Agenda 03/27/2018 Item #16D1603/27/2018 EXECUTIVE SUMMARY Recommendation to approve a Second Amendment to the Agreement between Collier County and Big Cypress Housing Corporation (BCHC) to change the method of payment from a loan disbursement to a reimbursement for services method of payment and extend the performance date of the contract. OBJECTIVE: To continue to promote affordable rental housing strategies for low- to moderate-income persons through the State Housing Initiatives Partnership Program (SHIP). CONSIDERATIONS: The FY2013-2016 Local Housing Assistance Plan allows for SHIP funds to be expended to promote housing affordability and particularly to acquire and/or rehabilitate the rental property. A solicitation for a rental strategy was released on February 29, 2016, and BCHC was awarded $500,000 on June 28, 2016, Agenda Item 16D17. Through this Agreement, BCHC will rehabilitate rental units at Main Street Village located at 104 Anhinga Circle, Immokalee, Florida. The agreement requires BCHC to conduct rehabilitation activities on no less than 40 units to include general property improvements. Rehabilitation will be performed by a general contractor and/or from contractors in specialty trades. BCHC will perform the overall contract management and administrative tasks as it relates to this project. On April 25, 2017, Agenda Item 16D3, the Board of County Commissioners (Board) approved the First Amendment. The Big Cypress Housing Corporation’s contract with the County allowed for two loan payments of $250,0000 after the of execution of a SHIP Mortgage and Promissory Note. The documents were recorded in public records, book 5431 and page 2185, on September 1, 2016. The first loan payment was rejected by the Clerk of Courts Finance Department because the loan payment was determined to be an advance payment for services. Therefore, Amendment #2 allows for a reimbursement of services. The Second Amendment will include the following changes: 1. Revise the method of payment from a two-loan disbursement in the amount of $250,000 for rehabilitation activities to a reimbursement for services method of payment. 2. Extend the time of performance to December 31, 2018, to allow for completion of the project because of the method of payment change. 3. Revise language throughout agreement to coincide with the method of payment change. FISCAL IMPACT: Funds are available within SHIP Grant Fund 791, Project 33429. LEGAL CONSIDERATIONS: This Item has been approved for form and legality and requires a majority vote for Board approval. -JAB GROWTH MANAGEMENT IMPACT: Acceptance of these funds will allow the County to expand affordable housing opportunities for its citizens and further the goals of the Housing Element of the Collier County Growth Management Plan. RECOMMENDATION: To approve and authorize the Chairman to sign a Second Amendment to the Agreement between Collier County and BCHC to change the method of payment from a loan disbursement to a reimbursement for services method of payment and extend the performance date of the contract.
