''OB_JECTIVE: To vacate a portion of Railroad Street, Immokalee, Florida to
expand a packing house.
'CONSIDERATION: A petition has been received by the Engineering Department
,'from Thomas K. Boardman, as agent for the petitioners, to vacate a portion of
• Railroad Street as shown on the attached akatch. Letters of No Objection have
been received from all pertinent utility companies. Water Management Advisory
Board has reviewed the petition and has approved it administratively. Engine-
ering and Transportation have reviewed the petition and has determined the
'Vacation would not affect drainage or access to others. Plan Implementation
has no objection.
RECOMMENDATION: That the Board of County Commissioners approve the vacation
of the above right-of-way and authorize execution of the Resolution by its
chairman, and direct the Clerk to record the Resolution.

EXECUTIVE SUMMARY
Recommendation to correct a scrivener's error found in the legal description vacating a
portion of Railroad Street in Immokalee, Florida, being a part of Resolution No. 84-166,
recorded in Official Record Book 1099, Page 1655 of the Public Records of Collier County,
Florida, located in Section 3, Township 47 South, Range 29 East, Collier County, Florida.
OBJECTIVE: To adopt a Resolution that corrects a scrivener's error found in the legal
description vacating a portion of Railroad Street in Immokalee, Florida, being a part of
Resolution No. 84-166, recorded in Official Record Book 1099, Page 1655 of the Public Records
of Collier County, Florida, located in Section 3, Township 47 South, Range 29 East, Collier
County,Florida.
CONSIDERATIONS: On September 4, 1984, the Board of County Commissioners (Board)
approved Resolution No. 84-166 recorded in Official Record Book 1099, Page 1655 of the
Public Records of Collier County, Florida to vacate a portion of Railroad Street in Immokalee,
Florida. Per the 1984 application, the intent was to vacate "Railroad Street from the extension of
the north boundary of Oak Street to the north boundary of the land owned by Chapman Fruit Co.,
Inc. located west of the Atlantic Coast Line Railroad right-of-way." As shown on the attached
site map, the legal description was off by 22.3 feet. The Engineering Services Department has
received a request from Thomas K. Boardman, as Agent for the property owner in 1984 and
today,to correct the scrivener's error found in the legal description of Resolution No. 84-166.
FISCAL IMPACT: Growth Management Division, Engineering Services staff will collect
approximately $320.00 fee from the petitioner which covers the County's cost of recording and
processing the Petition, and approximately $250.00 for advertising fees.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA TO CORRECT A SCRIVENER'S
ERROR FOUND IN RESOLUTION NO. 84-166 WHICH VACATED A
PORTION OF RAILROAD STREET, AS SHOWN ON THE PLAT OF
IMMOKALEE, FLORIDA, RECORDED IN PLAT BOOK 1, PAGE 60
OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA,
LOCATED IN SECTION 3, TOWNSHIP 47 SOUTH, RANGE 29 EAST,
COLLIER COUNTY FLORIDA.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
September 4, 1984 approved Resolution No. 84-166 for recording; and
WHEREAS, Resolution No. 84-166 contained a scrivener's error in the legal description
which left approximately 212.3 feet of Railroad Street in place; and
WHEREAS, the corrected legal description is as follows:
That portion of Railroad Street in Immokalee, Florida, as shown on the plat of
Immokalee. Florida, recorded in Plat Book I, Page 60 of the Public Records of
Collier County, Florida which is bounded on the South by a prolongation of the
Northerly right-of-%vay line of Oak Street to the East right-of-way line of Railroad
Street; and bounded on the north by a line which is found by, Commencing at the
Northwest comer of the Southwest one-quarter of the Northwest one-quarter of
Section 3, Township 47 South, Range 29 East; Thence along the west line of said
Section 3, South 00'57'50" East, a distance of 327 feet; Thence leaving said line
and along a line bearing North 88'2625" East extended to a point on the East right-
of-way line of Railroad Street.
WHEREAS, Chapman Fruit Company, Inc., the owner of the subject property, has
requested the Board of County Commissioners to amend Resolution No. 84-166 to include the
corrected legal description and to renounce ownership of the same.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
This Resolution amends Resolution 84-166 to include the above corrected legal
description as the vacated portion of Railroad Street in Immokalee, Florida and the property
described in said corrected legal description is hereby vacated, extinguished, renounced and
disclaimed.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the Public Records of Collier County,

Marcus - This is to confirm that I represented Chapman Fruit Company in a vacation proceeding involving that
portion of railroad street in Immokalee, lying between two parcels of property owed by Chapman Fruit
Company. This matter was concluded in 1984. It was the applicant's intent that all of railroad street lying
between those two properties be vacated, yet owing to an error in the survey, that apparently was not the case.

First let me apologize for the delay.
We have concluded that we can get this resolved by a resolution processed as a scrivener's error provided the
resolution is advertised for the BCC meeting.
As per our fee schedule, I have spent 7 hours researching, corresponding and preparing drawings to get staff
approvals required for this process. So at $40 per hour X 6 = $240.00, first hour free, plus a couple more hours
of my time to finish the process, plus the fee for advertising you already agreed to pay, we can get this
concluded and recorded with the County.
If
One more item, this process will only fix the Railroad Street error associated with the Chapman Fruit Company,
separate from the parcel to the north.

I met with Heidi Ashton yesterday and discussed the scriveners error on both parts of Railroad Street opposite each
parcel. There were a couple of items that Heidi needed to speak with Jeff Klatzkow (County Attorney) about and as soon
as she does, we should be able to come to a conclusion to get this resolved.
