EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to consider a
Resolution of the Board of Zoning Appeals providing for the establishment of a Conditional Use to
allow a church within an Estates zoning district pursuant to Section 2.03.01.B.I.c.1 of the Collier
County Land Development Code for property located on the northwest corner at the intersection of
Everglades Boulevard and Randall Boulevard in Sections 19, 20, 29 and 30, Township 48 South,
Range 28 East, Collier County, Florida. (CU- PL20110002615, The Church of Jesus Christ of
Latter -Day Saints. This item to be heard after Item 9C, PL20110002626 /CPSS- 2012 -1 Small Scale
GMPA].
OBJECTIVE: To have the Board of Zoning Appeals (BZA) review staffs findings and
recommendations along with the recommendations of the Collier County Planning Commission
(CCPC) regarding the above referenced petition and render a decision regarding the petition; and
ensure the project is in harmony with all the applicable codes and regulations in order to ensure
that the community's interests are maintained.
CONSIDERATIONS: The petitioner requests a Conditional Use approval to allow for a
Church in the Estates (E) Zoning District. The subject site is located in a Special Treatment
Overlay for well fields (ST /W -4), which requires land uses that reduce the potential for
groundwater contamination. In addition, there is also a companion small scale amendment to the
Golden Gate Area Master Plan Element of the Growth Management Plan (Petition CPSS -2012-
1). Approval of this Conditional Use is contingent upon approval of the companion GMPA
(Growth Management Plan text amendment).
The proposed Church of Jesus Christ of Latter Day Saints will have a worship hall,
administrative offices and auxiliary uses that will be housed in a 20,000 square -foot structure.
The chapel will seat 230 people. According to a Narrative Statement provided by the petitioner,
Sunday church services and Sunday School will occur at 9:00 a.m. According to information
provided at the CCPC hearing, additional Church services may be added as the Church grows
beyond 230 people. Church meetings for youth and the congregation will occur one or two
evenings per week. Special events including but not limited to baptisms, dinners and holy days
will occur once or twice monthly. The only non - church group that will use the church facility is
the Boy Scouts. The Church does not rent its facilities to outside groups. There is no
administrative staff or regular office hours as volunteers typically serve in that capacity.
The Conceptual Master Plan depicts a 20,000 square -foot church building with 230 seats and 131
parking spaces. There are two points of ingress /egress, one from Randall Boulevard and one
from Everglades Boulevard. Sidewalks have been provided along Randall Boulevard and
Everglades Boulevard as well. All of the proposed development except for the sidewalks along
the rights -of —way and ingress /egress driveways into the site are outside of an existing 50 -foot
road right -of -way easement.
The proposed companion Growth Management Plan text amendment (GMPA) requires a
recreated 65 -foot wide buffer along the north and west property lines adjacent to the existing,

neighboring residences. In addition to the 65 -foot wide buffer is a 10 -foot wide Type B
landscape buffer. The GMPA also requires a 20 -foot wide landscape buffer along the south and
east road right -of -way boundaries, but it has not been provided. The agent has proposed a 15-
foot wide Type D landscape buffer instead. Unrelated to the GMPA is a.77 acre preserve area in
the southwest portion of the site that provides additional buffering.
Water and sewer service will be provided by a private well and septic system. As previously
stated, there are existing single - family dwellings that are located on the north and west sides of
the site. The maximum zoned height is 30 feet; the actual height is 60 feet according to language
provided in the GMPA.
To date, five letters of objection and one letter or support along with a petition signed by 38
residents in the surrounding area of the Church have been submitted.
FISCAL IMPACT: Approval of the Conditional Use, in and of itself, would have no fiscal
impact on Collier County. There is no guarantee that the project, at build out, would maximize
its authorized level of development.
The County collects impact fees prior to the issuance of building permits to help offset the
impacts of each new development on public facilities. These impact fees are used to fund
projects identified in the Capital Improvement Element of the Growth Management Plan as
needed to maintain adopted Level of Service (LOS) for public facilities. Additionally, in order to
meet the requirements of concurrency management, the developer of every local development
order approved by Collier County is required to pay a portion of the estimated Transportation
Impact Fees associated with the project in accordance with Chapter 74 of the Collier County
Code of Laws and Ordinances. Other fees collected prior to issuance of a building permit
include building permit review fees. Please note that impact fees collected were not included in
the criteria used by staff and the Planning Commission to analyze this petition.
GROWTH MANAGEMENT PLAN (GMP) IMPACT: Future Land Use Element (FLUE):
Comprehensive Planning staff finds the proposed conditional use is currently not consistent with
the Future Land Use Element. Should the Board approve Petition CPSS -2012-
1/PL20110002626, which is a precursor to this item; the conditional use would then be
consistent with the FLUE. A more detailed description of the GMP consistency analysis is
contained in the Staff Report.
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION: The
CCPC heard petition CU- PL20110002615, The Church of Jesus Christ of Latter -Day Saints, on
October 2, 2014, and by a unanimous vote of 7 to 0 recommended to forward this petition to the
Board of Zoning Appeals (BZA) with a recommendation of approval. The approval is subject to
the following Staff and CCPC conditions of approval I through 12:
1. The uses shall be limited as follows:
a. The only non- church group that will use the church facility shall be the Boy Scouts.
b. The Church shall not rent its facilities to outside groups.

c. No outdoor amplified music, except for events which have a special event permit.
d. Day Care uses are prohibited.
2. There shall be no activities before 5:30 a.m. or after 11:00 p.m. except for events that have
a special event permit.
3. The Church is limited to 20,000 square feet, including no more than 230 seats.
4. Street lighting and area lighting shall be of the type specified to protect neighboring
properties from direct glare. Area lighting shall be shielded such that direct rays do not
pass property lines. Low- pressure sodium lamps are encouraged while halogen type lights
are discouraged.
a. Street lamps shall be of the high pressure sodium type and have a "cobra head with
flat bottom" style or be fully shielded so that light is directed only downward. Street
lamps shall be mounted on a wood pole at a height and wattage recommended by the
appropriate electric utility and as appropriate for a rural area.
b. Parking lot lamps shall be low - pressure sodium type lamps and shall be mounted
so that they point downward without direct rays extending past the parking lot,
building entrance, walkway, or other area intended to be illuminated.
5. A 20 -foot wide landscape buffer shall be provided along Everglades Boulevard and
Randall Boulevard. This buffer shall contain a single row of trees (excluding palm trees
and cypress trees) placed no more than 30 feet on center, and a double row hedge at least
24- inches in height at the time of planting and attaining a minimum of three feet height
within one year. A minimum of 50 °0 of the 20 -foot wide buffer area shall be comprised
of a meandering bed of shrubs and ground cover other than grass. Existing native trees
must be retained within this 20 -foot wide buffer area to aid in achieving this buffer
requirement; other existing native vegetation shall be retained, where possible, to aid in
achieving this buffer requirement.
6. As shown on the site plan, a maximum of 130 paved parking spaces and 21 grassed
parking spaces are allowed.
7. No site - related improvements, other than driveways for ingress /egress and sidewalks. shall
be located within 76.5 feet of the existing property line on Everglades Boulevard and
within 90 feet of the existing property line on Randall Boulevard.
8. Access Drives shall have a throat depth of no less than 30 feet, measured from the
roadway edge of pavement.
9. A 75 -foot wide buffer shall be provided along the northern and western boundaries of the
property as follows:

a. The first 65 -feet of the buffer area, as measured from the north and west
property lines, shall: consist of native vegetation materials from the three
vegetative strata; have an opacity of 80 percent at time of planting; reach 100
percent opacity within one year; and, be maintained at 100 percent opacity in
perpetuity. A septic tank drain field and water management facilities are
permitted within this buffer area.
b. A minimum 10 -foot wide Type B Landscape Buffer consisting of native
vegetation only shall be provided adjacent to the parking lot facing the north
and west property lines as shown on the Conditional Use Conceptual Master
Plan. Water management areas and the septic tank drain field shall not be
located within this buffer.
10. Remove the 30 -foot side yard setback notations shown within the north and west buffers
of the Conditional Use Conceptual Master Plan.
11. Remove the Site Standards Table from page 2 of the Conditional Use Conceptual Master
Plan.
12. The front yard setback along Everglades Boulevard shall be no less than 114 feet
measured from the existing property line; and, the front yard setback along Randall
Boulevard shall be no less than 165 feet measured from the existing property line.
Because the letters of objection have been received, this petition has been placed on the Regular
Agenda.
LEGAL CONSIDERATIONS: Before you is a recommendation by the Planning Commission
for approval of a conditional use to allow a church within an Estates zoning district pursuant to
Section 2.03.01.B.1.c.1 of the Collier County Land Development Code. A conditional use is a
use that is permitted in a particular zoning district subject to certain restrictions. All testimony
given must be under oath. The attached report and recommendations of the Planning
Commission are advisory only and are not binding on you. Petitioner has the burden of
demonstrating that the necessary requirements have been met, and you may question Petitioner,
or staff, to satisfy yourself that the necessary criteria has been satisfied. In addition to meeting
the necessary criteria, you may place such conditions and safeguards as you deem appropriate to
allow the use, provided that there is competent, substantial evidence that these additional
conditions and safeguards are necessary to promote the public health, safety, welfare, morals,
order, comfort, convenience, appearance, or the general welfare of the neighborhood. As a
further condition of approval of the conditional use, you may require that suitable areas for
streets, public rights -of -way, schools, parks, and other public facilities be set aside, improved,
and /or dedicated for public use, subject to appropriate impact fee credits. Approval or denial of
the Petition is by Resolution. This item has been approved as to form and legality, and requires
an affirmative vote of four for Board approval. (HFAC)
RECOMMENDATION: Staff recommends that the Board of Zoning Appeals approve the

GROWTH MANAGEMENT PLAN (GM-Pt CONSISTENCY:
Future Land Use Element (FLUE): The subject site is located within Golden Gate Estates and
designated Estates Mixed Use District, Residential Estates Subdistrict on the Golden Gate Area
Future Land Use Map of the Golden Gate Area Master Plan (GGAMP). The GGAINIP limits
Conditional Uses, such as a. church, to certain locations within the Estates area, The subject site
is not eligible for a Conditional Use, as it does not meet the locational criteria within the
GGAMP. Because the property does not comply with the locational criteria contained in the

PL201 10002626/CPSS-201-1-1, is approved by the Board of County Commissioners and
subsequently becoming in effect.
Transportation Element: Transportation Planning staff has reviev,,ed the petitioneCs Traffic

Conservation and Coastal N12nagement Dc.-nent (CCNIF): En-vi.rorimental revievv staff has
found this project to be consistent with the Conservation & Coastal Management Element

(CCME.). The project site consists of 4.68 acres of native vegetation, which includes the
e_Nclusion of the existing and future right of way. A minimum of 0.70 (15%) acres of the existing
native vegetation shall be placed under preservation and dedicated. to Collier Counter.

Based upon the above analysis and mitigation, Transportation staff concludes that the proposed
conditional use may be deemed consistent with the FLUE.
ANALYSIS:
Before any Conditional Use recommendation can be offered to the Board of Zoning Appeals
(BZA), the Collier County PIanning Commission (CCPC) must make findings that: 1) approval
of the Conditional Use will not adversely affect the public interest and will not adversely affect
other property of uses in the sarne district of neighborhood; and 2) all specific requirements for
the individual Conditional Use will be met; and 3) satisfactory provisions have been made
concerning the following matters, where applicable:
1. Section 2.03.01.13.1.e.1., of the LDC permits conditional rises in the Estates (K) zoning
district.
The requested use for a Church is permitted as conditional uses in the Estates (E,) zoning

If the Staff recommended Conditions of Approval are adopted. the proposed Church should
have minimal impact on neighboring properties in relation to Mare, economic or noise
effects. Activities at the subject property are generally concentrated inside the church
building. The Growth Management Plan requires that the applicant provide a 65 -foot wide
buffer along the north and west property lines. To further mitigate for any noise or glare
impacts from the parking lot and church building to the existing and fixture neighbors, the
applicant will provide required landscape buffers outside of the 65 -foot area. A 10 -foot wide
Type B landscape buffer will be provided along north property boundary and along a portion
of the west property boundary. The balance of the west boundary will be buffered by a 100
to 200 -foot wide .77 acre preserve area.
As previously stated, if the Staff recommended Conditions of Approval are adopted, a 20-
foot wide landscape buffer will be provided along the east and south property boundaries
adjacent to road right -of ways.
S. Compatibility with adjacent properties and other property in the district.
As previously noted, if the Staff recommended Conditions of Approval are adopted the
proposed Church will be well buffered. Impacts on surrounding neighbors would be
minimized and compatibility with the surrounding properties insured.

adversely affect the public interest and the specific requirements governing the Conditional Use
have been met and that satisfactory provision and arrangement have been made concerning all
applicable matters required by said regulations and in accordance with Subsection 10.08.00.D. of
the Land Development Code, and
WHEREAS, all interested parties have been given opportunity to be heard by this Board
in a public meeting assembled and the Board having considered all matters presented.

7. No site - related improvements, other than driveways for ingress /egress and sidewalks, shall
be located within 76.5 feet of the existing property line on Everglades Boulevard and
within 90 feet of the existing property line on Randall Boulevard.
S. Access Drives shall have a throat depth of no less than 30 feet, measured from the roadway
edge of pavement.
9. A 75 -foot wide buffer shall be provided along the northern and western boundaries of the
property as follows:
a. The first 65 -feet of the buffer area, as measured from the north and west
property lines, shall: consist of native vegetation materials from the three
vegetative strata; have an opacity of 90 percent at time of planting; reach 100
percent opacity within one year; and, be maintained at 100 percent opacity in
perpetuity. A septic tank drain field and water management facilities are
permitted within this buffer area.
b. A minimum 10 -foot wide Type B Landscape Buffer consisting of native
vegetation only shall be provided adjacent to the parking lot facing the north
and west property lines as shown on the Conditional Use Conceptual Master
Plan. Water management areas and the septic tank drain field shall not be
located within this buffer.
10. Remove the 30 -foot side yard setback notations shown within the north and west buffers
of the Conditional Use Conceptual Master Plan.

Given the time frame for the upcoming CCPC meeting Uwe felt that it was important to comment on this
application and make some simple suggestions that may help the process.
After reviewing the packet documents and discussing via e -mail and phone among the kez member:: of
ItOAGGE, many of which were members of the Golden Gate Master ,Plan (GGANP) and the Last of 931
Horizon Smdv Committee. we subunit to you the foliow ins:
1. The Honleowrtrs Association of Golden Gate F:staies and The Golden Gate Estates ,kr a
Association received no notification of the NI;M; but HOAGGE. did receive the notice from the County for
the CCPC mecrina.
2. One person showed up for the N.L%4, because this is a material change to the Master Plan, the scope of
participants should be conununity based.
3. The subject property is not in a Neighborhood Center so therefore there is no entitlement. and there is no
demonstration of naed.
4. There is available property for sale in already established Neif;hhorhood Centers a short distance av,'ay

Mr. Strain:
Several of our Board Members have had the opportunity to review the above referenced application and have expressed
serious reservations based on the following facts and circumstances:
1. The Community in general is unaware of this project as no notice of the Neighborhood Information Meeting
was ever given to the Golden Gat; Estates Area Civic Association or to the Homeo:vners Association of Golden
Gate Estates. The record shows that only one person from the Community attended the Neighborhood
Information Meeting.
2. The project represents a substantial deviation from the master plan as churches are not a permitted or
conditional use in the "E" zoning district except as currently permitted by the Master Plan.
3. The current Master Plan is long overdue for revision and update. In the last few years several amendments
have been approved on a piecemeal basis, and as you are aware the Community and bath Civic Associations
actively participated in the process. In the current instance there has been a complete absence of Community
participation.
4. The applicant has failed to demonstrate that there is a need for the intended use and that there is not a sufficient
supply of other parcels in the area which are already zoned for the intended use.
It is stilt not clear why no notice of the Neighborhood information meeting was ever sent to the affected Civic
Associations, but based on the record as it exists to date it is our recommendation that no further pr(eeedings occur until a
Ne g boyhood Information Meeting be held with reasonable notice in order that Community input can he a part of the
decision making process.
