EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve for
recording the final plat of Breeze of Calusa, (Application Number PL20130001575) approval of the
standard form Construction and Maintenance Agreement and approval of the amount of the
performance security, and to accept an off -site donation of mitigating Preserve pursuant to Section
3.05.07 H.1 of the Collier County Land Development Code. This item is a companion to Item 16E9.
OBJECTIVE: To have the Board of County Commissioners (Board) approve for recording the
final plat of Breeze of Calusa, a subdivision of lands located in Section 24, Township 48 South,
Range 25 East, Collier County, Florida, following the alternative procedure for approval of
subdivision plats pursuant to Resolution 99 -199. This procedure allows for the Board to approve
the plat and associated construction documents for construction purposes and recording purposes
concurrently.
CONSIDERATIONS: The Engineering Services Department has completed the review of the
construction drawings, specifications, and final plat of Breese of Calusa. These documents are in
compliance with the County Land Development Code and Chapter 177, Florida Statutes. All fees
have been paid. The proposed development is subject to Rezone PL20130001752 which was
approved by the Board on October 28, 2014. The developer will make an off -site donation of
Preserve land (1.14 acres) to satisfy the minimum site Preserve requirements, and provide a cash
payment for management of the land in accordance with Section 3.05.07 H.l.f.iii.b. The land
has been evaluated by Conservation Collier and meets the requirements set forth by
Conservation Collier. The donation must occur prior to the pre - construction meeting pursuant to
Section 3.05.07 H. l .f.iii.b of the Land Development Code. Security in the amount of 10% of the
total cost of the required improvements, and 100% of the cost of any remaining improvements,
together with a Construction and Maintenance Agreement for Subdivision Improvements, shall
be provided and accepted by the County Manager or his designee and the County Attorney's
office prior to the recording of the final plat. This procedure is in conformance with Section
10.02.04 F.2 of the Land Development Code.
The Engineering Services Department recommends that the final plat of Breeze of Calusa be
approved for recording.
FISCAL IMPACT: The project cost is $391,783.00 (estimated) to be borne by the
developer.
The cost breakdown is as follows:
a) Water & Sewer $ 86,031.00
b) Drainage, Paving, Grading $305,752.00
The Security arnount, equal to 110% of the
project cost, is $430.961.30

The County will realize revenues as follows:

Revenue generated by this project: Total: $11,000.34
The Fees are based on a construction estimate of $332,678.00 (does not include City of Naples
potable water improvements) and were paid in December, 2013.
The breakdown is as follows:
a) Plat Review Fee ($1,000.00 + $5. /ac) $1,020.00
b) Construction Drawing Review Fee
Sewer (.75% const. est.) $ 201.95
C) Drainage, Paving, Grading
(.75% const. est.) $2,293.14
d) Construction Inspection Fee
Sewer (2.25% const. est.) $ 605.84
e) Drainage, Paving, Grading
(2.25% const. est.) $6,879.42
GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of
Adequate Public Facilities prior to the issuance of the construction plan final approval letter.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and
requires a majority vote for Board approval. - SAS
RECOMMENDATION: That the Board of County Commissioners endorses staff's
recommendation to approve the final plat of Breeze of Calusa (Application Number
PL20130001575) for recording with the following stipulations:
1. Approve the amount of $430,96130 as performance security for the required improvements;
or such lesser amount based on work completed, and as is approved by the Engineering
Services Department.
2. Approve the standard form Construction and Maintenance Agreement and direct the
County Manager or his designee:
a. To withhold Certificates of Occupancy until the required improvements have received
preliminary acceptance.
b. To delay recording of the plat until suitable security and an appropriate Construction
and Maintenance Agreement is approved and accepted by the County Attorney's
office and the Board of County Commissioners or the County Manager or his
designee, or his designee on behalf of the Board pursuant to Section 10.02.04 F.2 of
the Land Development Code.

c. The developer must provide evidence of the donation and acceptance of the required
off -site Preserve land to Collier County.
