EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of
$399,000, for payment of $450, in the code enforcement action entitled Board of County
Commissioners v. AMG Properties, Inc., Code Enforcement Board Case No. 2007090454, relating
to property located at 3831 Arnold Avenue, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners (Board) accept an offer to release a
code enforcement lien with an accrued value of $399,000, for payment of $450, in relation to
Code Enforcement Board Case No. 2007090454.
CONSIDERATIONS: As a result of a code violation at 3831 Arnold Avenue, which consisted
of construction, additions to and remodeling of a steel frame building without the required
permits, the Code Enforcement Board ordered the imposition of a lien against AMG Properties,
Inc. in Case No. 2007090454. The lien was recorded in the Official Public Records on April 11,
2012, at O.R. Book 4784, Page 1751, and it encumbers all real and personal property owned by
AMG Properties, Inc. The lien amount of $399,000 is based on 1,995 days of accrued fines
(October 25, 2008 through April 11, 2014) at $200 per day. Operational costs were paid in full
prior to the lien imposition.
Jose A. Garcia, as President of AMG Properties, Inc., acquired the property on June 5, 1997 with
the building already in place. The code case was opened in 2007 and Mr. Garcia spent a great
deal of time and incurred over $100,000 in costs associated in bringing this property into
compliance, as evidenced by the attached hardship letter and backup. The property was brought
into compliance by Mr. Garcia on April 11, 2014.
Pursuant to Resolution No. 2012 -46, a request for waiver of fines may be considered when full
payment of a code enforcement lien would impose a severe financial hardship on the property
owner; fines accrued by an existing owner would be considered for a waiver as long as the
existing owner has diligently pursued abatement and compliance has been achieved. Mr. Garcia
has been actively maintaining the property and has paid $450 in fines. Mr. Garcia is requesting
the waiver of $398,550 in accrued fines.
FISCAL IMPACT: Payment of $450 has been made. If approved by the Board, accrued fines
in the amount of $398,550 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and
approved it as to form and legality. Majority support is required for approval. This item
conforms to the Board's policy contained in Resolution 2012 -46. KN
RECOMMENDATION: That the Board of County Commissioners waive the fines in the
amount of $398,550, accept payment amount of $450, release the lien, and authorizes the

OF COLLIER COUNTY, FLORIDA is the owner and holder of a certain lien against all real and
personal property owned by:
AMG Properties, Inc.
Respondent
The lien was recorded on April 11, 2012, in Official Records Book 4784, Page 1751, in the
Official Records of Collier County, State of Florida. The lien secures the principal sum of two
hundred forty -eight thousand dollars ($248,000), plus accrued interest and penalties, if any, and
imposes certain obligations against real property situated in Collier County, Florida.
Collier County, a political subdivision of the State of Florida, by execution of this Release and

I am contacting T you in an effort to resolve the outstanding fines and lien imposed on the property
located at 3831 Arnold Ave Naples, FL. It has been a long and strenuous process in rectifying
the non-conforming matters that were in existence when I purchased the property back in May of
1997 from Mike Holton. There was a variety of different issues brought to 11Lht in early 2008
from the numerous inspections in which I did my very best to rectify and come into compliance
with Collier County code as soon as possible. I was made aware by the initial inspection that the
property contained a beam in the rear of the warehouse that had become loose. As a result. I took
immediate action and fixed the beam in two days. A subsequent inspection revealed that that
the actual building and mezzanine which was built after the CO had been obtained in 1984 was
not in compliance with current code. These violations were created by a prior owner between the
years of 1.984 and 1986. In 1986, this property was purchased by Mike Holton by way of C131.
Inc. and subsequently sold to AMG Properties, Inc. in 1997. Both Mr. Holton and I purchased
this property not knowing that such violations existed. The violations in the code were never
I -
even addressed by Collier County until the 2008 inspection took place.
Shortly after I was made aware of the new alleuations. I met with Collier County code enforcers
to discuss the most efficient �wav to remedy all of the violations. It has taken a lonu time and lots
of -effort from both sides to get this job done. I ask that you take under consideration that our
economy has been in a terrible condition and that we have suffered tremendous financial
hardship in the past 6 or 7 ycars.
Our tenant has refused to sign a new lease agreement because the lien and I have had to reduce
their rent ever since so they would stay. I am being pressed by our bank to resolve this issue
quickly or face foreclosure because I can not have outstanding liens on our properties. I have
done everything in my power to come into compliance and I have spent over six figures to
comply will all the county's request. I have owned this property for 17 years and always paid my
taxes with a discount and never have given the county one complaint or a problem. I a in
seeking your help to remove the lien and the dollar fine associated xNlth this matter so I can
resolve the other issues as soon as possible.
