EXECUTIVE SUMMARY
Recommendation to approve an Amendment to the Amended and Restated Developer Agreement
(DA) between the developer of Parklands Planned Unit Development, Parklands Associates I,
LLLP (Developer) and Collier County (County) to extend the date of the intersection improvements
at Logan Boulevard and Immokalee Road (This is a companion to Agenda Item 16.A.2).
OBJECTIVE: To extend the date of the bridge improvements at Logan Boulevard and Immokalee Road
to be completed prior to the 495th Certificate of Occupancy within the Parklands Planned Unit
Development (PUD).
CONSIDERATIONS: Logan North will be constructed in two phases. Phase 1 from Treeline Drive to
the southern entrance of the Parklands PUD has been constructed. Phase 2 will be from the Parklands
entrance to Bonita Beach Road in Lee County and is currently under construction to the Lee County Line.

The Developer Agreement is dated May 10th, 2016, and recorded at Official Records Book 5274, Page
411, of the Public Records of Collier County.
Paragraph ten of the DA requires the Developer to improve the intersection of Logan Blvd and
Immokalee road prior to the 181st Certificate of Occupancy (CO), which requires modifications to the
bridge. It has come to staff’s attention that the bridge located at this intersection is owned by Stock
Development. Working with Stock Development, staff was able to perform an inspection and load rating
of the bridge. Staff will be requesting authorization to accept the bridge into the Coun ty system as a
companion item to this amendment.
Upon approval of acceptance of the bridge, the County will have the authority to authorize the Developer
to work on the bridge improvements. Paragraph 10 would be amended as follows:
Prior to receipt of the certificate of occupancy for the 495th dwelling unit within the Development, or by
September 30, 2019, whichever comes first, the Developer, at the Developer’s sole cost and expense,
shall have completed the Logan/Immokalee Intersection Improvement, which includes two (2) additional
southbound lanes for Logan North at Immokalee Road and is more particularly shown on Exhibit “A”
attached hereto and made a part hereof. If the Logan/Immokalee Intersection Improvement has not been
completed prior to receipt of the certificate of occupancy for the 495th dwelling unit within the
Development or by September 30, 2019, whichever comes first, no further certificates of occupancy shall
be issued until the Logan/Immokalee Intersection Improvement is completed.
All other sections of the DA are to remain the same.
FISCAL IMPACT: This is no fiscal impact with this amendment.
GROWTH MANAGEMENT IMPACT: The proposed agreement is consistent with the Long-Range
Transportation Plan and the Growth Management Plan.
LEGAL CONSIDERATIONS: The County Attorney prepared the attached Agreement, which requires
majority vote for approval. This is a companion item to, and conditioned upon the approval of,
acceptance of the Logan Boulevard bridge. -JAK
