules designated as Chapters 27473 (1951) and 30665 (1955). FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: None. LE GAL CONSIDERATIONS: The proposed Resolution was drafted by the County Attorney, is legally sufficient, and requires majority support for approval. -JAK RECOMMENDATION: That the Board of County Commissioners adopt a Resolution in support of removing the ban on spearfishing in Collier County coastal waters, and request that the FWC repeal the special acts and/or rules designated as Chapters 27473 (1951) and 30665 (1955). An act to prohibit spearing or gigging fish by the use or aid of any artificial light in any of the salt waters of Collier County, Florida. Providing penalty for violations. Section 1. It shall be unlawful to spear or gig fish by the use or aid of any artificial light in any of the salt waters of Collier County,Florida. Section 2. Any one or more persons violating the provisions of this act shall be guilty of a misdemeanor, and upon conviction, fined not exceeding $200.00, or imprisonment in the county jail not more than 60 days, or both so fined and imprisoned in the discretion of the court. A diligent search of the BCC minutes from 1950 and 1951 was conducted by the Clerk to the Board's staff and by me, but we were unable to locate any references to this act nor anything to indicate why it was passed. In April 1955,the following Special Act was filed with the Secretary of State: CH.30665(1955). An act to prohibit spear fishing in all of the waters of Collier County, Florida; providing penalty for violations; providing for referendum at next general election. Section 1. It shall be unlawful to take or attempt to take fish in any and all waters of Collier County, Florida,by means of a spear,gig,or similar device. Section 2. Any person violating the provisions of this act shall be guilty of a misdemeanor,and upon conviction subject to the penalty provided by law. Section 3. This act shall not become effective until the question has been voted upon by the qualified electors of the county and ratified by a majority of those voting on the question,which shall be placed on the regular election ballot at the next general election. 1 Packet Page-67- 2/12/2013 10.D. Should a majority of the qualified electors voting on the question vote"yes",then this act shall become effective immediately. Should the majority of qualified electors voting on the question vote"no",this act shall be void. In June 1955 a group of commercial fishermen requested the Board to pass a prohibition of spearfishing in Collier County. A public hearing was called on the issue, and held on July 5, 1955. The minutes of that meeting (attached) reflect that a petition signed by 303 county residents was presented to the Board asking for a ban on spearfishing. Those speaking in favor of the ban cited concerns of the negative impact spearfishing was having on commercial fishing, fishing guides, and tourism. Residents speaking in favor of spearfishing stated that the sport should be allowed, and possibly regulated. Upon hearing from both sides of the issue the Board tabled the matter for further study. On August 16, 1955, the Board passed a resolution asking the Salt Water Conservation Department of the State of Florida to ban spearfishing within 1000 feet of the mouth of all Collier County rivers and inland waterways, and set licensing requirements. The full text of the resolution is contained in the minutes from this date. On April 3, 1956 the Board approved the drafting of a resolution that would ban gigging, spearing, and the use of bow and arrow along the canals. On May 1, 1956, the Board passed a resolution requesting that the State ban the taking of all salt water fish in Collier County by said means. The full text of the resolution is contained in the minutes from this date. • On September 4, 1956, the Board discussed Chapter 30665 (cited in full above), and directed that the act be advertised and a referendum placed on the ballot in the upcoming general election. In November 1956 Collier County voters approved the spearfishing ban as stated in Chapter 30665 by a vote of 1,196 in favor to 590 against, more than a 2 to 1 margin. Upon this vote the Special Act became law. In 1983 the Legislature passed Chapter 83-134 (attached), which repealed the above Special Acts as law, converting them into regulations of the Marine Fisheries Commission, and still in effect under the Florida Fish and Wildlife Conservation Commission (FWC). The Florida Senate 2012 Florida Statutes TITLE XXVIII CHAPTER 379 NATURAL RESOURCES; FISH AND VIEW ENTIRE CHAPTER CONSERVATION, WILDLIFE RECLAMATION,AND USE CONSERVATION 1379.2425 Spearfishing;definition;limitations;penalty.- (1) For the purposes of this section,"spearfishing"means the taking of any saltwater fish through the instrumentality of a spear, gig,or lance operated by a person swimming at or below the surface of the water. • (2)(a) Spearfishing is prohibited within the boundaries of the John Pennekamp Coral Reef State Park, the waters of Collier County, and the area in Monroe County known as Upper Keys,which includes all salt waters under the jurisdiction of the Fish and Wildlife Conservation Commission beginning at the county line between Miami-Dade and Monroe Counties and running south,including all of the keys down to and including Long Key. (b) For the purposes of this subsection,the possession in the water of a spear,gig,or lance by a person swimming at or below the surface of the water in a prohibited area is prima facie evidence of a violation of the provisions of this subsection regarding spearfishing. (3) The Fish and Wildlife Conservation Commission shall have the power .o establish restricted areas when it is determined that safety hazards exist or when needs are determined by biological findings.Restricted areas shall be established only after an investigation has been conducted and upon application by the governing body of the county or municipality in which the restricted areas are to be located and one publication in a local newspaper of general circulation in said county or municipality in addition to any other notice required by law. History of Invasion / Ecological Threat: Lionfish (Pterois volitans) were introduced to the coastal waters of southern Florida more than 25 years ago. Since that time,lionfish have spread throughout the Caribbean and are now invading the Gulf of Mexico. Marine biologists are concerned that lionfish will significantly alter the population dynamics of our native marine species resulting in further impacts to the health of Florida's reefs. Harvesting by spear and hand held dip net has proven to be the most efficient and effective means of control.Divers are safely and efficiently harvesting significant numbers of lionfish with small,lightweight pole spears. Dive safety always comes first, and care should be used to avoid damaging reefs when targeting lionfish. Food Quality / Handling: Lionfish are commonly eaten and comparable in texture and taste to hogfish or black sea bass.Many harvesters who choose to clean lionfish prefer to clip off the venomous fin rays prior to cutting fillets as a safety precaution.Even fish that have been on ice for many hours can cause painful injuries.Treat stings by immersing wound in hot (not scalding) water for 30 to 90 minutes and seek medical attention as soon as possible.Handle lionfish carefully!
