1/22/2013 Item 16.E6. EXECUTIVE SUMMARY Recommendation to deny the negligence claim of Liz Pfunder, Claim #22-02151201177 in the amount of$38,093.52. OBJECTIVE: To seek the review and authority from the Board to deny claim #22-02151201177 which alleges negligence on the part of Collier County resulting in a sewer back up in the home of Liz Pfunder. CONSIDERATIONS: On October 23, 2012 the Board heard Item 11J which was a request from claimant Liz Pfunder for reimbursement of repair bills related to a sewer backup claim in her home that occurred on February 14, 2012. The details of the claim are presented in the background portion of the Executive Summary below. The Board directed that staff do the following. 1) Secure confirmation that Ms. Pfunder is no longer represented by legal counsel. 2) Secure copies of bills and proof of payment for repairs made to her home. 3) Review these bills and determine an appropriate sum that is commensurate with the damages incurred and the reasonable cost to repair the damage. 4) Bring the•item back to the Board for further consideration upon completion. All of the above have been completed by the County's adjusting firm, Johns Eastern. In addition, staff directed Johns Eastern to perform a field site visit to the claimant's home to document that the repairs presented were actually completed. The field adjuster's report is attached as backup to this item. There are two issues for the Board to consider. First, is the issue of liability. It is the opinion of Risk Management staff, Johns Eastern staff and the County Attorney's Office that the Claimant has not proven that the County is liable for the alleged damage and therefore no payment is owed to the Claimant. If the Board makes the determination that the County is not liable, or that liability cannot be established in this forum, then no damages are due the claimant. However, if the Board determines that the Claimant has established liability, and accepts that the County is liable for the damages alleged, then the Board must determine the amount of damages owed the Claimant. Damages presented by the Claimant consist of the following: Roto Rooter Bill: $ 589.95 Dry Zone Water Mitigation: $ 8,860.12 Repairs: $33,644.35 Total Damages Claimed $43,093.52 Less Carrier Payment ($ 5,000.00) (Paid by claimant's homeowner's policy) Net Damages Claimed $38.093.52 (Claimant has paid$35,354.47) The County's adjuster, Johns Eastern prepared a damage estimate consisting of the following: Dry Zone Water Mitigation: $ 8,860.12 Actual Cash Value of Repairs: $29,887.51 Total Damages Estimated $38,747.63 Less Carrier Payment ($ 5,000.00) (Paid by claimant's homeowner's policy) Net Adjuster's Estimate $33,747.63 Packet Page-1480- 1/22/2013 Item 16.E.6. In summary, the claimant has net damages claimed of $38,093.52. The County's adjuster has calculated a net estimate of $33,747.63. The difference is $4,345.89. It must be stressed that the County was never afforded the opportunity to inspect the damage prior to the commencement of repairs. Therefore, the adjuster is basing this estimate on the work completed rather than a first person inspection of the damage alleged. Background On February 17, 2012 the Risk Management Department received a notice of claim from Ms. Liz Pfunder who resides at 3500 Corinthian Way, Naples Florida 34105. Ms. Pfunder alleges that a sewer backup occurred at her home on the evening of February 14, 2012 between the hours of 8:00 and 9:00 p.m. According to a statement taken by the County's adjusting company, Johns Eastern, on February 23rd, her granddaughter flushed the downstairs toilet before going upstairs to bed. She attended to her granddaughter for approximately 45 minutes. When she came downstairs she found water in the second bathroom coming up from the shower. The claimant admits that the toilet was stuck in the open position and continued to run during the time that she was away. She also admitted that she had experienced problems with the toilet prior to this time. She stated that she jiggled the handle and it stopped running. During that time, a significant volume of water was released. That same evening, Ms. Pfunder contacted a plumber, RotoRooter, who came to her residence within approximately 20 minutes. According to the technician for RotoRooter, he could not find the cleanout from the home and proceeded to open the County cleanout on the street side of the system without the authority of the Public Utilities Division. According to the technician, he "Ran high velocity jett (sp) at 3200 psi and cleared clog roughly 40 feet in"and "Ran camera, shows large hump or inward dent in 6" pipe that must have caused back up."At no point does he mention that he checked the claimant's side of the line for blockage. The RotoRooter technician called or referred the claimant to DryZone to begin cleanup and repairs. He also told the claimant to call the County. At 10:50 a.m. on the morning of February 15, 2012 the Wastewater Collections Department received a call from the claimant. Crews responded and checked the customer's cleanout and found it was clear and flowing. The crew also scheduled a camera truck view of the line in question. According to staff, the claimant did not mention damage to her home nor did she request that a claim be filed. On February 17th, the Wastewater Collections staff performed a view of the County's line. A camera was inserted into the line and no service issues were discovered. They did not observe any dents, humps or blockages in need of repair. At 3:45 p.m. on February 17, 2012 the claimant contacted the Risk Management Department to file a notice of claim. Mr. Jerry Tharpe, Safety Specialist responded to the claimant's home that day. Upon entering the property, Mr. Tharpe immediately identified the location of the claimant's cleanout. Upon entering the home, it was noted that significant repair work had commenced including the removal of drywall, fixtures, baseboards and carpets. Staff documented these activities; however, due to the extensive repairs already underway, the original damage itself could not be documented by staff. The information gathered was provided to Johns Eastern. On March 2, 2012 John Powers of Johns Eastern completed his investigation of the claim. In accordance with Resolution 2004-15, he recommended to the Risk Management staff that the claim be denied. Resolution 2004-15 requires under Loss Verification and Expense Provision, paragraph 4) A written recommendation by the Risk Management staff member or the contracted Adjuster performing the investigation as to the issue of liability, Claim valuation, economy and efficiency, and or other reasons for the recommendation to settle within recommended amounts. Staff reviewed the adjuster's recommendation and agreed with his assessment based upon the fact that legal causation could not be established. There was no prior notification of problems with the line in question. The claimant authorized the RotoRooter technician to perform unauthorized repair work on the County's line without Packet Page-1481- 1/22/2013 Item 16.E.6. affording the County the opportunity to observe the alleged blockage or make necessary repairs. The RotoRooter technician stated that he could not find the claimant's cleanout, which is doubtful. Further, there is no evidence that he checked for potential blockages on the claimant's side of the system. The RotoRooter technician states that he inserted a camera into the line after he cleaned the line rather than prior to cleaning the line. In other words, he did not visibly observe the blockage nor is there any photographic evidence provided by the claimant that the blockage existed within the County line. The evidence collected by Wastewater staff shows that the line was clear; that the line did not show a hump or dent in need of repair. This is in direct opposition to the opinion of the RotoRooter technician. Due to the absence of notice to the County it was impossible to confirm that the alleged blockage occurred within the county line. Therefore, it is impossible to establish a breach of duty, legal causation, and therefore, liability on the part of the County. Mr. Powers issued a letter of denial to the claimant on March 2, 2012. The basis of the denial included the following statement, "Please be on notice that Collier County and their insured locations must be on notice of hazardous conditions and beyond that, there must be a failure to act in a timely manner for negligence to exist. The county did not have notice of the alleged hazard prior to the aforementioned loss. Furthermore, a plumber was authorized to complete work before the county was given any opportunity to respond or to inspect their property." A letter dated March 19, 2012 was sent to John Powers of Johns Eastern Company, the County's adjuster, from Michael G. Brown of Michael G. Brown and Associates, P.A., Attorneys at Law. He begins the correspondence by stating that he represents the claimant for her claims for money damages arising out of property damage to her home. He also requests reimbursement of the claimant's Dry Zone bill in the amount of $8,860.02. In the letter he also states, "Accordingly, this is to request that you immediately contact me upon youir(sp) receipt of this correspondence to discuss this matter. I write this letter in an effort to avoid time-consuming and costly litigation over this incident. Please be advised, however, that should we be unable to reach an amicable resolution of this matter in the very near future, I am prepared to initiate suit on Ms. Pfunder's claims in the Twentieth Judicial Circuit Court in and for Collier County, and let a jury decide responsibility for and amount of Ms. Pfunder's damages." An additional letter dated March 25, 2012 was sent to adjuster John Powers of Johns Eastern Company, from Michael G. Brown of Michael G. Brown and Associates, P.A., Attorneys at Law. In this correspondence, a demand for $46,288.51 is presented for Dry Zone repairs. Included in this correspondence were pictures taken by Dry Zone prior to the renovations. Staff reviewed the original digital photographs and noted a large area of mold in one room extending some three feet up the wall. Staff reviewed the date stamp on the picture and noted it was taken on February 15th at 12:55 a.m., some three hours after the back up. In the opinion of the adjuster, it would be impossible for mold to form on the wall from the alleged sewer backup within just a few hours of the event. Further, the formation of the mold was much higher than the water depth of the backup. It appears that an unrelated leak existed in the area for some time. Along with the March 25, 2012 demand, John Powers of Johns Eastern received a copy of a video prepared by the RotoRooter technician. The video was reviewed by Wastewater Collections staff who stated that they did not see anything on the video that would warrant further action by the County. According to staff, they observed a dip in the line, however; they did not believe it to be the cause of the backup nor did they believe a repair was necessary. On June 26, 2012 the County Attorney's office received a call from attorney Joe Davidow who stated that he represented the claimant and that he intended to file suit. On July 5, 2012, a public records request was received from attorney Christina Davidow regarding this claim. No further contact has been received from the claimant's attorneys. Packet Page-1482- 1/22/2013 Item 16.E.6. The recommendation of staff is to deny the claim on the basis of a lack of legal causation necessary to establish liability. The recommendation of staff is that if the claimant believes she can prove her claim, the proper venue for a cause of action is within the 20th Judicial Circuit. Oak However, should liability be considered by the Board, there remains the issue of damages. It is the position of staff and the county's adjuster that the County was prejudiced by the claimant's failure to contact the County prior to the commencement of repairs. Normal protocol would be to engage a professional estimator/adjustor on the County's behalf to assess the damage and prepare a separate estimate. It is apparent that prior water damage may have existed which would offset the value of the claim. There is also a matter of contributory negligence on the part of the claimant for failure to properly maintain her toilet. The claimant stated that the toilet stuck open and continued to run for 45 minutes which contributed to the damages she incurred. In fact, she admitted to John Powers that the toilet had stuck in the open position prior to this event. Rather than spilling a few gallons of water, this resulted in the spillage of hundreds of gallons of water. Finally, the claimant filed a claim with her homeowner's insurance carrier who paid up to $5,000 under Endorsement HO 05 99 01 09 of her policy. Each of these issues should be considered when evaluating the damages owed the claimant. FISCAL IMPACT: Based upon the recommendation of the County's adjuster and the recommendation of the Risk Management Director, it is recommended that the claim be denied. However, should the Board accept liability, funds would be paid from Fund 516, Property and Casualty Insurance. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and concurs with the staff recommendation to deny this claim. The County has no legal duty to maintain and/or repair a private property owner's sewer line under usual circumstances. In fact, the County litigated a similar case in County Court (Case No.: 11-CC-1030), and the case was dismissed on Summary Judgment Asiftet, with the Court finding that that County had no duty to maintain and/or repair a private property owner's sewer line. There is no evidence presented that the blockage occurred on County property. The evidence presented supports the position that the blockage or damage was on private property. In addition, the damages appear to be unreasonable or excessive for this type of claim. The Claimant has the burden of proof, and the Claimant must prove that the County's negligence caused her damage. As discussed above, there is no evidence to support her claim and no proof of causation. As such, this Office concurs with the recommendation to deny her claim, and believes that the Courts are the appropriate forum for this dispute. This item is legally sufficient for Board action and requires majority vote. —CMG RECOMMENDATION: It is recommended that the Board approves the denial of claim #22- 02151201177 which alleges negligence on the part of Collier County resulting in a sewer back up in the home of Liz Pflunder. Amok ORIGIN This claim was reported back on February 14, 2012 by the claimant. The claimant had a sewage backup occur on her property. INSPECTION We met with the claimant and completed a walkthrough of the property. We noted that there is a plastic pcv sewer cap located in the paved portion of the driveway According to the insured; the plumber came out when the backup occurred. He snaked up to 40' from the pipe down the line and found a blockage. We have enclosed his report for the file. In speaking with the insured when we walked around her home we noted she said the sewage came up from the shower and also up from a toilet in the second bathroom. She claims they later found a crack in the base of the toilet. She also told us she was not happy with the work performed by Dry Zone. She felt, due to the situation, that she somehow was forced into signing for the work for them to complete. We went through the home and noted repairs have been completed. The claimant advised that she had the floor changed from the tile and carpet to an engineered wood laminate. She had replaced the toilets and vanities herself with funds received from her own carrier. She explained that she changed out the vanities to a different type of her choosing. It was explained that „,w,. insurance, whether hers or another, would consider payment back to what it was. A closet was mentioned by the claimant and we noted mold on the wall. However the claimant admitted this was not part of the claim but that the cleaning company included it as clean up and repair. She did confirm that she received $5,000 from her carrier and used the money towards repairs. She went and purchased the items herself and had them installed to cut costs. She also added some items that may not have been considered for this claim. MOLD As reported in our investigation, the claimant informed us of a mold problem that was in her closet but does not feel it was part of the claim. The area has been repaired at minimum requirements. ADJUSTMENT We reviewed the estimate of repairs by Dry Zone and as requested completed an estimate working from this one. We made some changes and added depreciation where we saw necessary. N Replacement Cost Value: $32,579.56 Depreciation: $ 2,692.05 Actual Cash.Value: $29,887.51 The claimant received a payment of $5,000 from her own company even though they are not covering the loss. He informed us that they wrote the estimate to help the claimant out at the time of the loss. He also confirms that sewage was coming up through the shower floor. ROTO ROOTER was called.The plumber said he couldn't find her cleanout, he then opened the county cleanout proceeded to clean the line toward the manhole.SEE: plumber bill.The plumber told the lady it was on the city side (water-city of Naples/Sewer-Collier County).The city was called and came out and asked her if she was flowing and she said yes and he left.The county was called at 10:50AM On 2-15-12 to check the sewer line.The line was setup for viewing. No problems found. The plumber called or recommended the Dry Zone 24hr emergency cleanup services.They responded Wednesday evening ripping out carpet,vanity and cutting the drywall up from the floor about 24 inches they placed blowers around the rooms to dry the house. Timeline: Plumber called on 2-14-2012. Plumber cleaned the line from the county cleanout. Collections was called at 10:50AM about a backup in the sewer line. Dry Zone was called to clean up the house; they removed the carpet, vanity and cut the wallboard about 24 inches from the floor. The home owners adjuster came on the 15th or 16th• The homeowner called the City of Naples Utility at 2:26 on 2-17-2012 and then called Collections at 3PM with a damage issue. Arrived at residence at 4:16 Property Damage: Carpet and walls in the Master BR,perimeter walls around the adjoining rooms (living room, closet, bathroom, under stairway, hallway)vanity ruined. Investigation: Checked the damage to the dwelling and took pictures of the damage. Conclusion: The water damage happened on the evening of thel4th. A plumber was called, and not Collections. When Collections arrived on the 15th no damage was reported to them. When the homeowner called Collections at 10:50AM no damage was mentioned. Upon Roto-Rooer's plumber's inspection of the situation, he determined that the source of the flooding was a defect/dent or blockage in a 6"pipe located off of Ms. Pfunder's property, and on property owned by the City of Naples. Considering the late hour and the emergent nature of the situation, notwithstanding the fact that the source of the problem was a defective or blocked pipe located on property owned by the City of Naples, there was neither time nor opportunity for Ms. Pfunder or the Roto Rooter plumber to contact the City of Naples prior to their taking action to mitigate her damages. Specifically, said plumber ran a high velocity jet (at 3800 p.s.i.) through the subject pipe and cleared the clog, thereby preventing any additional water from intruding into Ms. Pfunder's home. 1 Ask Packet Page-1539- 1/22/2013 Item 16.E.6. As far as damages are concerned, Ms. Pfunder hias already paid to Dryzone, Inc. the amount of $8,860.02, for said company's water removal services (copy of Invoice also enclosed), which included the removal of the floors, dry walls, cabinets etc. Ms. Pfunder has additionally sustained approximately $48,000 in damage to her property, for which a written estimate from Dryzone, Inc. is forthcoming. Enclosed herewith for your review are two (2) CDs on which there are mutliple color photographs that document the extensive damage to Ms. Pfunder's home and personal property resulting from this incident. I don't know why the county representative was talking about me seeking litigation ....this is absolutely not the case. have attached the letter written by Michael Brown, whom I contacted at that time to act on my behalf. That was in March 2012. After my claim was denied for the 2.time I told Mr. Brown that I will not need his help anymore and that I will try my very best to settle this outside the courtroom and not seek litigation. After I ended the representation with Mr. Brown, I contacted a local attorney to help guide me through potential courses of alternatives to litigation.At this time, I have instructed her not to initiate or engage in any form of litigation, but instead, to wait and see if the county is willing to take responsibility for its utility services or until it becomes apparent that the county will not pursue out of court resolution. I believe in my county commissioners, and I know that they are good people and responsible citizens like I am. I therefore believe that they will be honorable and carry the responsibility they have undertaken. A video/DVD of the pipe from RotoRooter was sent to Michael Powers on April 20, 2012.
