EXECUTIVE SUMMARY
Recommendation that the Board declare that emergency conditions exist at Clam Pass inlet;
authorize an expedited procurement process to obtain quotes and quickly mobilize a contractor;
authorize the County Manager or his designee to negotiate and execute a contract to be presented
to the Board for “after-the-fact” approval at the next regularly scheduled meeting; authorize
Tourist Development Tax funding and the associated budget amendment for this project; and make
a finding that this item promotes tourism. (Fiscal Impact $434,500)
OBJECTIVE: To quickly mobilize a contractor to address critical conditions at Clam Pass inlet and
apply sand on the significantly eroded section of Clam Pass Park.
CONSIDERATIONS: Clam Pass is a very small natural inlet affected by wave energy. The cumulative
effects of an active tropical season including Hurricanes Irma and Nate, and several cold fronts in October
through March caused significant shoaling of the inlet mouth and have eroded the beach access point at
Clam Pass Park. A condition survey of the inlet and adjacent beach was completed on March 6, 2018. The
total available sand within the permitted dredging template is approximately 8,000 cubic yards. The inlet
channel (section A) and the immediate flood shoal area (section B) hold more than 6,000 cubic yards of
sand while the interior part of the flood shoal (section C) holds approximately 2000 cubic yards within the
permitted dredging template. The attached plans show the potential sand placement area. The total
volume available within the inlet dredge template can be used to augment beach erosion and replenish the
beach fill template between R42 and R43 in the Clam Pass Park access and concession area. The access
and concession area receive the highest use and sand will be placed in this area where it is needed most.
The estimate cost for the project is as follows:

Staff is recommending that the Board finds that the critical inlet shoaling at Clam Pass has met the criteria
for emergency maintenance dredging. These facts along with the importance of getting work underway
prior to Turtle Nesting Season, supports staff's recommendation that the Board declare that emergency
conditions exist.
TDC BOARD RECOMMENDATION: This item is scheduled to be presented to the Tourist
Development Council at their regularly scheduled meeting on March 26, 2018.
PBSD BOARD RECOMMENDATION: This item is scheduled to be presented to the PBSD Board for
approval at a Special Session on March 26, 2018 at 1:00 pm.
FISCAL IMPACT: Funding for the proposed Clam Pass project is not presently budgeted. A
budget amendment appropriating reserve funds from TDC Beach Renourishment/Pass

Maintenance Fund (195) Reserve for Capital Outlay in the amount of $434,500 will be
necessary.
GROWTH MANAGEMENT IMPACT: None
LEGAL CONSIDERATIONS: Ordinance No. 92-60, as amended, provides that pass and inlet
maintenance is an authorized expenditure of tourist development taxes. The Board of County
Commissioners must make a finding that this expenditure of tourist development taxes promotes tourism.
The Board may accept the recommendation of the Tourist Development Council or the Board may make
its own finding and recommendation. Section 255.0525, Fla. Stat. and Section 8(17) of Collier County
Ordinance No. 2017-08, as amended, authorizes the Board to alter the procedures required for
competitive solicitation in any manner that is reasonable when emergency circumstances exist. The
Board may find that emergency circumstances exist at Clam Pass inlet and Clam Pass park and autho rize
waiver of the County’s Procurement Ordinance. This item has been approved as to form and legality and
requires majority vote for approval. - CMG
