EXECUTIVE SUMMARY
This item is continued from the December 11, 2012 BCC Meeting. Recommendation to approve an
amendment to the Developer Agreement with Habitat for Humanity of Collier County, Inc. for the
Neighborhood Stabilization Program 3 (NSP3) to reflect updates to the US Census Tracts. (This
item does not propose to alter the geographic boundaries of Board approved target areas.)
OBJECTIVE: Make minor administrative changes to reflect updated census tract target areas in the
developer agreement.
CONSIDERATIONS: On December 13, 2011, Agenda Item No. 10. A., the Board of County
Commissioners (Board) approved an NSP exit strategy and associated implementation actions with the
purpose of extricating the County from daily operations of the Neighborhood Stabilization Program. On
April 24, 2012, Agenda Item No. 11. B., the Board approved a Developer Agreement with Habitat for
Humanity to acquire property with the goal of Habitat using private funds to rehabilitate and resell the
properties.
On February 28, 2012, Agenda Item No 16. D. 6, the Board approved a County developed Action Plan
that was sent to the Department of Housing and Urban Development (HUD), with regard to the
implementation of the NSP3 program. Within the Action Plan, the County identified target areas as
"Areas of Greatest Need" in which to carry out programmatic activities and to reflect all planned
activities.
It was originally determined that the eligible census tracts targeted would fall under Tracts 104.09;
104.10; 104.11; and 107.01. As a result of population shifts during the most recent decennial census, the
census tract designated as 104.09 split into two completely new census tracts, 104.19 and 104.20. This
split dissolved the original census tract of 104.09, yet retained the same external boundary. HUD has
determined through email that the County is not required to update the Action Plan with the revised
census tract designations, so long as the stated activities will remain within the same census tract
boundaries that were originally designated. However, it is necessary to amend the NSP3 Developer
Agreement to reflect the newly created census tract numbers. This item is solely for the purpose of
updating the Developer Agreement to reflect current and original boundaries as approved through the
Board's NSP3 exit strategy thus allowing Collier County to pay Habitat for properties acquired in these
census tracts.
If the Board does not approve this change to the developer agreement to update the current Collier County
census tracts allowing payment of acquired properties, the County may be in danger of not meeting its
NSP3 federal grant timeliness requirement of March 2013. Failure to meet HUD's timeliness requirement
may result in programmatic restrictions for all HUD federally funded programs and/or require the County
to repay federal grant dollars already expended for the NSP3 program.
FISCAL IMPACT: There is no fiscal impact. NSP3 funds are located in Housing Grants Fund (705),
Project 33150.
LEGAL CONSIDERATIONS: This item is legally sufficient and requires a majority vote for Board

GROWTH MANAGEMENT IMPACT: The Neighborhood Stabilization Program facilitates the goals,
objectives and policies set forth in the Housing Element of the Growth Management Plan.

Suzanne,
Kim spoke with Maria Ortiz at HUD regarding what they consider the definition of boundaries in
this case with regards to census tracts. HUD view boundaries to be determined by street names.
Looking at the map in reference to Eli's response below the boundaries have not changed with the
change in census tract numbers. I have included the maps received by our planning department
showing that the boundaries have not changed (when 104.09 split into 104.19& 104.20) and that
we are not expanding our target area. Please let me know if you have any questions for Pay

We checked with HUD headquarters regarding the subject mentioned above. However, if the
County wants to keep the old boundaries of 104.09 then they don't need to do anything,that's
what was approved and it's fine. Please be advised that if the County wants to update its target

After speaking with our TA who then referred us to Lori, it seems that our issue with the census
tracts has come up before with HUD as shown in the email string below. Do we need to create a
substantial amendment to address this issue? If we do is there any way to pay our developer's

I believe Mary spoke with you recently regarding the issue that we are having with our census
tracts.Attached is a letter from our Planning department confirming that the census tract 104.09
split into two new different ones. In speaking with Mary,she relayed that HUD wouldn't have a
problem with the County going forward and reimbursing our developer who purchased a property
in the physical location that used to be the 104.09 census tract. I just wanted to confirm that with
you for our Clerk's office. Also would we need to perform a substantial amendment to our action
plan to update the new census tracts in our action plan or would HUD allow us to continue with
