EXECUTIVE SUMMARY Recommendation to adopt a Resolution authorizing a public hearing to consider vacating a portion of the southerly 10 feet of an existing 20-foot drainage easement located in Tracts D and E, Northbrooke Plaza, as recorded in Plat Book 31, Pages 65 through 66, of the Public Records of Collier County,Florida.-Application No.AVPLAT-PL20120002420. OBJECTIVE: Pursuant to Section 177.101,Florida Statutes, and Resolution No. 2006-160,the Board of County Commissioners must authorize a public hearing to consider the vacation of a portion of any type of platted easement. CONSIDERATIONS: The Engineering Services Department has received a request from Dean Foster as agent for property owner. This is a request to vacate a portion of the southerly 10 feet of the existing 20-foot drainage easement, located in Tracts D and E, Northbrooke Plaza, as recorded in Plat Book 31, Pages 65 through 66, of the Public Records of Collier County, Florida, where the existing building was constructed in error over the southerly part of the 20-foot drainage easement. The drainage easement infrastructure was never built. Parcels to the west already had all or part of their easement vacated, so the functionality of the overall easement was already impeded. The remainder easement being vacated here already can be considered non-functional due to a lack of connectivity. The public hearing will be advertised in a local paper of general circulation pursuant to Section 336.10,- Florida Statutes, and Resolution 2006-160,and the adjoining property owners will be given notice. FISCAL IMPACT: The application fee of $2,100.00 covers staff review and processing. The Applicant is also responsible for advertising fees. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office, is legally sufficient and requires a majority vote for approval. AVPLAT-PL20120002420 REV:1 PROJECT NAME:Northbrooke Plaza,Tract D&Tract E • DATE:10/9/12 DUE:10/23/12 To Whom It May Concern: Construction of the subject property at 2515 Northbrooke Plaza Drive was completed in January,2003. It was the first building to be completed in the development on the north side of Northbrooke Plaza Drive. The property was purchased by the present owner in July of 2012. The engineering firm did not reflect the drainage easement in their survey that was submitted to Collier County, along with the architectural material, for plan review and construction permitting of the building at 2515 Northbrooke Plaza Drive. Additionally,the drainage easement was not reflected on any of the subsequent surveys, including the slab survey or the as-built survey. In fact, the existence of the drainage easement was not discovered until late August of 2012, when the owner ordered a survey for the property at 2515 Northbrooke Plaza Drive. • After receiving the new survey for the subject property,the document was brought to the County office on Horseshoe Drive. John Houldsworth indicated the position of the building in respect to the drainage easement indicated the easement was most likely vacated at a previous time. However, further research by Mr. Houldsworth revealed the easement had not been vacated. As a result, a portion of the existing drainage easement is encumbered by 10 feet by the existing building on the subject property. In turn, the owner presently is unable to secure title insurance for the property. For this reason,the owner respectfully requests a vacation of the drainage easement located at the northern border of the subject property. The area of the requested vacation does not include any of the existing drainage easement area that overlaps other existing easements on the property. Thank you. • �.
